June 2013 Visa Bulletin and Analysis



June 2013 Visa Bulletin was released earlier today. Date for EB2 India is 01 SEP 04 and EB2 China is 15 JUL 08. The cut-off for all other EB2 countries are Current.

As expected the EB2 India has not moved. The good news here is EB2 China dates are moving, which means till EB2 India reaches that date, it can consume all the spill over numbers that comes to  EB2 category.

The demand data for this month had been released earlier. The cumulative demand prior to Jan 1, 2005 rose to 450 from 425 from 375 from 300 and the cumulative demand prior to 1 Jan 2009 is 24,050 from 23,850 from 23,400 from 23,975.

July, August and September Visa Bulletins will be the last 3 for this Fiscal Year. I am still hoping EB2 dates will start moving from next bulletin onwards. Now, how much movement is all dependent on two main factors -- how much spillover EB2 India will get and how much porting will happen.  Going by this month's demand data, the porting is increasing steadily. Assuming, USCIS/DOS is giving about 260 per month green cards till date for EB2 India. Then, if the spillover is about 10,000 then the dates will move to 01-JAN-08. I am hoping atleast that will happen.

Cut-off dates for EB3 India is 08 JAN 03 and EB3 China is 01 SEP 08. As expected, EB3 India is moving at one week or two weeks per month pace. For EB3 India, it is going to move at this pace only till there is a legislative change. The reason being there is no spill over to EB3 India category. Hence only about 2800 green cards are given for this category every year.

    In your earlier post you were saying EB2I will get 18,000 visas as Spillover. But in current post you are estimating there will be around 10,000 visas as spill over. Could you pls let us know onto why spill over is getting reduced for EB2 India? And other question I had, will they move straight to Jan2008 or they go with stops to that date?

    1. No. All I am telling is, we still don't have clear data on what the spillover is going to be. It will be nice if we can at-least get 10,000.

      Mix it well and let it cook for minimum 5-6 years without adding any emotions or efforts to the recipe. Just like wine older it gets better it taste.

  5. With EB2 ROW moving further most of the spill overs could be used. So what EB2 I will get is mystery. But JUNE VB will reveal this.

    1. Spill overs are never revealed in the VB.

      VB is just to stop more people rushing in than needed. Since there will be some spill overs (which no body knows how much, till last month of the year) So VB will move to a certain date, depending on the Employment demand but it will not indicate how much was spill overs. This movement is just a guesstimate but not a real indicator.

  7. One has to understand all this theory n possible prediction is based on data available. EB2 dates may move for 2008 , again we all waited till now I think one month patience needed to see possible change in dates.

    2. I believe Oct 2014 date was for the point system. Other changes might take effect immediately. This is my understanding as there is not not much clarity as of now on immigration bill.

    6. What is point based system then if it is not same as merit based system? The link does not have a separate category listed for point system. I think they are same and it does gets implemented before 5 years.

    7. I think my comment above yours was a little confusing. What I meant was there will be immediate help to people with MS and PhD's in 2014. The point based system like they have in Canada will get implemented after 5 years. So if you have a PhD, you wont even be counted in the inventory. If you have a MS degree and if your PD for EB is withing five years of graduation, you will be exempt just like PHD.

    10. In short, the point based system like they have in Canada does not come into effect till like 2018 or 2019. IF CIR bill passes we will see significant reductions in backlog next year. Unfortunately, doesn't look like it will pass as it it w/o major amendments for legal aliens.

    4. Once you file I-485 -- there is FBI name check and you need to do finger printing. So, it might take about 3 months. You need to hope for 2 things: one -- your priority date to become current and two -- it stays that will till you get your green card.

    Has EB3->EB2 (for India) porting inreased year over year past 3-4 years? i.e. how much cumulative demand prior to Jan2004, Jan2003, Jan2002 etc...existed in prior years' Q3 visa bulletins?

    A simpified way to put it is, has porting increased in recent years? If so, what you think is primary reason? The rules haven't changed now then they were in the past years, have they? If not, then is it just more awareness of that option among the EB3 community?

  14. With the current porting rate (before Sept 2004) EB2-I will use the quota this year without any movement in visa dates for EB2-I. There are 1000-1200 applications pending between Sep - 04 to Feb - 07 as per last 485 inventory. Even if USCIS assumes porting will be steady (~300 per month) and spillover is 10000 the dates won't move beyond Feb 2007. I am not sure how it will be Jan 2008 unless I am missing something else.

    The truth is porting will be much higher in later months, so if USCIS is cautious in moving dates next month we might not even see 2007 dates this year.

    1. The spillover prediction for this year was 13000 as of last month.

      If not, wouldn't that push the date to Jan 2008?

    2. No one know what the spillover will be. We might get a better idea when latest 485 inventory data is released. Even if we get 13000 the best date can only be July 2007.
      Also, I am not sure when ambals said 1000 spillover, did they mean spillover from EB category alone or from FB too. Though we might not get all 18000 from FB but we will get good chunk of it. That can cause the dates to move forward more.
      How the dates move forward will depend on whether USCIS considers porting in calculation or not. My guess is they will, and in that case dates wont move much.

    I had few questions.

    1) Does the demand data contain only those applications for which I140 has been approved and I485 has not been filed, or does it only include only those application for which 140 has been approved and I485 has been filed or does it include application for which I140 has been approved irrespective of whether I458 has been filed or not?

    2) Does the demand data for EB2 also contain applications which have have been successfully ported from EB3 to EB2 (I140 approved under EB2)?


    3) Does the inventory report contain only those applications for which I485 has been filed?

    1. I am not sure if I got your question right... demand data has nothing to do with I-140. Demand data is the number of I-485 applications pending at USCIS and have not been issued a visa number. If you are asking 1, 2 or 3 to be picked, then its 3.

