December 2013 Visa Bulletin and Analysis


December 2013 Visa Bulletin was released earlier today. 

EB2:

Date for EB2 India is 15 NOV 04 and EB2 China is 08 NOV 08. The cut-off for all other EB2 countries are Current.

The good news is EB2 China keeps moving forward. 

As confirmed by lot of law firm websites, earlier this month, the date for EB2 India has retrogressed back. 

Looks like DOS has a new strategy this time. They kept the dates the same for first couple of months this FY. Then, now they have moved it back.

At this point, I think it is going to stay the same till June 2014 Visa Bulletin and it might start moving big from July 2014. But, we will keep a watch and see what other strategies DOS has in place.

EB3:

Cut-off dates for EB3 India is 01 SEP 03 and EB3 PHILIPPINES is 08 JAN 07 and all other countries is 01 OCT 11. 

Good news here is all countries except India and Philippines are at 01 OCT 11.

I thought, the EB3 India date will at-least move this month. But, for some reason, DOS has moved the date back. From the inventory data, they have 1637 applications pending for 2003 alone. That explains why the date is 01 SEP 03 as for the whole FY they can give only 2962 GCs for EB3 India. 

There is no porting in-flow for EB3 India and they know the I-485 inventory. Given this, I am very surprised they moved the dates to 22 SEP 03 and now moved it back. It makes sense for EB2, but it does not makes sense to me for EB3.

There is no demand data yet. We will keep a watch on that.

    Thanks for the analysis. I saw December VISA bulletin retrogressed to 2004 for EB2 india. My PD was May 2008 and 485 and EAD was filed on 27th September.

    I was wondering how retrogress affects Green card ? Do I need to wait till dates get current again ? Will I get EAD or that waits too ?

    1. EAD/AP -- comes regular time, say within 60 days irrespective of the dates.
      GC -- If it does not come in November, you might have to wait till it becomes current again.

    Thanks a lot for the service. My I-485 receipt date is Sep 12th and had my FP on Oct 28th. Also received my EAD/AP on Oct 22nd. What chances of getting GC by end of Nov? If not what is the procedure? Will the I-485 get approved and wait for visa number to get GC or I-485 itself need the visa number?

    1. I-485 approval means GC. So, you have slight chance of getting by end of this month. If not, hopefully July 2014 for EB2 India.

  3. Good analysis Ambals..I guess they are giving some approximate number to the derivatives vias also..Thus they would have made the EB3 priority date calculation ,taking into account the approximate/probable Derivative visa also..

Need your advise please..I am in India and have applied for EB3 GC from India from US consultant and my PD is May 2004 ...when it would become current(prediction)?...whatz next steps and formalities after my PD becomes current? How long to get EAD?...have wife and twin's and if I apply I 485 adjustment how long it would take for them to get GC? Please advise..

    1. Sorry. I saw your message. But couldn't reply earlier. At this point there are about 7500 folks from 01 Sept 2003 to 31 may 2004, which equates to another 2.5 years. So, it totally depends on how many folks port to EB2.

      From, India I am not sure what the formalities are. If it is a regular I-485 route, if you have not yet applied, you can apply for I-485 once the PD becomes current, and then within 90 days you should get your approval.

  9. Ambal, thanks a lot for helping people on GC info. I have a ques. The 145 pending inventory got released and only 11K visas got reduced from the Oct 2013 EB-2 india inventory. Every year oct the pending inventory list used to get 15k reduced but this oct 2013 only 11k got reduced. And we also got the 18K unused visas from Family based got moved to Employment based what happened to those visas? Are they going to give it from Jan 2014. I am just curious to know about those 18K visas as EB-2 would get at least 10K more visas. your opinion would be appreciated.

    1. Yes. I have my own reservations on that data. If you see EB3 India, the number actually increased for 2004.

      If CIR passes in current form, you might get in 2 years.

    Just wanted to report back and thank you for your help. I frequented your blogs a lot to get info on the GC Situation. My priority date is Jan 08, 08.. I had been waiting for my GC for a while...became current in Sept and no news from USCIS till end of Sept. Then contacted Senator's office (on Sept 30,2013) for help and finally got GC on Oct 18th.
    My feeling is DOS kept the dates current for couple of months to grant GC for most people till June 08 and then retrogressed back.

    Anyways...thanks for all your help. I appreciate it. All the best to others.

