Couple of months back DOS released the FY 2011 Visa report.
In FY 2011, 23,997 Green Cards has been given under EB2 India category, while EB3 India has got 4,002. For China, EB2 number was 8,257 and EB3 number was 2,542. It is very interesting to see 25,229 green cards were given under EB1 category; 66,804 under EB2 Category; 37,425 under EB3 Category; 6,381 under EB4 category and only 3,463 under EB5 category.
In FY 2010, 19,961 green cards were given for folks under EB2 - India category. In FY 2009, it was 10,106 and in FY 2008 it was 14,806.
What this helps to answer is the repeated question of how much spillover does EB2 - India category get from EB1, EB4, EB5 and EB2-ROW.

So what is your thought on how much the spill over would be?

DeleteAmbals, how do you speculate it will be low this year. As you can see spillovers have increased under current administration because of an increase in audits after 2009. Many people had lost their jobs and lost EB3's when they were porting to EB2's. Exactly how do you reach this conclusion?

Spillover typically will be known only at the end of the year. But, DOS/USCIS does estimates based on previous year. Normally they take that into account only from June onwards. FY 2012 was exception, where they started from October. We have to wait and see how they do it this year. My guess will be from June 2013.
DeleteIf Spillover is added in June then when did they add the spillover for last year because the EB2I was "U" from May-Sept. Where have all those visas gone ?
DeleteSo in FY -2012 they started adding spillovers to India/China from the begining of the FY ? In that case why do you think we are still so far behind in the PDs? Is it only due to EB3-EB2 portings? It somehow appears way too much porting. Even if we assume all EB1,4 and 5 were consumed, still we saw a cutoff date in ROW. How can there be so many eb3-eb2 portings!!

So how come in FY11, 23997 visas were given under EB2 India?

ReplyDeleteAs you said they delayed spill over this year from July to Oct. In that case, then spill over would be 15 months spill visa????
ReplyDeleteWondering is employment-based GC wait for Indians and Chinese nationals can be challenged in Federal courts and there is a precedent in such cases. Does it fit the test of discrimination and infliction of undue pain on green card seekers even while receiving tens of thousands of dollars in taxes. Shouldn't the priority be based on first-cum-first-serve basis? How was the 7% country quota determined? Why not apply the quota during the initial stages of GC itself and avoid the inhuman treatment by imposing multiple years of restricted employment and location mobility? These are all valid questions that the law makers need to answer to all GC seekers, more so, that these workers have already contributed millions of dollars in taxes and fees. I wonder if the bloggers or the readers have any thoughts on this. Is there is at all a legal and human rights basis that this issue can be pursued?
ReplyDeleteI hear you. Unfortunately, any such movement can be lead by citizens (from India). Frankly they don't care and they don't even understand the process and are not even willing to listen since their ship has sailed. I have more respect for people from south, they support their community in spite of the fact they broke the law.

ReplyDeleteWho cares, India gets more than its fare share anyway. Stop being so greedy and wanting the spillovers, you get far more than any other category anyway.
