August 2014 Visa Bulletin and Analysis


August 2014 Visa Bulletin was released earlier today. 

EB2:

Date for EB2 India moved from 01 SEP 08 to 22 JAN 09 and EB2 China from 22 JUL 09 to 08 OCT 09. The cut-off for all other EB2 countries are Current.

Good News !!! EB2 India and EB2 China keeps moving forward.

If you are becoming current in August and if you are going to file I-485, please make sure to contact your immigration lawyer now and get the relevant documents.

If you are waiting to file I-485, please use this opportunity to gather all the documents and keep it in place:

EB3:

Cut-off dates for EB3 India from 01 NOV 03 to 08 NOV 03 and EB3 Philippines from 01 JAN 09 to 01 JUN 10 and EB3 China from 01 OCT 06 to 01 NOV 08 and all other countries it stays at 01 APR 11.

Good news here is EB3 India date has moved 1 week, EB3 Philippines date has moved more than a year and EB3 China has also move more than an year..

I-485 Pending inventory:

Current I-485 inventory shows data till 1 APR 2014. For EB2 India, there are 31,187 pending applications, whose priority is before 01 MAY 2010. For EB3 India, it is 30,992 applicants before 01 SEPT 2007 Priority date. 

The new inventory should come sometime this month. We will keep you posted on that.

What to Expect Next Few Months:

For EB3 India - I am hoping it will move 2 weeks every Visa Bulletin, at the very least one week.

For EB2 India,

My calculation says, it will move to 01 MAR 09 in Sept 2014 Visa Bulletin. There are few law firms that say, it might move as much as 01 SEP 09. We have to wait and watch. Of-course, more the merrier.

Then, the next question is what might happen after that.

Last year the dates for EB2 India was like this:
Jul 2013 -- 01SEP04
Aug 2013 -- 01JAN08
Sep 2013 -- 15JUN08
Oct 2013 -- 15JUN08
Nov 2013 -- 15JUN08
Dec 2013 -- 15NOV04

I expect pretty much the same. The dates will move till Sept VB. Then, stay put for one month or two months. Then, retrogress back. I think it will retrogress again to say, 15 DEC 04 in November 2014 Visa Bulletin. It totally depends on what strategy DOS wants to follow this time.

  2. Hi. Our PD is sep 3 2008. We sent response to RFE including physical by CS and documents last month and was received by USCIS on June 16. Our finger printing was done in March 2012. Would we need to be finger printed again. And if so what are the chances that we will get a greencard this time. Last time it took them 2 mo to make appointment for finger prints and likely internal retrogression would set in by then. Thanks for your help!

So i will be a first time filer for both EAD and I-485 this time. What the our chances of gettin GC this year with the assumption that dates will stay current till Nov bulletin?

    3. Assuming dates stay the same till November, assuming you are not getting any RFE, the chances are still pretty high. With these assumptions, typically GC stood come in 90 days from the date of filing.

    4. Thanks Ambals. One another questions. My attorney is recommending that we file the I-485 without the medicals right now and can provide the medicals when we get RFE (this is with assumption that dates will retrogress anyway and it is best to provide medicals just once). if we do that: can it potentially lead to rejection? And assuming dates retrogress to next year, without medicals will they give EAD this year?

  4. Can you please help me understand why would the dates retrogress back to 15DEC04? Also what is the rationale behind this specific date (i.e. why not DEC05 or DEC07)

    1. That is match the demand of porting cases from EB3 to EB2. with out the unused visas from other categories, EB2 quota for India every year would just be enough for porting cases from EB3 to EB2 before DEC05 or what ever the date is set to.

    3. The dates can retrogress to anything, depending on DOS strategy.
      They can give only about 230 GCs under EB2 India till they know for sure the spillovers (Assume, October to June). Typically, they watch the porting during October and decide which way to go and how much.

    4. I read somewhere (possibly on one of your blog posts) that spillover to EB2 retrogressed category goes to India first and then to China. If true then how would China move to October 2009 when India is still at January 2009? Should't USCIS make them equal first and then move them together?

    My PD is late 2006(EB2). 140 was also approved in '07. I filed for 485 in nov'13 without completing medical and later got an RFE for medical which was sent back end of may. From then on i only see the status of rfe response under review.

  14. Hi Ambals! My priority date is Jan 2008 and I filed my I-485 on July 1. Do you think I can get my GC this year? Also, if someone having a priority date later than Jan 2008 (e.g. March 2008) filed I-485 last year, which application would USCIS look first (my application or March 2008 application) assuming the person who filed last year already has got an EAD.     I am in the process of switching jobs...not currently employed. I would be signing a contract in the next few days and darting by mid or late August.
    I have received RFE for medical and EVL which states to provide the date when I started the current job. What should I do?
    My EB2 GC was filed in March/2009 and based on all the predictions I think the date will be current next month.

    PD 11-Sept-2008- EB2; Current in August 2014
    Original I-485 filed date: Feb 2012
    BC RFE recd but PD retrogressed before response to RFE was accepted
    Medical RFE recd in May and responded to USCIS with updated medicals on 16 June.

