September 2013 Visa Bulletin and Analysis


GOOD NEWS ALL OVER !!!

September 2013 Visa Bulletin was released earlier today. Date for EB2 India is 15 JUN 08 and EB2 China is 08 AUG 08. The cut-off for all other EB2 countries are Current.

I expected the dates to move to 01 APR 08. But, it moved to 15 JUN 08, which is a very good news. Looks like there are lot more Spillover visas available than expected. Even the visa bulletin mentions this -- they say the EB1 demand has reduced in the last 2 months and also, there is less demand for EB2 other countries.

Also, I think it will retrogress back to earlier date in October 2013 visa bulletin for EB2 India. This is the reasoning behind it -- theoretically all the EB3 applicants can port to EB2. As long as there 300 or more porting, DOS will have to retrogress the date and keep it like that till the spillover is determined. But, Visa Bulletin prediction says there it might remain the same for a few months and then, it might retrogress. There is no viable data to decide which way it will go. It is purely based on DOS team's logic. Let us hope for the best and let it remain as it is.

Cut-off dates for EB3 India is 22 SEP 03 from 22 JAN 03 and EB3 China is 01 JUL 10 from 01 JAN 09. 

I think the movement for EB3 India is again because of spillover. This year is a special case were there is unused FB visas from last year. For EB3 as a whole there is 45,188 instead of the usual 40,040 visas this year. As the most backlogged country in the EB3 category,  India will get all the spillovers till it reaches the next severely backlogged country's date.

India:  This cut-off date has been advanced significantly more than originally expected, based on the projection that there would be “otherwise unused” numbers under the overall Employment Second preference annual limit.  This is the result of a decrease in Employment First preference number use, and a similar decrease in Employment Second preference demand for most other countries during the past two months.  It is expected that such movement will generate a very significant amount of new India demand during the coming months. 
THIRD:
The Employment-based Third preference cut-off date for most countries was advanced at an extremely rapid pace in April through July in an effort to generate demand.  Historically such movements have resulted in a dramatic increase in applicant demand for numbers within a few months.  At this time there is no indication that the expected increase is materializing or will do so in the near future.  This has resulted in significant movements in the September cut-off for all countries. 
It is unlikely that there will be any forward movement of most Employment-based cut-off dates during the next couple of months.  In addition, a sudden surge in demand could require the retrogression of a cut-off date at any time.  Such action would be required if it appears that such number use could impact visa availability under the FY-2014 annual limits.

  2. Hi, thanks for your analysis. I just looked at the September visa bulletin and see that EB2 dates for India is June 15th, 2008. My PD date is June 18th, 2008. Does this mean that I missed the boat by just 3 days? Do you have any predictions for the next month? Will I get a chance next month? Thanks !

  5. I'm current Mar 14 2008, Does anyone recommend opening a SR/InfoPass/Senator Letter to get my application the chance to be picked up , or will it hurt the chances anymore than if I didn't do anything ?

    1. There is no real way to say one way or other. My suggestion will be wait for the first week of Sept and see how it goes. The, call USCIS and check if your case in pre-adjudicated and also, give a letter to Senator's staff.

  6. I filed my 485 in August 2007 for EB3, PD May 2007. I moved to EB2 I-140 approved and interfile filed in April 2013. How long does it generally take for a decision on 485? Any general ideas?

I called them and they had my call sent to second level CSR and she said the system shows that the case is pre-adjudicated and assigned to a immigration officer but she said she doesn't know anything more than that... I asked her how long and she didn't know.... I'm current now... I wonder if anyone knows how long it usually takes for the case to be approved after pre-adjudication...May 2007 is the PD

  7. My PD is Apr 15 2008. So i am now current. I have my EAD and have applied 485. IF the dates retrogress in the Oct 2013 bulletin. Will i get my GC in the next couple of months or no?

My PD is Nov 2006,It became Current in August 2013 Visabulletin,I have added as dependent through spouse on EB2 category.I moved from the current address long back which i gave at the time of I-485 filing,but i submitted the AR-11 form online for address change on 09-AUG-2013.and i informed to USCIS as well on 1-800 number.They said if submit through online it will take 30days to receive the Receipt.Does it give any impact when the USCIS issue the GC.Any one has an idea ..let me know..Any suggestion that i need to call USCIS and create an SR.

    1. As per the visa bulletin, they don't expect any movement now for EB2 India. It might also retrogress. We have to see how the porting goes and we will get a better idea.

    1. Depends on porting and number of visa available to EB2 India. If there is 20,000 visas available and if there are 5000 portings, it might move to JUN 09.

    2. I think it is better to consult an immigration lawyer.
      Some folks have done that. I am not sure how. Typically, you need your I-485 waiting for 6 months or more, I-140 approved and EAD card in hand to make a move and keep the priority date.

