May 2013 Visa Bulletin and Analysis



May 2013 Visa Bulletin was released earlier today. Date for EB2 India is 01 SEP 04 and EB2 China is 15 MAY 08. The cut-off for EB2-ROW, EB2-Mexico and EB2-Philippines is Current.

As expected the EB2 India has not moved. The good news here is EB2 China dates are moving, which means till EB2 India reaches that date, it can consume all the spill over numbers that comes to  EB2 category.

The demand data for this month has been released earlier and then another revised one. It is interesting to note that the cumulative demand prior to Jan 1, 2005 has raised to 425 from 375 from 300 and the cumulative demand prior to 1 Jan 2009 is 23,850 from 23,400 from 23,975. May be data errors/May be porting from EB2 to EB1. But, the porting is at constant pace as per this demand.

What will happen next ? Like mentioned in the earlier posts, USCIS/DOS has gone back to their earlier strategy -- where in they wait till last quarter of the FY to determine the number of visas to give for EB2 India and China, due to spill over. Given this, I expect lot of movement in July. Going by today's data, it might go to 1 Jan 2008. But it will depend on the spill over that EB2 India gets and the number of porting cases. I still expect the dates for EB2 to go to 1 Apr 2008 in Sept 2013 Visa Bulletin.

Cut-off dates for EB3 India is 22 DEC 02 and EB3 China is 01 DEC 07. As expected, EB3 India is moving at one week or two weeks per month pace. For EB3 India, it is going to move at this pace only till there is a legislative change. The reason being there is no spill over to EB3 India category. Hence only about 2800 green cards are given for this category every year.

Focus is currently on the 8 Senators trying to come up with Immigration Reform bill which is expected during next week.

    2. My case is EB3 India 2004 Aug. According to your analysis, does it mean that when the demand is more in a particular category, it will move faster. As people are porting from EB3 to EB2, the demand in EB3 has decreased, hence the movement is slow?

  5. After the PD is reached, how much time before we can expect GC. What options do you have to ensure you get GC before the dates goes back again.

    1. If you have filed I-485 and done all the formalities, then within the end of that month. If you not files I-485, then about 4 months. You can always contacts USCIS and open SR. You can also contact your Congressman or Senator's office.

  12. A dumb question.. If I see the demand data correctly China have only 6125 in EB-2 . If this China EB-2 goes current say next year, then all spillover from EB-1 will go to India ( assuming for next demand for China EB-2 is less than their quota)

  25. My PD Feb 2006 , recently ported my EB-3 to EB-2.
    485 pending and have an EAD.
    Should I expect it to become current on June 10th release ( July 2013 bulletin) ?
    Once it becomes current, Can I expect the GC to be printed by end of July or would it take beyond September 2013.

    1. If all the formalities are done and if there is no RFE, typically, you should get your Green Card in the same month it becomes current.

    2. When I spoke to USCIS couple of weeks earlier they mentioned that my case is pre-adjudicated..
      I think that means 485 is inter-filed with EB-2 and all the review/process is done and they are waiting only for a visa number.
      Am I right? So with your above reply I should have the GC by end of July most probably.. Right ?

    5. You Can call 1-800-375-5283 and ask for the 2nd level customer service / Immigration officer.
      He will ask for routine verification questions first and then you can ask him/her whether your I-485 is upgraded to EB-2 and also if your AOS is already pre-adjudicated... Let me know how it goes.

    People have started treating you like an astrologer :). 60% of the messages here are like "my PD is so and so, when will I get my GC". Despite you repeatedly telling that it takes 5-6 years from PD date, still people keep asking. It shows they dont read the comments at all. People should be contributing what they know in the comments so that everyone gets benefited instead of just throwing questions their lawyer should ideally be answering.

  29. The E2 date has not moved for last 8 Visa Bulletin, it was 01SEP04 in Oct '12 and is the same in May '13 Bulletin. However for China (for example) it at least moved for a year in this duration, i.e. 15JUL07 to 15MAY08. Not sure if I still get it - why is there not even a single week movement for India over last 8 months while there are movements in China – also if we go by the logic that the numbers are release in last quarter of FY, then there was no update during last Jul – Sep period, all the while data was unavailable and then ‘07 date went back to ’04 date, so what make one believe there will be progress in Jul – Sep this year and even if it does guess June '13 bulletin will have same PD of 01SEP04?

    2. Last year was totally different. See the previous years -- EB2 India has been same for most of the year except last 4 or 5 months. On the top of this, this year the porting seems to be about 300 visas per month just going by demand data. Given all this, the estimate is that the spill over will be applied in last quarter and the dates will move.

  33. Hi, my PD is Feb 25, 2008, i have so far file only I-140. when do you expect this date to be current? Is I-485 the last step? Within the month of my PD being current, if i file for I-485 then how long would it take for me to get my green card?

    says the bill will contain -

    1.) Recapture (from unused GC since 2001)
    2.) Elimination of per-country limits
    3.) Exemption for dependents
    4.) Exemption for US STEM graduates
    5.) Ability for H-4 to work (if your country of origin reciprocates the same)
    6.) 60 days Grace period on H1


    Any idea how did they get this information? I dont see these points clearly mentioned in any websites. Is it something internal they have come to know?

    2. I found more details. For the legals the initial set of offerings looks like

      1. elimination of siblings GC thereby freeing up some percentage of the numbers to EB.
      2. Exceptional (STEM) category will be out of quota which essentially means current EB1 will almost be totally moved to EB2.
      3. Removal of diversity GC ( 55K).

      Above 3 steps can potentially add 150K extra GCs for EB which will tremendously help clearing backlog in EB2 and EB3.