    Will any GC approvals for all those 2008 PD cases in July 2014 bulletin impact my GC approval?

    Chances of GC this time? And when?

    My EB2 PD is May 2008. I am a first time filer and I filed I-485 during first week of July, 2014. I am trying to figure out my chances to get GC this year. It is very likely that the dates will retrogress starting next fiscal year but could you tell me when are you predicting that will happen? Will it happen right away in Oct 2014 or in later months?

    Also I read above that you are predicting "typically GC should come in 90 days from the date of filing.". But the USCIS is predicting typical processing time as 4 months here: https://egov.uscis.gov/cris/processTimesDisplay.do. Do people get their GC in 90 days if they don't receive RFE? Is USCIS data is outdated?

    I have a question regarding Birth Certificate. How Crucial is the Date of Registration on birth certificate. I have been told that the Date of Registration should be close to 1 month from birth, if not it will not be valid. My Date of Registration is very recent. Will that be a problem & trigger a RFE ? Please let me know what you think.

    1. Get an affidavit from your father and mother in support of the birth certificate and send it along with the other docs to the USCIS. You should be fine then.

      Please do check with your immigration lawyer for sample. He has to be comfortable on what he files for you.

      - Your parents current address
      - Parents DOB and birth place.
      - Their spouse name.
      - They need to declare how they are related to you (sounds absurd though)
      - All your information from your Birth certificate.

      Plus any other your lawyer may recommend.

    7. I had the same issue and did the same and got affidavits from parents in India on Rs 100 stamp papers. Your lawyer would need the originals so make sure you ask your parents to get this done and send you ASAP (assuming you are filing for AOS within the next few days). Good Luck

    Our priority date (me and my wife) is 02/02/2009 and according to immigrationroad.com/green-card-tracker, there are 17,584 applications pending ahead of us. We have already responded to my EVL + our medicals RFEs and USCIS has received them as of 07/01/2014. Our cases have the current status of "RFE response review." Based on your experience, what chances do you think we have to get our GCs this year?

    My priority date is May 2008. I filed for my new perm in September 2013 under EB2 category. Bad luck, I got an RFE on it , this May. When do you think my perm will be approved in this situation? Will my perm be approved by October/ November? And in case my perm gets approved, do you think I will be able to get my EAD this year? Also, I haven't done my medicals yet, not sure if I should get it done now.

    I have a priority date of Sep 08 and am thus current as of the Aug visa bulletin. I have also received an RFE for updated medical as of early June this year (to which I have responded). In your estimate, assuming no other glitches such as additional follow ups such as other RFE's, would I be able to get the EB2 GC approved this cycle ? If so, when would you estimate this to be ?   39. Hi. I was getting ready to file for AOS last year when pd June 2008 became current. The attorney did not file in time and pd retrogressed back until they became current. I did my medicals and photos October 30th 2013. Would it make sense to use the same medicals and photos for refilling? Looks like I may get an RFE regardless if my case is not adjudicated in 2014

  42. Are there any cases where GC is issued 2-3 weeks in advance of the Visa Bulletin being in effect for a PD being current?

    For example, if my PD is current in Aug visa bulletin and I have responded to the RFE now, is there a possibility that VO can assign a visa and issue it now while he or she touches the file for RFE review or would they prefer to complete the review and wait until Aug 1st? Long time can't wait :-)

    My PD is 26rd Jan 2009. As you know, Aug bulletin stopped just few days short of this. I have my Advance Parole and have travel to india scheduled for end of august.

    Will the USCIS pick up for green card processing automatically as soon as the I-140 is approved? Do we need to perform any special process for linking to the old Priority date?

    My PD is 22 Jan 09. I was exhilarated when I opened August bulletin as I thought my date was current. But my joy lasted for 10 mins until I found out that the cut-off date is any date earlier than 22 Jan 09, So basically only till 21 Jan. I have been reading news alerts from some law firms that suggest there will not be any progression in the cut-ff dates for this fiscal year. It really hurts to imagine I missed the cut-off by just one freaking day. Can anyone prove these law firms are wrong. I'm not sure on what basis they give out these news alerts. Do they have special access to state department that we don't have. Adithi & Ganesh any thoughts?

      I can feel your pain. My PD is 13 NOV 2003, EB3. I also opend the August bulletin hoping that like always it would have moved by 2 weeks. But this time it only moved by a week. I was quite frustrated and disappointed until I saw your post. I can't imagine what it feels like to miss it by a day... and then wait for a whole agonizing month hoping that it will get current next month. Good Luck!!

    My I-485 is pending and my PD is June 2008. As per USCIS, they have mailed an RFE to me on June 4th but I have not received yet. I also have requested them to resend it last week. I checked that my address is correct in their system from the beginning. Not sure why the mail did not reach me nor my attorney. Anyways, my question is do I still have a chance to get my GC this yr? I am hearing from many people that the RFEs are mostly for medicals because the ones that were submitted 2 yrs ago have expired. What would be the cut off for me to receive the RFE and respond to it so I will not miss the visa number this yr. I understand that the deadline on the RFE letter does not correlate to the visa availability timeframe. Appreciate your response.

