August 2013 Visa Bulletin and Analysis


GOOD NEWS !!!

August 2013 Visa Bulletin was released earlier today. Date for EB2 India is 01 JAN 08 and EB2 China is 08 AUG 08.The cut-off for all other EB2 countries are Current.

As reported earlier by The Oh Law Firm website, the EB2 India dates has moved to 01 JAN 08.


The Visa Bulletin predicts that it will generate enough demand to keep the date as it is. It kind of indicates, there might not be any movement of the dates and the movement will be based on how much demand this will generate. I still hope it moves forward, say to, 01-APR-08. But, we have to wait and see.


Also, I think it will retrogress back to earlier date in October 2013 visa bulletin. This is the reasoning behind it -- theoretically all the EB3 applicants can port to EB2. As long as there 300 or more porting, DOS will have to retrogress the date and keep it like that till the spillover is determined.


Cut-off dates for EB3 India is 22 JAN 03 and EB3 China is 01 JAN 09. As expected, EB3 India is moving at one week or two weeks per month pace. For EB3 India, it is going to move at this pace only till there is a legislative change. Also, EB3 China is ahead of EB2 China dates. :)

  1. 18K Visas spilled over from FB to EB category. This should help EB2 move past Jan 1st 2008 given the port ins from EB3 to EB2 did not use up all of them.

    1. This is a very old news (may be 6 months old), this 18K spill over is accounted for in all VB from last 6 months or so. This 18K is equally divided to all EB's (1, 2, 3, etc). Also it is divided country wise, so India would have received some extra EB2 GC, which are already accounted for.

      Again, exact spill over which comes from un-used GC (From other countries, from EB4, EB5, EB1 to EB2 India) is still unknown. So don't get confuse with this spill over numbers with the FB spill overs.

  3. Hi. Thanks for this info.
    I have a question. MY 1-40 was approved under eb 3 and I-485 is pending with teh priority date of dec 2005. My perm and I-140 got approved earlier this year under EB2 . Doe that mean my 485 application is automatically transferred to eb2 or need to be filed again in august?

    1. You don't have to file I-485 again. But, you need to file a request to interfile (basically, use the EB3 I-485).

  4. How much visa spillover is expected to EB? Someone mentioned 18K - what is the source of this?

    Last month's demand data showed 8050 EB2I applications prior to 1JAN2008. If the spillover is truly 18K that should translate into an additional 10K visas, which should push the EB2I priority date maybe 1 to 3 months beyond 1JAN2008?

    First of all, thank you so much for your selfless work and keeping us posted on all the developments.

    My EB3 priority date was Oct 2007 and this year my EB2 PERM and I-140 got approved. Since, we got only 2-3 months of my date being current this year, does it mean that I would get only the EAD this year and wait for my GC next year?

  9. Ambals, thanks in advance for your service. My priority date is Oct 8 2007 and I am on EAD with 485 filed last year. I read that there is a demand of 8050 , so does that mean that they will issue 8050 green cards in 2 months ? My attorneys are preparing the reply to RFE such that USCIS will receive employment verification document befor Aug 1st. Doeas this mean that I will get the GC for sure in Aug/Sept ? USCIS might call for biometrics/Medicals again, if they call again still 2 months will sufficient get GC ?

    I see that the last 3 times when steep retrogression happened was in June 2009, June 2010 and June 2012. So why should it be in October in the next year? What am I missing?

    1. DOS keeps changing the strategy every year. I think now they are stabilizing on the facts about porting and retrogressing. Given that, I feel it will be retrogress in Oct 2013. They might totally do a different thing.

  20. Ambals - thanks very much for your selfless support and hard work. My PD is EB2 Jan 07. I didn't receive an RFE and my online status has always shown 'accepted' since the I-485 filing. Do I need to be wary of anything or do I need to do anything at this time? I want to make sure I don't miss this chance.

    1. There 2 theories. No one knows what is good. One theory is leave it alone, you will get it on-time. Another theory is raise infocase, contact congressman and Senator.
      This is what I would do, research and keep the information about how to contact Senator's office and what form to fill. If I don't get my GC by Aug 15, I will go ahead and do that.