    3. Yes, you need to file new PERM labor and I-140 with new employer. your I-140 will port your old PD Feb-2011.

    5. You can move to new employer at any time (give 6 months time after approval of 140). But you need to start the PERM and 140 process again from beginning. While filing new 140, you can port the old priority date to new 140. Make sure you have the old 140 approval notice copy (you can use FOIA request to get the 140 copy,if your employer is not sharing).

    1. Based on current trend I would think sometime in 2016 your priority date should become current and as soon as that happens you will get your EAD. Unless DOS decides to forecast the demand in between like they did last year, then it's possible that you might get the EAD sooner. Since they already have demand data up until mid 2010, I don't think they will forecast again until 2015. So really best case would be 2015 and worst case could be > 2016. So much depends on porting too.

    3. Even if you approach, I think the answer from USCIS will be something like we are processing it and we will get back to you when it is complete. They have to ask you to come for finger printing, then they have to security check and then check all the documents...

    Thanks for all your blogs. I am spent a lot of time reading through these comments and your answers. My PD is Jan 08, 08 and am current. I was current in Dec 2011 and had got by EAD before the dates retrogressed back. The day when I get the GC in hand, I will be like a hindi movie mother who sees her son 20 years after he got lost in a village fair.

    Any idea how long it takes to get GC in hand (I think i am pre-adjudicated and recieved RFE jun 14th)?

    1. The approvals are happening in random order, even though they claim it is per USCIS receive date of I-485 for primary applicant. If you don't get any update as on Sept 9, call USCIS and check if your case is pre-adjudicated and confirm your address. Also, request your local congressman or senator's office to check your status.

  22. My priority date is April 14 2003, any predictions when it could become current. I am not sure why EB3 dates moved so fast. I was assuming all spillover first goes to EB2 and EB3 will not get any spillover unless EB2 is current. Any clarification about that would help.

    First of all thanks for the great work you are doing. Secondly, I do have question and I would appreciate if you or someone can share experience or knowledge.
    I am current in Sept Visa Bulletin and will be filing my I-485 first time. Do you know list of Vaccines we need to take during medical Exam?

    The reason I am asking is that my wife is pregnant and I want to make sure she can have those vaccines during pregnancy. Also, what if she cannot have certain kind of vaccines? Do Doctor write the note in report? Does that create RFE later?

    1. I understand that you can check with the Civil Surgeon and get waivers on certain vaccinations which may not be safe during pregnancy. It will be good to call the civil surgeon you are going to for medical exam and check with them.

    2. I was in the same situation as your wife. I was not comfortable taking any vaccines during pregnancy (even if they were considered safe or low risk).
      Three things I did:
      1. Got a letter from my family doctor in India, listing the vaccine schedule taken from birth to adolescence as per the cdc/usics requirements.
      (Search for "cdc immunization schedule" or "uscis vaccine" online). I presented this to the civil surgeon filling the I-693). This way I avoided taking any shots.
      2. The other thing is the TB test. This is done using a skin test, again I was not comfortable with the dye test (even though this is considered very low risk). There is a blood test you can do for the same purpose. So, I requested the civil surgeon to perform a blood test for the TB. This costed us a bit more and not covered by insurance.
      3.Do mention to the civil surgeon about the pregnancy so that they are able to give you the right advise regarding the tests and vaccines.

      1. Thank god we have medical certificate for all the vaccines mention at cdc/usics except Hepatitis A & B. But that certificate is in local lauguage. Do you see that could be a problem?

    1. Thanks for the response. Can you elaborate a little? I am skeptical and perhaps pessimistic because *even with* 18K spillover, EB2-I date could make only Jun 2008. I don't think it is impressive because 2 years ago, the PD was at April 2007...so net increase for 2 years is slightly over an year.

      I think everyone agrees that there won't be FB spillover next year and from my readings of forums, I don't see EB1 or EB2-ROW demand has reduced substantially for long term. I heard that sequestration has helped slowed PERM processing and the temporary dip in EB1 and EB2-ROW approvals helped push EB2-I date.

      Given so many things working against us, do you think a 7 month advance is possible next year? Can you put a percentage number (even from your gut feeling) on the likelihood of end of January 2009 being current? I need to plan some life changing events around the best informed opinions I can gather.

    2. As per today's available data, in the last 5 years, EB2 India has got minimum 10,000 GCs and maximum 24,000. Assuming 6000 porting and if 10,000 are available for EB2 India, then it will go to about 01 OCT 08 by Sept 2014. Assuming 3000 porting and if 25,000 are available, then it will go to about 01 DEC 09 by Sept 2014. I believe it will be somewhere in the middle, that is why I think Jan 2009 is possible.

    2. I think it will come back in July 2014. It will be perfect for you -- as labor is taking about 7 months to clear these days. Make sure, your lawyer files I-140 in premium along with interfiling as soon as the labor is cleared.