    I have a job offer and No EAD, have to use i-140 to transfer employer. my Priority date is July 3 rd 2009 EB2 I and do you think I should wait for next Visa bulletin before i submit my resignation? Some of my friends are saying it may get current in the next visa bulletin or October 2014 The employer is ready to wait for me to join until Sept 15th and I'm worried if i delay my labor processing with the new company may get delayed making me to wait until 2016 for EAD\GC,.Please help its kind of urgent. I'm stuck and very confused whether to move or not. Appreciate your quick response.

    1. Here is my 2 cents: I to moved to the client company as they offered me a promotion but that's where things went bad to worst... My old PD is 2009 as well but the new Labor that my current employer applied went into audit (And the audits have drastically increased)... Things have changed from 2009; now keep in mind that it takes 7 - 8 months for labor to get approved and if it goes into audit add another 8 - 9 months. If the offer is really toooooooo good then take it... If not, my friend it's better to get your GC when you can and sure a new offer will come by. It's really frustrating when your PD is current and Labor is still not approved (I am living it and it really frustrating).

    1. Similar situation with me. PD July 2008, filed in Jan 2012. RFE for medicals and EVL submitted to USCIS 9th July. Just checked online status as "Card sent for production". So yes I believe you should expect to receive yours in 2 months

  67. Ambals, My PD is Nov 2007, will file AOS/EAD/AP by July end. My lawyer says current trend is EAD approval in 3.5 months and GC in 4-6 months. do you think they are correct on this ? sounds exaggerated to me.

    ​07/15/2014: India EB-2 Visa Bulletin Cut-Off Date Could Move Back as Early as November 2014?
    In the August 2014 Visa Bulletin, the State Department released their prediction for visa number movement for India EB-2 with a warning that it could move backward significantly in the next several months. According to the AILA, it could come as early as November 2014. Usually, visa numbers do not ​​retrogress in the first month (October) of a fiscal year, but tends to move backward later part of the first Quarter or first part of second Quarter. It is hoped that the number keeps moving forward for India EB-2 in September and Octobeer so that EB-2 Indian professionals get further relief before it faces another nightmare for a significant period of time. Result of November national election can bring some changes in the political environment, but the Aashington gridlock is likely to continue through at least 2016 Presidential election and broken immigration system may have to endure the pains for a long time. ​​

    My PD is July 2008. Ported from eb3 to eb2. 140 is still pending . can we apply for 485 now since current is Sep 2008 ? Can we apply for 485 while 140 is pending ? What if by the time we get 140 the PD is no longer Sep 2008 but moves to Jan 2009 ? Pls help me understand this. Thank you so much in advance

    1. Until your I140 is approved under EB2, you cannot apply for 485 under EB2. If by the time your I140 is approved your PD is no longer current, you have to wait until it becomes current.

    Now, that I haven't received my green, am i okay to accept new offer?

    Pls clarify if its doable and what effects do I have because of this?

  78. you have two options.
    1) you can upgrade for 140 premium process(which i did), For me it took only 3 days for approval.
    2)Still you are eligible to apply 485, since you are already porting.
    Best thing is first one. That's what my lawyer suggested.

    Thank you very much for answering questions to a lot of people. My wife and I finished my fingerprinting on 7/23/2014 and I come under EB2 India category. My question to you or other knowledgeable members is on my I-797C, Notice of Action for I485 Case type and under Preference Classification for me says 'Employment Based 2nd'. My wife also works and her priority date is in March 2008, EB3 India category. 2 years ago, she changed employers and her current employer is applying in EB2 category, her company's attorney suggested that she be independent with all the backlogs etc so that she can continue working until I get mine. She is riding on my application. But her I-797C, Notice of Action and under Preference Classification says 'Employment Based 3rd'. I talked to my attorney and they have opened a 'service request' with the USCIS. Is this okay for my wife's receipt to say EB3 or should it be mentioning EB2 because she is riding on my application? (On the side note, her employer is applying for her labor in EB2 retaining the previous priority date).

  86. Jan 2009 PD and i will be current in august 1 still no sign of any rfe. Not sure what is happening. Called uscis. They said they will send rfe if needed and i dont have to worry abt it.       Sorry i did not notice your first i-140 was EB3. First of all, Successor of interest can't be applied under EB2 for the perm approved in EB3.
      SOI means same job/position/location and just the company change.

    One very urgent question, I insisted to my lawyer to file the very first date of Aug 1st as my dates are current now. But now I am thinking that i should send mail on August 1 to be received on Aug 4, just to be safe. So that there is no doubt of sending in July when dates for me are getting current in Aug1.

    1) Are the dependent applications counted in the I-485 applications? or each application can have multiple applicants which means will take more visa numbers per app?

  97. Looks like my Permanent residency has been approved and granted.
    This morning case status on the USCIS read as follows:
    'Card/ Document Production' and that the card will be mailed out within 30days.

    After about 10mins though when I refreshed the browser the status went back 'Decision'.

    On August 1, 2014, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.

    During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

    Is the permanent residency really approved or is there going to be another step before I get GC in hand??

I have not received any rfe but I have not seen any movement on uscis website.. my lawyer said they have inquired about my case and are waiting for response.
