November 2013 Visa Bulletin and Analysis


November 2013 Visa Bulletin was released earlier today. 

EB2:
Date for EB2 India is 15 JUN 08 and EB2 China is 08 OCT 08. The cut-off for all other EB2 countries are Current.

EB2 China keeps moving forward.

As expected, the dates stay the same for EB2 India.I think it is a good news. 

Now, the question is what will happen in the next visa bulletin for EB2 India. I think there are 2 options. One, it will stay as it is. Two, it can retrogress back. I believe DOS has a cut off, little about the regular monthly approvals, say about 400 porting applications per month. If it crosses this number, they will move back the dates. Depending on the dates of the applicants who are porting - anywhere between 01 SEP 04 to 01 JAN 08. But, I feel it will stay the same.

EB3:

Cut-off dates for EB3 India is 22 SEP 03 and EB3 China is 01 OCT 10. 

I thought, the EB3 India date will at-least move this month. But, for some reason, DOS has kept it the same. Comparing the numbers for applicants with priority date prior to Jan 1, 2005 -- the new Demand Data and the I-485 pending inventory released in July -- have very similar number. That makes me believe, DOS and USCIS are still consolidating the number of porting from EB3 India to EB2 India. I am hoping once that is done, the dates for EB3 India will move foreward.

Demand Data:
The new demand data was released yesterday. It has some interesting information.

First, the total number of visas is 148,000 instead of regular 140,000 and the last year 158,000. It seems like FY 13 spill over from FB has already been applied to FY 14 Employment based demand and that number is 8,000. Even though, it has reduced from 18,000 last year to 8,000 current year, it is a good news that there is some.

Second, all the EB2 numbers has been consolidated to Jan 1, 2009 or prior. For EB2 India it is 9,000. 

Third, they indicate that whoever didn't get the Green Card for FY 13 and the date is current, will likely get it this month if everything is good.

    1. Typically, it is taking about 90 days from your I-485 notice date to get Green Card. This is under the assumption, your PD is still current and everything is good on your application.

    My priority date is dec 5th 2007 eb-2. filed 485, ap and ead on august 1st, finger printing done on august 28th, received ap and ead combo on sept 12th.

    EB2-I first time filer with priority date of Sept 2007. What are my chances of GC this year itself considering the current visa bulletin and demand data?

    My PD 8th Oct 2003 for EB3 India.

    I am still on H1B, thinking of porting to EB2. I thought dates will move at least one week every month but looks like it is stuck/Will it retrogress?
    As per Demand data only 2900 EB3 is pending prior to January 1, 2004. How much EB3 India will be released every month?

    Is this Calculation/assumption is correct

  12. Hi, my husband's company applied under EB2. Our dates were 2008 May. He got his green card yesterday but I have not received any nor have I seen any status updates. Since I am not a primary applicant am I considered as EB2 category or family based? Is my priority date also May 2008? Up till now both our EADs AP etc were processed at the same time. When can I expect to get the GC? Thanks!

    1. You should be EB2 if you applied as your husband's dependent. You should get soon assuming you both applied for I-485 at the same time. If you don't get any update by the end of next week, please do call USCIS and check what is happening. You can also contact your local congressman or senator and see if they can check your case.

    Is the above statement based on the following paragraph in the demand data?

    "The FY 2013 Employment annual limits were reached prior to the end of September, and no further allocation
    of numbers was possible after that time. Offices continued to process Employment cases, submitted them in
    the normal manner, and such cases were then held in the Visa Office’s “Pending Demand” file. All eligible
    cases were then allocated Employment-based numbers on October 1, 2013, under the FY 2014 annual limits. "

  14. If the FY13 spillover has been applied to FY14 then does that mean that we will not see any movement at the end of the year this time?
    My priority date is April 09 EB2 India and I was hoping to see the GC by end of FY14 - does this way of utilizing spillover make it highly unlikely unless they still to this format and use FY14 spillover for beginning of FY15?

      We got our EAD today (however approved on oct 8th according to the uscis webpage). Our fingerpriniting got done on Oct 9th and the 485 was was accepted by uscis on sep 6th (Submitted to them on sep 3rd).

      According to the nov bulletin my priority date is still current (mar 2008). Is there any chance for me to get the greencard before nov end? Thanks.

  19. What is the difference between invenory data and Demand data? And how do those numbers affect EB2 India? Inventory data was last released in July 2013 and DOS released the latest demand data earlier this week. Thanks.

    1. Yes. I am hoping they will release a new I-485 pending inventory data this month. That will help us.
      I-485 pending inventory data is the one released by USCIS and it gives the actual number of I-485 applications pending. Demand Data is released by DOS and it gives the list of I-485 for which visa number has been assigned.

  20. How about the unused visas from FY13 quota for EB4,EB5,EW,E1. This spillover should be applied to EB2 which effectively advances cut-off date for EB2 India until the cut-off date matches that of EB2 China. Which month of FY14, will this spillover be applied to EB2-India?

    1. It depends on DOS/USCIS. They can decide to apply every month or every quarter. Typically they will get a better understanding only in last 3 months and more importantly in the last month.