    1. There is no annual limit. But, as long as you have a 4 year bachelors degree and 5 years of experience -- you are eligible for EB2.

    1. The requirement for EB2 is Bachelors with 5 years of experience. So, everyone whose PD is August 2007 or earlier under EB3, are eligible to port to EB2. As per last inventory, there are 41,024 applications like this.
      What I mean in the above statement is -- all of these 41,024 applicants can theoretically come under EB2. Though it is not practical.

ITs not practical at all.. even if eb3 port there are two reasons that wont happen so fast. 1) not all companies allow porting, so u have change jobs. 2) You do need to file labor and current labor process is 6 months, so if 41k apply for eb2 they can come in only after 6 months. I dont think its gonna retrogress so fast.

    3. Absolutely true. But, you need to remember, lot of applicants has already started the process and it increasing every month. It is just a matter of time you will see them on I-485 data and demand data.

    1. Very hard to tell at this point. But with today's data, it should become current in August 2014.
      If you have already filed I-485 and all the documents are in order, you should get your GC in the same month you become current.

    I need your input on my case

    I am porting to EB2 and my PD is current. I just filed my i-140 and my employer has confirmed that I can't do parallel filing.

    So the question is

    1. Assuming that my 140 is approved and I am able successfully file my i-485 within this month and then next month the date retrogressed. How long does it take to get EAD approximately. Will USCIS consider my application for EAD?

    2. If I am not able to file i485 within this month and date retrogress, I believe I will have to wait till the date is current. is that true?

    3. Any chances that this PD remains same in next month

    1. 1. EAD has nothing to do with being current or not. As per current rate, you should get in 60 days after you file you appliation.

    My PD date became current with the Setember'13 Bulletin. I have a valid AP until July 2014.
    I have international travel plans in Oct'13. Would it be okay to travel on a valid AP, while the PD is current, but while the GC hasn't been issued yet?

    1. I guess, you should be ok to travel on AP while waiting for GC and when your date is current.

      Only when you apply for H1 extension until it is approved you should not travel as they extend your I94.

      Applicants should NOT travel outside the U.S. after filing for adjustment of status unless they have a receipt for the I-1-485 form and plan to travel and return as an H-1B status holder OR they have the advanced parole form I-512. Applicants who travel without the proper paperwork may be considered to have “abandoned” their PR application by travelling outside the U.S. with the wrong documents or at the wrong time. Please contact an immigration attorney if you have questions about travelling while the I-485 application is pending.

  44. Hi Ambal, my priority date is oct 2006 EB2 India, last time I was unfortunate to get the GC coz of interview and the dates moved back. My case status still shows "Testing and Interview" I have opened a SR last week but haven't seen any movement in my case. Any suggesting how should I pursue my case now ?

  45. Hello... USCIS received the first time 485 on 7th. Called today to USCIS and spoke with L2 officer and he said- my information has not been added to the system yet and the data entry will happen and then I will receive the receipt date. It takes approximately 30 days.. Anyone in same boat?

  47. Hey Ambals....This is not a green card question....I have a typical scenario pertainign to H1B and H4 visa.

    My wife traveling to India for couple of months and she is getting H4 visa stamping based on my current employer's petition.

    But I will most probably be changing employer while she is in India (not before my wife is getting visa stamped).

    My questions are -

    Can she enter US on H4 visa stamped through my old employer

    If she can, then does she has to provide new petition which will be given to me by new employer (and I will ship it to her in India) when she enters US

    I would prefer if she gives new petition because then she would have more validity to stay in US.....but would like to know if there is any risk here.

    My PD is May 2007 (EB3 to EB2 porting) and applied for I-485 for the first time on August 1 (TSC) of this month. I did early walk in and completed finger printing last week itself. Any chance of getting GC approved next month?

    1. Early walk in wont help for approval of GC...but if your original finger print date was in august month then u have more chance to get GC on Sep30. Suppose if ur FP scheduled date is sep 03 or after then no chance even though u did early walk in. don't be too smart

    3. As per today's available data, in the last 5 years, EB2 India has got minimum 10,000 GCs and maximum 24,000. Assuming 6000 porting and if 10,000 are available for EB2 India, then it will go to about 01 OCT 08 by Sept 2014. Assuming 3000 porting and if 25,000 are available, then it will go to about 01 DEC 09 by Sept 2014. I believe it will be somewhere in the middle, say 01 May 09. But, we have to wait and watch to access the trend better.

  55. Thanks, you are doing a great job. My PD is March 11, 2003 (EB3). I already have a I-485/EAD. I bought a home and am moving end of September. (1) Will I get my GC before then? (2) If they are doing random GCs is there a chance that even with an I-485 submitted I might have to wait until next month or later for the GC? (3) If I do not get my GC in September, do I simply do my AR-11 (online or phone is better?) and sit tight hoping that there is no retrogression in October?