  22. EB3 - PD Feb 2006, I-485 pending since 2007. Have an EAD.
    EB2- PERM and I-140 approved. PD ported.
    The laywer says he already did interfiling at the time of I-140 application and at the same time he said their firm will interfile it again when PD became current.
    When I called USCIS few months back about an update in address, they told my case is pre-adjudicated.

    Does this all mean, I am all set and if nothing else comes in the way , I should have GC by end of August ?

    Also if for some reason USCIS take longer to process (God forbid that..), and if the date retrogress will the GC issuance be held off or would the visa number assigned to my case in the next two months will be used beyond Sept 2013....

    1. My data analysis support for Priority dates to go only to 01-APR-2008 in September 2013 VB. But, There are unconfirmed reports from Oh Law Firm website and other websites, saying it might go till 08-AUG-08 to match China numbers in September 2013 VB. In FY 2014, there will be movement in july, aug, sept 2014 VB.

  28. Our PD is oct 2006 and ead s was approved in early 2007 under eb3 category. Two month back we got I-140 approved under EB 2. As per my attorney we don't have to file any other papers and we should be getting out GC now that dates have moved forward for EB-2 India.
    Is that correct. I have read something about interfiling but my attorney says he has not even heard of it.
    Also is there any way I can check with uscis if our case is been approved / pre adjudicated and is line for green card

      If you have already captured the date on your New I-140, means when you applied for new I-140 under Eb2 and have already captured the date from Eb3 (your i-140 under Eb2 should show the same priority date Oct 2006)In that case your attorney is right. you dont ahve to do anything but just apply for I485 when it becomes current.

    2. Thank you so much for your response. We applied for I 485 back in 2006 concurrent to I 140 ( which was current for schedule A occupation at that time).. We are on ead since thn. What is our best course of action. As per my attorney we most likely will get a RFE for an employment letter when they look at our file after 1st of August. The company gave every thing recently when we applied for i140 under EB-2 few months back. Got approved under perm.

    3. If you filed your I-485 in 2006 under EB-3 then you MUST send an inter-file request and have the I-485 upgraded to EB-2.

      If you are not applying for new I 485 under Eb2, linkage of file doesn't happen automatically. If you are banking on just new i140 with captured priority date is suffice than in my experience that is incorrect( I did interfiling).

      What's your email? I can share my exp of interfiling and process I followed.

      From my exp I can say, you have to do interfiling after capturing old priority date on new i140 if you are not planning to apply for new i485

    I read all comments above and past few posting comments to find out some answers.
    Here ia my situation I had 140 approval with pd oct 2007, changed job in 2011 and processed gc in eb2, eb2 i140 got approved last year oct 2012.
    Now since date moved to jan 2008, I will file aos and ead both, what are the possibilities to get and Aos approval this year before oct 2013 assuming dates again moves back as happened last year..

    1. If the dates move back, sorry, there is very less chance for you to get GC. The finger printing and FBI name checks take about 3 months.

    I applied for follow to join for my wife with priority date May 2007 and now her priority date will be current in next month. So when she will expect interview date (all other documents are approved and already paid visa fees as well). Is it in august or sepetember 2013.

  37. Despite having a MS degree from US university and working in reputed company in the Bay area, I'm still waiting for my I485 and GC .

    To keep my story short, my lawyers screwed up my GC application the first time and put me in the EB3 category. I later contested and the company agreed to re-file my GC and now I have a priority date of SEP 2008 (EB2).

    Any idea when Sep 2008 might get current for EB2 category?

  45. I came to US as a student in 2002. Started work in 2005, Jumped multiple companies and hence a lousy priority date of May 2011, EB2. What do you think about the provision of fast tracking GC for individuals who have live and worked for 10 years in the current CIR bill? If this takes root will I be able to apply?

  46. Thanks for the nice blog and update. I am quite new to this. I work with Google (through an internal transfer on L2) and belong to EB2 with priority date as November 2012. As of now I have filed I-140 (couple of months back). Do any of you see foresee light for me in the coming months/years? I also hear that, the number of applicants between 2008 and 2012 are relatively small. Is this true? Any data to substantiate this rumor?