  21. The interesting thing is this, all the scenarios are good for someone and bad for someone. Here is what people with different PDs would be hoping:
    1. Jan 2004 - Dec 2006: Ideally they might want dates to retrogress to Dec 2006. This would give them a much better change of getting GC as they do not have to worry about 2007,2008 guys getting ahead of them and taking away their chance.
    2. Jan 2007 - Jun 2008: They are hoping dates stay as they are today. Most likely a retrogression might take them out of the picture and hence they might want dates to stay where they are.
    3. Jun 2008 - Oct 2008: They would be hoping that the dates move forward and they at least get a chance.
    4. Oct 2008 - Feb 2009: They know their dates wont be current soon. They are hoping it retrogresses to 2005/2006. This would translate to less porting and hence less people in from of them in the queue. Eventually it gives them a better shot during Aug/Sep 2014.
    5. Mar 2009 onwards: Just hoping that dates move forward. So they at least get a chance to hope. Frankly these people would be more concentrating on CIR then visa bulletin.

    2. Hey, It almost took an year for EB2 PERM to get approved @ June-2013 (btw there was an RFE on it), while 140 porting got approved in a month.

    Inventory Data and Demand Data will be in Sync with each other once its out or whether inventory data for pending I-485 includes dependents also?
    I see total 43000(EB2)+41000(EB3)=84000 applications pending with USCIS in the inventory data before April 2010 but on demand data it shows total of 60000 for both till 2013. So it means that many candidates(around 24000) are clared and dates will move a lot faster. if its true we can assume that these 60000 will be processed in next 3 years at current pace.

    Let's assume that the house passes some sort of immigration bills and then those go to conference and say a bill mostly the senate version gets approved in the conference in Dec 2013. When will the changes like Country cap removals come in to effect? In the same month or October 2014? Please let me know. Thanks in advance!

  37. Hi Ambals, thanks for your analysis. I need your prediction on EB3 to EB2 upgrade.

    My EB3 PD is Jan 2008. Recently applied for EB2 PERM in Jan-2013 (no employer change) and it's been almost 10months without any significant movement in application processing.

    - Is my EB2 PERM application different from any fresh (1st time applicant) PERM application?
    - Is there any good explanation for why it is taking so long to process the PERM application? And do you have any estimate on when it would be processed by for me to move on with I-140 & 485 (with EB2 date being current, I suppose I can apply both at the same time)? Last time I recall, it took less than 3 months for my EB3 PERM (2008).

    1. EB2 PERM is no different. It is taking so long because of sequestration and govt shutdowns that has reduced the Labor department staff and thus increasing backlog and time of processing.

    My husband has a priority date of 3/11/11 on an EB3 worldwide classification (there is cross-chargeability as he is using my country of birth to fit under the EB3 worldwide category).

    1. You can surely check with USCIS. From few responses above, it looks around 30 days from FP, the GC are getting cleared. So, by November end, you should get it.

    2. My question is actually this: suppose my PD became current this month, can I apply for I-480 using my old priority date from my new employer say after 6 months from now assuming the dates won't retrogress. My worry is it might take a good 2 years to finish up the I-140 from my new employer.

    Oct 19th is the first time I received a note saying that my EAD was approved…Then on Oct 21st I received the same note saying the card was approved…On 24th morning received a note saying that the card production is in progress…On 24th evening received a note saying that USPS got the notice and I was able to track the card that it was in Kentucky but did not note down the USPS number…Yesterday night I got a note which was the same as Oct 19th…Just a bit confused…

    1. You should get soon. You can call USCIS and check the status. You can also contact your local congressman or Senator and ask their office to check the status for you.

    2. Ambal, I called USCIS yesterday and was told that the typical processing for NSC is 4 months and I'm only 2 months into my application. Bottom line, I was told to wait.

      Should I frame my question to USCIS in particular way?

      My concern is the dates will retrogress in December and my application processing may stop as it enters into the 4th month period.

    1. As per July 2013, I-485 pending inventory, there are about 6000 applicants in front of you. At this rate, another 2 years. Hopefully there is will be some porting and you can get sooner.

    My PD is Oct 2010. I understand from your blog that the current trend is 6 years from PD date. Does that means till i get the GC or EAD or that it will get current in Oct 2016. Generally how much time does it take between the EAD and GC. Also are there any chances that the 6years trend will change.

    According to CO eb3 India will retrogress. Then again according to him the demand data is 2900 until 1/1/04. He is contracting his own statement cause if the dd is really 2900 the shouldn't the dates move forward in the near term. Sir, what is your take on this.

    My i140 was approved under eb3 and PD was Nov 2008. But I left my employer so he had revoked my i140. Now after 3 years I am joining my employer again. Now I am eligible for EB2. What steps need to be followed and how much time will take for me to get GC?

    1. You have to pretty much start from beginning from labor to ads to LC to I140 to I485. Labor is taking about 8 months now.

    I am worried if I would receive GC before dates retrogress in december visa bulletin. For us process has been slow, since USCIS intially messed with our EB2 i-140, they deleted EB2 i-140 instead of EB3 i-140 in the porting process.
    We see that people with our kind of dates have already received their GC.
    Here are my dates - Do you think I would receive GC before dates get retrogressed?

    PD : Dec 12th 2007
    Filed : Sept 1st 2013 - couldnt file in Aug, since it took time for USCIS to correct their porting mistake.
    FP: Oct 1st 2013
    EAD/AP: approval Oct 22 2013

    4. Check -- Senator John Cornyn's website -- http://www.cornyn.senate.gov/public/index.cfm?p=Forms
      There is an immigration privacy release form. Download fill it and fax it along with a letter requesting them to check your status. In the letter give your I-485 and your dependents I-485 numbers, A number, priority date and other relevant details.