    1. Early walk in, is totally at the discretion of the officer there in the local office.
      I think it is better to wait for your notice to come and go the date they ask you to come.

    1. There are about 21,000 in front of you -- from nov 2003 -- according to July inventory. If we assume 3000 GCs are given per year for EB3 India, we are talking 7 years. But the good news is -- lot of folks are porting to EB2. There are few spillovers available as well. So, it will be sooner.

    1. There is a very good chance, you will get it before end of next month.
      It is better to call USCIS and talk to L2 officer and see what is the status.
      It will also help, if you contact your congressman or Senator's office and ask them to inquire about your case.

  69. My PD is Jun 13,2008 EB2 direct,i become current in SEP, happy about that but still not sure if i get GC next month or will be leftover.If i miss the boat now,only time i can get current again is 8-10 months from now. I have couple of questions, Can you answer please.

    1) coming SEP 3rd, on what basis they pick the files, is it based on RFE,RD,PD or Direct EB2 cases etc ? I haven't received any RFE till now,but if they go by PD, i will be the last and there is a very definite chance that visas might get over early.what are the chances of picking up my file ?
    2) are all EB3 to EB2 porters till Jun 15,08 considered for SEP bulletin ? my question is most of the people may not requested for interfiling and they can request now as the date becomes current.
    3) assumption is total around 6000 porters, out of that how many people from Jan 1 - Jun 15 ,08 ? Just want to see how many newly added from AUG to SEPT bulletin ?

    1. 1. They say it is based on I-485 receive date. But the approvals suggest there is no specific order.

      3. You don't have to worry about new I-485 filings, because, it will take about 3 months for them to get the GC. All the other porters, who have already filed I-485, could have ported anytime. But, there is no data to say what the number is for July, Aug and Sept.

  70. I am going to file (first time) 485 on 03 SEP 2013, how long will it take to get finger print appointment?
    My son's passport is expiring in Feb 2014, and My passport expiring May 2014. Is there any minimum passport validity for finger print?
    I am thinking to apply for a passport next week, as per the procedure I have a chance get in 3 weeks. OR Do I need wait to complete my finger print then renew the passport?

    Please advise.

    1. First thing first... Finger prints, they did not even check my passport. And I don't think it will take so-long for getting your FP Notices. I don't think it matters. I recently got my new passport. i.e. it was expiring end of September but when I filed for my 485 etc., the lawyer said it doesn't matter that we will have to submit the new passport copies etc./ The passport is expiring in X Number of days. She asked me to get the whole passport scanned in color and send it kind of. But I got my passport renewed just before they filed my 485. So new passport copies were also attached. It's my experience kind of... Best answer is... Check with your lawyer.

  71. Does anyone know whether requirement of 6 months with your sponsored employer after recieving GC is mandatory or a suggestion? What/if issue can it cause say during citizenship filing? Any case anyone is aware of whose GC is compromised because they didn't stay with the employer long enough after GC? Assuming that the intent to stay with employer is there upon GC but circumstances change within 1 month or so.

    Does the medical exam for 485 be borne by the insurance. Looks like the doctor is charging $400 per head.

    1. Same here..paid 780 for 2 people..Only Blue cross blue shield insurance covers the GCmedical Insurance..But you an shop around the approved doctors and get little less deal. Also I read in some forums that you an get the shots from General City Medical administrator for literally free cost..thus you need not get exorbitant rate for the shots to the doctor..

    2. This is what you can do. Go to your regular family doctor and you ask, you missed these vaccinations and you want to take them. Then, your doctor can claim insurance and see. As a part of your yearly physical, most of the insurance covers vaccinations as well. There is no guarantee.
      Then, you can take those records to your civil doctor who is certified by USCIS.

    My priority date is Aug 2010.I-140 is approved. Now I have full time employment opportunity who is ready to transfer my H1B and do my GC. They mentioned that they I can retain the earlier priority date for me,, I am not sure . There is CIR rumor... If CIR happens when can I expect my date to be current... if CIR does not happen what is approximate time ,my priority date will be current. Do you suggest joining full time job at this time..I had my priority date as jan 2009, I changes employer before 140 approved. I already missed GC line once...Now I am scared to miss second time..Please suggest on this..

    My PD is april 2009 and I am on EAD(got lucky when the dates became current for one month in mar 2012 and applied at the time). Any idea when I can expect the all important plastic card ? At this rate, I am hoping for 2014. Am I correct ?
    Also, I have a 2 year combo EAD/AP card that is valid from april 2013 - apr 2015. I traveled to India in Aug 2013 on AP and on re-entry, my passport was stamped as a parolee with an i-94 date of aug 2014 although my combo card is valid for 2 years. What does it mean in terms of renewals ? Should I have to renew my AP alone before aug 2014 ?