    2. Everyone who is eligible to file for I485 will file after aug 1st. So there will not be enough data by the time sept bulletin is out on how many more visas are available .     Thanks for the dedication in maintaining this blog and providing your insight. My PD is OCT 2007 with I-140 approved under EB2. I am now filing for AOS/I-765/I-131. Will I get my EAD card before it possibly retrogresses in OCT 2013? Also, can I switch jobs with EAD or no?

    1. Getting EAD has no relevance to dates. Once you apply, in the normally processing time -- about 60 days -- you should get your EAD. But, you have to be still current to get your GC.
      On switching jobs -- if your I-140 approved and if your I-485 pending for 180 days or more and if you have your EAD, you can switch to same or similar job and maintain your GC application by filing AC 21.

    "What it means:
    More people will be able to apply for I-485/I-765/I-131 now. However, approval of their I-485 may take time because of the potential slow-down or backward movement of the visa numbers ahead, sometime in 2014.
    Those with pending EB-485 may be adjudicated fairly quickly because in all likelihoold, their cases could have been preadjudicated. If they are served with RFEs, unless they can send in responses very quickly, they will potentially face a long wait for the visa number backward movement"

    Can we assume that even if porting happens,there is a processing time that still applies to ported and new applications. Can we expect that the dates would still move in the next few months.

    1. As far as my understanding goes, you should get your GC in about 3 months after you file I-485 and if the your priority date is still current.
      At this point, it looks like they will retrogress the dates in Oct 2013. We have to wait and see what strategy DOS will use.

Our hopes were dashed by the retrogressed dates in the July 2013 bulletin but has lifted once again with forward movement in the Aug 2013 visa bulletin. Hopefully many people are happy to finally received after nearly a decade on EB3 and then roll over to EB2. Keep up the good work.

  53. my priority date is october 29 2007 EB2 replied to RFE in April 2012 on I485 university name. My case status says RFE response is in review since last month.

  56. My H1b expired on Oct 1, 2012. On Sep 20, 2012 I filed for my H4 extension and got recepit on Sep 28, 2012. My H4 approval notice shows H4 is valid from Dec 12, 2012 to 2015.

    Was I out of status from Oct 1, 2012 to Dec 12? Or am I O.K. since I filed H4 before my H1 expired, I should be fine and the receipt date shows Sept 26,2012?

  57. Ambals - In the G-325 form, it asks for mother's maiden name.Both first and last names were changed after marriage and I dont have proof. Should we just use post marriage first and last names for mother ? OR should I put maiden names ? What supporting docs will USICS need ?

  59. Is there a way to find out by calling USCIS whether my GC has been pre-adjudicated?

    My priority date is EB2I February 2007. This date did become current a couple of times over the last six years and I filed my I-485 the first time it became current. It seems like they did not get around to approving it the last couple of times. I have EAD and AP.

  60. Thank you for a great blog. There is a lot of discussion here on GC approvals, but the expectation is that it will only be current for 2 months. For people that are already on the EAD and AP, another fingerprinting and medical request will mean the same status quo and these will take a few months. What are your thoughts?

    Thanks for the great selfless service.
    I have a question- my PD is Jan 17 2008, EB2 India.I thus missed out by few days when the bulletin was out y'day.

    Hopefully, if they open up the dates further in the next bulletin and say it is at 15 Jan 2008. Will I be eligible? Some blog says I would be considering eligibility applies for the whole week of 15 Jan i.e 15 to 22. Is that correct? Or I need to wait till the cut off date goes technically past Jan 17 2008. Do you know for sure which way is it?

    1. It is very clear. If the date is 01-JAN-08, everyone with a priority date before that is eligible to apply. So, even those with a priority date of 01-JAN-08 cannot apply.

  63. My guess is in Sep Visa bulletin eb2 india date will move to 01-Feb-08.

    Eb2 india is getting spillover visa numbers somewhere around 12,000 to 14,000. There are already about 8,000 I485 applications pending before 01-Jan-08. On Aug 1st, i guess there will be about 3,000 new eb2 I485 applications. This will bring the numbers close to 11,000.

