Immigration Data and Updates


First: Immigration Reform Bill that was passed by US Senate is stalled in US House. It has been announced that any immigration related issues will taken over after summer recess.

Second:  See how the cut-off dates has been for EB2 India and Eb3 India, starting from Oct 2009 Visa Bulletin (X-Axis: Cut-off dates and Y-Axis: Visa Bulletin Date) :

Third: See how many visas has been issued on F1 and H1B categories and compare it against the 140,000 employment based green card available (X-Axis: Year and Y-Axis: Count of number of visas issued):

    1. Earliest, it will be current will be Sept 2014 -depends on how far it goes next visa bulletin, how many porting and how much spillover.

  5. It seems like H1b issued (jobs created) during 2005-06 are choking the system. Once they clear those years by handing them green cards, it will move priority dates predictably. It looks like it will take another year to clear that backlog for Eb2.

  6. This is Brilliant! - Sharing your knowledge helps so many folks. I have paid lawyers for consultation and I got a lot less than what I get here. So Kudos.

    My question: I have a EB2 priority date (from a previous company) of Feb 2008. When can I expect it to be current? Feel free to add in optimistic and pessimistic time frames. Thanks.

    1. No. All over the world. The main point is, we have 140,000 employment based Green Cards issued every year, but almost 500,000 F1 Visas are issued just last year.

    1. It might get current around Nov-Dec 2015 but that will only for generating inventory. You'll get GC around sept 2016.

  10. I have to say this is one of the leading site I checked in past few months related to greencard analysis, alongwith Murthy. You are doing a good community service!
    Finally after 6 years (Nov 2007 PD) I am able to file my I-485 in EB2 this week.
    Question - 1) Assuming I don't get RFE and dates stay current, how long it takes to get the greencard or it's unpredictable?
    2) In case, dates go back in next month or in couple of months, would that mean more wait or it doesn;t matter since it's filed?
    I only have fingerprinting left I think from my side

    1. Typically, it takes about 3 months for your to get your GC. Only catch is, your PD has to stay current that long.

    Question: I have a EB3 (India) priority date of Mar 2008. When can I expect it to be current?

  12. My priority date is sept 2011- eb3. Should I port to eb2 or wait for immigration reform?
    If I don't port And if immigration reform does not pass, when will 2011 be current for eb3?

  13. I am currently on my H1 visa which is in its 8th year on the basis of approved I-140 ( EB3-India ) . My EAD has not been filed since the priority date ( Feb-2008) is not current for EB3-India

    I have received a new job offer from a company who is willing to Tranfer my H1 and also process my GC in the EB2 category.

    Questions
    ************
    1. Can I change companies at this stage of my GC process..? Do I risk anything ?

    2. Will I be able to continue extending my H1 Visa in the future on the basis of the I-140 from my previous employer...?

    3. There are talks of Executive Action later this year towards Immigration Reform. Is it going to help EB3-India candidates who have been waiting for years for the priority dates to become current.... Something like 2007 where all visa classes were current