      Question which of the above will be blocked or amended potentially. I believe Democrats will not let Diversity visa go away ( Recolloct that they stoped the same once in last November). Still it's a pretty good deal for EB if passes.

      1. removing sibling GC
      2. removing diversity GC
      3. making PhD or MNC executives out of total quota

      will free up lot of green card numbers that will be used in EB category. Notice that it says 40% of that will be used in each EB category. Let's assume by above actions, total 160K additional GC are freed up, so the total EB number is going to be current 140k + 160 K = 300K. 40% of that is 120K as a whole given for EB2 or EB3. Even if they dont remove country cap, such a number is a good amount.
      I would think when they introduce the 'merit programme' after 5 years, EB based green cards will no longer be there. Above actions are only to clear backlogs.
      The bill is very promising for us but there is hardly any chance the above proposals will pass.

    1. Actually the bill is sprinting. There is a judicial hearing in senate scheduled for 19th. If you're talking about legal and h1b component of the bill, you know it may not even happen since its mostly about vote bank

  45. I went through the legal part of the bill and here is what I understood.
    Let's assume it passed before Oct 1, 2013.

    1. Country cap removal - starts from Oct 2014.
    2. recapture of unused GC from 1991 - starts from Oct 2014.
    3. Exemption of dependents in total demand data - Not clear when this starts.

    From Oct 2014, Merit based system Part-2 activates. Part-1 starts 5 years from enactment. All the EB based people waiting for 5 years BEFORE THE DAY OF BILL PASS ( approx PD before 2008 Oct ), will be automatically put into Part-2 of Merit system. They will be divided into 7 batches to be cleared in 7 years !!!

    Then the STEM part- that's weird too. People who applied for GC WITHIN 5 YEARS of graduating as STEM are eligbile to be treated specially i.e. out of total limit.

    The bill is no good for people in EB3-I. Person with EB3 PD 2008 will receive GC in 2022. It's better than current process but not as good as everyone hoped.

    Also it does not say people who has PD after 2008 and in the queue, what happens to them. To what Merit system they fall under.

    You've said that a spillover of 13000 visa numbers is predicted for India and China this year.

    Is this true?
    If so, doesn't this mean that almost all of these numbers will spill over to India, since China is already at 2008?

    Is this the basis for your prediction that India will move to late 2007/early 2008?

    Isn't there a lot of ambiguity in the number of EB3 to EB2 porting cases happening every month?

    Can you please elaborate on how this might affect the movement in July?

    5. Here is the outline of the journey.

      1. May 7th is the last day for submitting amendments to the senate bill. A dozen amendments are expected.
      2. Debate on senate starts in June.
      3. House version of the bill is yet to be released.
      4. Once #3 is done, house will debate.
      5. Only if both #2 and #4 clears i.e. both the bill passes. house and senate then start to 'merge' the bills into a commonly agreed one.
      6. The above step is the most difficult one, if that too passes then it goes to white house for final signature.
      7. After that it becomes law, then USCIS needs to be trained with the new system which could take months.

      Realistically, step 7 can only start sometime middle of next year. Until then we only have to hope on spillover numbers.

  52. Recently, I received a renewed EAD until 2015. My PD is Dec 2007. Given the predictions by your blog it should be current by Aug/Sept 2013. But I am a bit puzzled as to why it was renewed for 2 years. Does that mean the dates won't move? Is that an anticipation on USCIS's part?

      Your EAD is just your's, its got nothing to do with anything else in this world, and just to be clear by anything, I mean Date movement, immigration reform etc.. Since you applied for a renewal, they just renewed it for the standard time that is allowed.

    3. Actually if the bill passes this year, by the end of next year there may be an opportunity. It depends on different factors, like are you a STEM degree holder, when did you file after graduating, etc. I think apart from the bulletins every month, none of the 2010-2011 and onwards date will be current until Oct 2014. I guess thats what the bill says for pending cases.

  62. On Q's immigration form people are discussing on 20K extra EB2 Cases reported this year which weren't accounted previously. So some people heard from their attorneys that EB2I PD will retrogress during Q4. Have u read/heard this news ambals?

    1. Actually if the reform goes through it will definitely help EB2 and EB3. There are many people with MS in EB3.   69. While everyone is hoping for big date move in the next three months, here is what I think is practical. It's true that the date for EB2 India might move up to as far as 2008 but, the reality is it can't stay there for longer. If you look at the demand data it's obvious that porting is much higher than people have anticipated. In fact this month's data shows that the cumulative porting was 600+. This will continue going forward and USCIS will be concerned that the yearly EB2 India quota will reach soon thereby they will retrogress the dates again. Here is a clearer picture
    1. next month date moves.
    2. At Oct 2013 bulletin, let's say the date is 2008 Jan 1.
    3. Porting continues at the rate of current, making the total porting amount before 2008 much higher than the monthly available GC.
    4. So as early as Nov bulletin, the date moves back to 2005.
    5. It stays like that until the last quarter of 2014.
    6. Again the date moves, porting continues and the cycle goes on until all EB3 porters before 2008 finishes.

    Therefore, my guess is, every year, effectively 3 months are available for EB2 applicants to get their GC done. It sounds pessimistic but it's fact.

  75. My priority date is Dec 2007. I see that they issued and RFE, but haven't received anything in the mail too. I havent changed my employer since my 485 filing. Will have to wait and see what they are asking.

  76. ha ha ha - gotta love the HUGE MOVEMENT in EB3. You greedy greedy indians, all ported from EB3 to EB2 thinking you could defraud the system. Now look what's happened, EB2 has slowed, EB3 is racing through. Thanks for doing that, my EB3 ROW jumped nearly 2.5 years, I'm now current and already filed.