      I was trying to understand whats is included in the demand data and in the inventory report.I always thought that the demand data report included applications for which I140 was approved irrespective of whether for those application I 485 was filed or not (i.e.irrespective of whether the date was current or not).

      On the other hand I thought that inventory report contained only those applications for which I 485 was field but are pending since thier dates are not current any more(i.e. dates are retrogated).

      Is my understanding correct?

    4. The demand data report includes I-485 cases and not I-140. I-485 cases include the whole family numbers. But as we all know that I-485 can be filed only when priority date is current, the number of porting cases are still unknown. As soon as PD is changed from 2004 to let's say 2007, all the porting candidates with PD on or before 2007 will join the demand data.

      If 300 porting cases are being added every month when 2004 is current, just think what an avalanche it will be when dates are moved to say 2007.

    1. EB2-I gets 2800 every year. All that is currently and will be consumed due to porting with priority dates before Sept 2004. If there is no spillover EB2 will not move forward at all this year.

  18. What does pre-adjudicated mean? how do we know whether an application is pre-adjudicated or not? If I dont receive an RFE does that mean 485 is likely to have been pre-adjudicated?

    1. You can call the USCIS customer service number and talk to L2 officer to see if your application is pre-adjudicated (everything is good to go and waiting for PD to become current)

    1. They are 2 different numbers. I-485 data has just the I-485 numbers that are pending. Demand data has the pre-adjudicated I-485 and the applications pending on consulates outside of US.

    Are you familiar with US politics rules? The question is can Senate override House decisions? If Senate passes the bill next month while House has not even come up with their bill yet, will the bill be hanging until House comes up?

    1. If the senate passes the bill, it will go to the House. It is upto the house to take it up or not. But, the same bill with exact same wordings has to be passed by both House and Senate and signed by President -- to become law.

  29. Visa on Passport expires in June 2013. I 797 expires Oct 2013. I will be out of US in July either on business or unpaid leave to India. If i go thru a consulate to get visa till OCt 2013 will I face any issues in the interview since I will only have 2-3 months on my visa?

EB spillover 130000.. plus FB spillover 18000. so totally 31000 thousand visas available for EB2 retrogressed countries (India & China) ..Since China's PD moved advance most of the spillovers will go to EB2 India to match with china, End of this Fiscal year both india and china will share the same PD. so expected PD for EB2 india will be March-2008 within next 3 months.

  32. FB spillovers goes to all the categories, So EB3 (I) will get some more additional visas,so there will be some movement (30 days) in next 3 months in Eb3 category. Eb2 will get some numbers from FB and more from EB spillovers. China 15JUL08 will be matched in best case. Expected PD for EB2 india for next 3 months will be b/w Jan 2008 to March 2008. So guys get ready to file your 485 if u missed earlier. all who filled best of luck for your GC.

    1. If EB4 and EB5 doesnot use, it goes to EB1, if EB1 does not use, it goes to EB2. In EB2, till EB2 India reaches EB2 China, everything will be used by EB2 India.

    1. As far as my understanding goes, DOS sees primarily the Demand Data (pre-adjudicated) to set the dates. They do get input from USCIS on porting and I-485 inventory.

  41. very unlikely that EB2 India will move beyond 1st January 2005 in July 2013 VISA bulleting. If at all there is any major movement, that will happen only in August or September VISA bulletin.

    1. My attorney says the same.. He thinks chances of it moving to 2007 is only 2 %. All we have to do is wait and see what happens. I don't think these calculations can give any estimate or predict the dates in next VB

    The priority date cut-off for EB-2 India could advance as far as February 2008 in the August or September Visa Bulletin, according to Charles Oppenheim, the senior State Department official responsible for visa control. The EB-2 India cut-off date has been stalled at September 1, 2004 since October 2012.

  48. Also, one more thing- Let's say my October-2007 becomes current on Monday- will there be a room for to get the GC or this may retrogress with the backdated and I might miss the GC window? In short- how long the October-2007 should remain current for to have the GC generated from their office.

    1. Assuming, you become current in July visa bulletin and you have filed I-485 and all the formalities are done and your case pre-adjudicated, then you should your GC in July itself. If you will only file your I-485 in July, then it might take 3 months processing, so you need to watch for the dates to stay current till you get your green card.

To that note- let's say- I file everything in July time frame- what are the possiblities of having the date remain current for Oct-2007? Do you think, it will remain current for another few months based on your analysis..

    1. Surely it will stay till Sept. We have to wait and watch what will happen in Oct. You need to have birth certificate and marriage certificate. Those are the main things from your side.

I have those two ready- However, my BC has the First Name but doesn't have the last name in it( as you know Indian BC doesn't have the last name seperately mentioned).My father name however has the last name mentioned. I think that should be OK? right? Also, Do you by anychance know- how much would be the cost of filling the I 485 for me and my spouse? I think my company will be paying but just curious.

    7. But my first name appear same as it appears on the Passport so why there would be an RFE? My first name in passport is exactly what that shows on my BC. It is simply that the surname column in BC is not available and that is why that it doesn';t

    8. My parents are here in the US with me visiting. Can I get the Birth Certificate affidavit done here in the US? What does the BC affidavit look like as in what information does it contain? Can it just be notarized by a Notary Public?

    1. Based on the demand data, we can't predict anything...as USCIS said April-2008 will be the final PD for this year..so the next 3 VB as follows July-->sep-2007, august-->Jan-2008, Sep-->April-2008

  57. In July 2013 visa bulletin, USCIS, in the last few paras, has given some prediction/indication of the possible movements in August 2013 and September 2013 bulletins!! Can Aditi and Ganesh throw some light on those indications given by USCIS itself?