    In the month of Jan 08, there is already 1,146 pending I485 applications, so my guess is they may not move the date beyond 01-Feb-08.

    For every month in 2008, there are more than 1,000 I485 applications. So even if we get 15,000 to 20,000 spill overs next year, eb2 PD will not move to 2009 by next year.

    1. Only thing is, whoever files I-485 now, may not come in the calculation as it will take 3 months or more for their case to be approved. But, there are folks who are replying to RFE, they are not yet pre-adjudicated, they will be in August.

    2. As of 01-Jan-13, there are about 8000 pending I485, and as of 02-Apr-13 there are about 8500, may be as of now pending I485 would be around 9000.

      Assuming all 9000 gets their GC in Aug, still there will be about 3000 to 4000 unused visa numbers, so you think the dates may move 3-4 months further in Sep to fully utilize FY 2013 numbers? May be it is possible.

      Then probably in Nov/Dec they may retrogress?

    2. Mine was filed in EB3 back in 2006, I moved it to EB2 and used my old PD date MArch 2007. I had filed my I485 back then and have been using my EAD ever since. I have not got any Queries.

  65. Hi, In june 2013 demand data, it shows that for jan 1 2009, the demand is 24200. What does this mean? Is this demand between Jan 2008 to jan 2009 ? or is this demand between jan 2005-jan 2009 ?

    1. If you see the left most column, it says "Cumulative Demand prior to". So, it is all the pre-adjudicated applications, that have priority date prior to 01-JAN-2009 is 24,200.

  66. Hi, I filed my I140 and I485 concurrently (EB2) in 2007 and my PD is July 2007. My PD became current in November 2011 but I didn't get my GC and the dates retrogressed. Now that it has become current in the August bulletin, is it reasonable to expect to receive the GC in August?

    1. It is totally possible for it to stay the same. But, at this time, I think it will retrogress. We have to wait and watch.

      You can apply only on Aug 1, once your priority date becomes current.

There are chances for Visa Bulletin to remain the same for another 4 months with 2008 I think it is fairly possible because immigration site says the bulletin may change sometime in 2014 fiscal year I am asking this question because that there is a possibility of having a green card approved in 3 months. Do you think that if I reach out to Senate office in first week of August after I file my 485 application that they may expedite the process and I can have my GC approved in a few months

      They need at-least 60 days to process. So, if it is current after 60 days, then, I would contact -- senator office and USCIS.

  69. I have the LC and I-140 approved (under EB2 PD SEP2008).

    What if the company I am working for gives me a promotion. Would it affect my GC process? I am currently Senior SW Engineer and the company is considering me for the Principal SW Engineer position.

    1. I am not sure. It is best to consult an immigration lawyer, show him the future job description and ask him to compare against LCA job description and ask him what has to be done.

  71. Since the recession started around end of 2008 and lasted for the entire 2009 there were many people fired and didn't apply for GC or went back not just Indians but other citizens as well. Do you foresee moving of priority dates drastically in FY 2014?

  74. I called USCIS and they confirmed that my case is pre-adjudicated. I am not sure if my attorney had submitted the inter-filing when I ported from EB3 to EB2. Any chance getting a RFE due to this?

  75. If there was no RFE, does that mean the case is pre adjucated? Last time I called USCIS (march 2012), I was informed the case was with a immigration officer. I assume the case was still being worked on even after the dates retrogressed. I also got a an extension for EAD/AP . If the case was not pre-adjucated or had some issues, EAD renewal is not possible right? Your thoughts please.

  76. Thanks for the quick reply. I had called 1-800-375-5283 and asked them for status of my I485 application. They took my information and then I got a letter via USPS in 2 weeks.

    The key point is you need to call only after what they term to be "outside normal" processing time. They will only open a query if your case is deemed to be such by the agent.

    3. I mean all I-485 and related forms for Green Card application, it is better to use the same A number.
      Very strictly speaking, A number is the one they give you first time you enter US and it should maintain in your I-94 every time, you go out of country and come back. But, that is not always the case.