    1. I am still trying to figure out why DOS moved back the dates. That aside, there are about 2100 applicants in front of you. So about July 2014. If there is more porting, it will be earlier.

I am following your blog from last six months... my PD is Oct 2011, India I know it's look hard to be current in near future.... but what if Immigration reform pass by this year and which means they have only 24 working days... what's your call... and if they don't use unused quota from past years for other country or XYZ... still that will going to help us to make all things faster... and reduce time... one more thing do you think EB 2 will be current any time sooner...

    My PD is Dec 2006, I-485 Notice date is 8/20 (Nebraska) and FP on 10/3. I got my EAD+AP approved on 10/21. But I am still waiting for the 485.

    On 11/8, my 485 status changed from "Acceptance" to "Initial Review" indicating that my name correction has been made (This correction is valid by the way). But, does this mean that only on that day my background check/actual processing has begun? Could I have been assigned a visa number already?

    Please throw some light on this. I'd really appreciate any feedback. Thanks much.

    1. Don't worry much about status change. If you have not already done, call USCIS and check what is happening. Also, contact your local congressman or Senator's office and ask them to check the status of your application.
      You still have chance to get GC before the end of this month.

    1. According to latest inventory data, there are about 2136 applications in front of you, depending on your exact date. If they give 246 visas every month, then you should become current about July 2014. It might be earlier if the DOS decides to open up and get more application when they come closer to August 2007 date.

    1. Yes. First, you should call USCIS and ask why you have not received your GC yet after 60 days. You should also ask about your wife's GC status.
      Second, you should contact the senator's office and ask them to check on behalf of you on both the issues.

      You can call the number and ask if they can enquire about your case status or you can fill the privacy release form and attach a letter with I-485 numbers and information and fax it to the number on the form.

    1. If you see the I-485 inventory, they have 32,000+ applications for EB2 India and they have numbers till April 2010. When the priority dates in visa bulletin, comes closer to April 2010, they will open it up again. So, Mid-2015 you might get EAD. It is all too early to tell at this point. We will see how it goes.
      Hopefully, an immigration bill will get GC for everyone next year.

    1. If you have not yet started LC PERM process for EB2 India, it is probably best to wait. My guess is you should become current July 2014. On the other hand, the PERM process itself will take more than an year.

    Kudos on the good work. I'm in a strange situation and could not find much online so would appreciate any advice - my PD is May 2006 and filed my 485 in 2007(Nebraska). It got approved and I got my GC at the end of October 2013.
    My wife's 485 was filed with Texas SC in August 2013 and she got her FP done and received her EAD/AP in October. However, there has been no change to her 485 status since August and it still says Acceptance. Contacting USCIS did not provide much visibility and now the dates will retrogress.

    Any ideas on what to do? Is anyone else in a similar situation?

  39. Hi, My H1-B is valid till 2015, Is it good to stay on H1 status even after receiving EAD? Or Can primary be on H1 status while dependent(Currently on H4 status) is working on EAD...is it true that if dependent starts working on EAD, primary has to move to EAD status?

  41. Is it required that we contact the local senators office for checking our application status only when our date is current. Like, my priority date is Aug 08 and I filed 485 in 2012 and now the dates are retrogressed. Can I still contact the senators office to check on my case status with USCIS

    1. You can contact anytime. If your date is not current, they will send a reply saying your date is not current. If your date is current, they will look at your file and tell why it is stuck and not processed. So, it is makes more sense to do it when it is current.

    1. I don't think there will be significant movement.
      If you see the I-485 pending inventory, there are 34,336 I-485 applicants waiting in EB3 India category who has priority date before 01 Sept 2007. You need lot of porting for that number to clear out or move forward.
      Even if you assume 5000 porting per year + 3000 regular EB3 India GCs, we are talking 4+ years to clear that. Then, we need to see the inventory for another 10 months before your PD.

      There is an immigration privacy release form, fill that, sign it, attach a letter with your I-485 number and other details and your dependents details. Fax it to the number on that form.

