FY 2013 Employment Based Green Card Numbers



Department Of State has released the FY 2013 --  Oct 2012 to Sept 2013 Green Card numbers.

161,269 Green cards had been given under the Employment Based category last year.

India numbers are here:
EB1 -- 9,640
EB2 -- 17,193
EB3 -- 7,816
EB4 -- 562
EB5 -- 87
Total EB -- 35,298

  2. With EB1 Usage from 5k to 9-10K, and on going EB3 Porting, it is going to be impossible for EB2 India now before 7-8 years of your priority date.

  4. Even if we take 2013 numbers the spillover for this year would be @9000 and considering the current inventory data ..the dates may not move beyond Sept 2008

  5. I am confused with the numbers here.. every year we have only 2,963 for each category with the total of 10300 for each country ..But above number says 35298 visas issues last year.. How this is possible...

    4. Last year is a special case, EB got spillover from Family Based immigration left over from previous year. That gave more to EB3 and more from EB3 ROW spillover to EB3 India.

    1. When the date comes closer to May 2010, they have to open it up for inventory. It might be sometime in late 2015. We will have to wait and see how it ends in sept 2014.

  10. I see South Korea EB2 category got 7152 green cards in FY 2013. Any insight on how the math worked here? How did this category get such high numbers in FY2013 and no retrogression?

    1. It looks like in this case EB1 spillover from South Korea was used for them. Not sure if that's legal.

  14. Anybody who has 2009 or later PD, try to forget about your GC for next two years...if you get lucky it could be Sep 2015, if your luck is even better it could be Sep 2014. But try not to worry about it too much.

    By the way mine is March 2009.

    1. EB2 India, current trend is about 6 years. It might increase due to porting.
      When the date comes closer to May 2010, they have to open it up to get I-485 inventory data, so that is a good chance for people to become current.

    1. 01 JAN 09 -- assuming 4500 porting and 18,000 available for EB2 India, based on about 13,500 applicants waiting on latest inventory data available.
      It can be more or less depending on spill over and porting.

  19. Hi Ambals, With my first filing PD is Nov 2007. With my second filing hoping PERM to be approved by June 2014. (was filed in Nov 2013). Hopefully old PD is recaptured. if in any case PERM takes longer and my PD becomes current in July 2014 how long do you think it will stay current ? in other words any possibilities of retrogression ?

    1. Not sure at this point. I am hoping they move the dates in June 2014 visa bulletin and they try not to retrogress.

    I filed my GC on previous company, completed I-140 and then moved to other company and completed I140 again. My PD is 16 Jan 2009. Current job is kind of shaking, hope i can complete this year. I feel that my PD will become current this year based on recent report. What do you think?

  23. Does anyone have any idea on when the USCIS will move the processing times for I-485 employer based applications.?

    I filed for I-485 on Sept 1 2013. My date is still current. But when I tried to file for a service request, they denied it saying its within the normal time.

    Few months back, I saw the normal processing time is 4 months and we can file a service request if it crosses 4 months. Did something change ?

    I have a question with respect to my H1B visa.



    My PERM & I-140 were approved from employer A and EB2 priority date is july-2012. I joined employer B in Jan 2013 and the GC hasn't been initiated (H1-B expiry Jan 2016)

    Now I want to change jobs and wish to join employer C.

    My concerns are:

    1. Can Employer C easily transfer my H1B wthout any issue

    2. I know Employer A hasn't revoked my 140 so how many years extension do I get 2 years or 3 years.

    3. Once Employer C files my GC will I have any issues .

    I am on EAD with priority date around 30 January 2010.
    My wife is doing J 1 Waiver job and is finishing her waiver in September-October this year. She is on H1. Naturally I could not add her on to my application when my 485 was done as she was either on J1 physician job and then later on waiver job. What are options for her: She has to file extension of H1 to continue the job, if she wants to: question arise, if she does not want to work or work part time? and how should I add her to my EAD application or is it possible? If she decides to leave and wants to be on dependent visa, what Visa we should be applying and what are the problems we can expect. Thanks

    1. Yes, Ambal is not an astrologer. These bloggers do lot of research and spend time on immigration issues and provide valuable analysis. There is no harm in asking their opinion. Atleast it give people like us (kids) a hope and hope will keep us moving ahead. You like grown up folks, what the heck you are doing on this blog when you can not respect other's and their feelings.     Thanks a lot for your effort. I am in very tight situation for my son. Need some input if you can provide. My PD is Mar 2011. My son is now going to college on H4 (in Fall 2014). I understand that I need to file my I485 before he turns 21. Green card is not the priority in my case. If I fail to file 485 before he turns 21, he is not in my dependent list any more. For PD March 2011, EB2 Inida, are there any chances to file 485 in next 2-3 years? Thanks for your analysis in advance.

    1. Based on current trends, there is a very good chance that 2011 filers will have a chance to file 485 in 2016 and for sure by 2017.

  31. Hi,
    My pd is nov'06 (eb2). I applied for 485 in nov 14 ( perm and 140 were approved in 06 early 07 time frame itself).
    I delayed it personal reasons for the past couple of years.
    I do have a h1b valid till '15.

    Now,
    1. do i still need to wait for 6 months from the time I applied to move companies
    2. can I move companies based on my h1b before the 6 month period - my company might be going thru a lyoff - ia m not yet affected by it but wud like to know my options. what happens to the gc then.
    3. do i need to wait ead +6 months after I receive to move companies?