  47. hello Ambals, i have been a silent spectator to your blog. you are doing a highly commendable job. i have a question..do you think that there are any chances of the EB2 priority date to be current in another 2 years? The reason am asking is my PD is May 2011. I am planning to shift my job which would lead to porting labor, I140, etc that would take another 1 or 2 years. Per the current trend, it would take 6 years from my PD. But before that is there any vague possibility that eb2 can be current in next 2 years? can you please throw your suggestion accordingly i can think of planning to shift my job or not.     1. If you see the latest inventory, there are about 32,000 applicants before 01 May 2010 priority date for EB2 India. When they come closer to clearing this, they will open up again for more inventory. Plus there is porting from EB3 to EB2. So, you are right, it will take more than 2 years to open up.
      Consult a good immigration lawyer before you move job if you have not filed I-485 yet.

    Pd is jan 2009 on eb2i. I have my ead/ap valid until 4/2015.

    Question: my i94 granted as a parolee expires 12/2013.. should I do anything to extend it or ap/ead validity into 2015 should suffice?

    applied for 485 on sep 3rd 2013
    got ead and ap on oct 11th
    fingerprinting done on oct 9th 2013

    Today I checked the status of my 485 online and this is what I see:

    we transferred your I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, to your local USCIS Office for further processing. The new office has jurisdiction over your case and will send you a decision as soon as processing is complete or you will be notified if further information or action is needed.

    What does this mean? Do I have a chance of getting 485 approved by this month end? Thanks.

    1. I have an earlier PD/RD/FP date than you, but my EAD got approved ~10 days later than you and I also have my I485 in acceptance status. I have already contacted congressmen and it doesn't seem to have any effect. They are telling me things that are obvious/we already know.
      Someone says he got his GC in 60 days and it's been >75 days for me since I applied. So, it all varies from person to person.

      Just hope that something turns out before the end of this month.

  56. Got an RFE for my wife's application... stating "USCIS records show that you have a pending Form I-485; however we are unable to locate the underlying immigrant petition associated with your application for adjustment of status.

    Submit evidence such as copy of an I-797C receipt notice, that you have properly filed an underlying petition.

    Please lt me know what are all the documents I need to submit to USCIS...Is this common?

  59. For a EB3I PD 22nd Mar 2005, does it make sense to port to EB2 now? I know it takes anywhere from 12-18 months for the new labor/I-140 etc.

  61. I have crossed labor and I-140 in eb2. Only 1.5 years left to complete my 6 years cap. Is it ok to take a new job and restart my gc process? My PD is Aug-2012. Is there a chance of my PD can be current in next two to three years? Very confused. :(

    Thanks for you reply on my earler post saying my PD of June 2008 may still get it by end of month. Last night I recieved status update of card production for all our 485's. Here are my details

    My concern is if say card prod. status continues until dec 1 would I be denied issuance/dispatch of physical cards.

    2. Assuming you have filed your I-485 and done with finger printing, there is still possibility of getting GC by the end of November.
      You can call USCIS and check your status.
      You can also contact your local congressman or Senator and ask them to check your application status.

    1. how long should i wait before i change my employer,
    2.how long should i wait before i move into a different role?
    My PD: Nov '06 EB2 India( i had some personal reasons due to which i held off applying before).

    1. If your I-140 is approved and if your I-485 has been pending for more 6 months and if you have your EAD, you can use AC 21 and switch to same or similar job.

    My PD is dec 2011 and my I140 is approved,
    But the hidden issue is my 140 is approved based on masters, and my university is not accredited, will USCIS rovokes my 140 or I485 application if they came to know that. My university is not accredited during my i485 process, kindly please let me know if this situation can be defended.and my college was never accredited, but I did fulltime masters in CS.

      11/27/2013: India EB-2 Number Became Unavailable Effective 11/20/2013 for November Visa Bulletin Pending Cases

      AILA reports that no additional EB-2 numbers was allocated for EB-2 India for I-485 adjudications in November 2013. This confirms reports in immigration tracking discussion board. Reportedly, Indian EB-2 demand was so unprecedented that State Department received Indian EB-2 visa number requests about 150 per day between November 10 through November 20, causing its action to stop releasing any numbers effective 11/20/2013. Reportedly, State Department allocated 15,000 EB-2 visas for Indians in August and September alone using preadjudicated EB-485 cases. A lot of these cases are reportedly Indian EB-3 cases which had been upgraded to EB-2.
      At this point, no firm predication can be made, but reportedly there is some possibility that Indian EB-2 may return to August 2008 cut-off date in August or September 2014, meanwhile the worldwide EB-3 can move backward before the end of FY 2014 if demand increases next year.
