May 2015 Visa Bulletin and Analysis

May 2015 Visa Bulletin was released earlier today.

EB2:

Date for EB2 India moved from 01 SEP 07 to 15 APR 08. EB2 China moved from 01 APR 11 to 01 JUN 12. The cut-off for all other EB2 countries are Current.

Good News is that EB2 India have started moving earlier than expected and it is moving fast. Another, good news is EB2 China is moving forward.

If you are waiting to file I-485, please use this opportunity to gather all the documents and keep it in place:

EB3:

Cut-off dates for EB3 India moved from 08 JAN 04 to 15 JAN 04. EB3 China moved from 01 JAN 11 to 01 MAY 11. EB3 Philippines is 01 JUL 07 from 01 OCT 14For all other countries the date moved from 01 OCT 14 to 01 JAN 15.

Good news is the dates for most of countries have moved. There is a retrogression in EB3 Philippines number.

I-485 Pending inventory:

I-485 pending inventory data was released last month.

Current I-485 inventory shows, For EB2 India, there are 21,082 pending applications, whose priority is before 01 MAY 2010. This number was 20,263 in the previous edition. For EB3 India, it is 27,472  applicants before 01 SEPT 2007 Priority date. It was 29,422 in previous edition.

What to Expect Next Few Months:

For EB3 India:
I am hoping it will move 2 weeks every Visa Bulletin, at the very least one week.

For EB2 India:
I expected the dates to stay the same till June. But, DOS is using a different strategy this time. They have moved a little in Feb Bulletin and they moved more than an year in Mar Bulletin and another 8 months in April Bulletin and another 7 months in May Bulletin. I am hoping they keep the forward movement trend.

    2. Trying to understand your situation, So when last year the date moved to Oct+ 2009, you applied for i-485 (EAD), and because you got RFE you did not get the EAD card, am i right? Or you did not get the GC?

If you get RFE on your i-485 application you still get EAD card or not? Most probably NO, i am just clarifying.

    2. Its annoying when you see 90% of the post here asking the same question "when my PD will become current". If we avoid those posts then nothing will be there to read. I agree with Neel here that no one knows so just keep watching and be prepared when it comes close to your PD. I dont think anyone here is to make fun to others and definately not here to insult. I personally think predictions does not do any good and in most cases it is being proved wrong. No matter how much you say that this is only prediction but lot of people (including me) will take that as "carved date" and when it does not come true then it shatters our hearts. Anyways my point is that I like to see some valuable information from these posts. May be updates on immigration bill, overall GC process, perms updates. There are so many things we can talk about and educate people from this post which will increase the value of this site.

    4. people come here to find meaningful information not same stupid question again and again. its better we educate people. one can go through here to find how to predict your with some assumption. www.uscis.gov/green-card/green-card-through-job/questions-answers-pending-employment-based-form-i-485-inventory
only missing information is we don't know how many new I485 applications are getting filed for dates earlier than current PD.
for example last year EB2 India got ~23000 visa but pending I485 inventory didn't decrease by that number, in fact it decreased by ~12000 and EB2 india still has ~20000 pending cases. pending EB3 India decreased by 5000. I am guessing half of that have gone to EB3--> EB2 porting. that leaves ~9500 new I485 filing for EB2 india with PD between aug2007 to april2009.

according to comments from Charles Oppenheimer EB2 India will move 6-8 months in next bulletin. and after that slowdown 3-6 months movement. looking at pending inventory it makes sense as EB2 india has more than 1000 pending cases per month from may2009.
also we have not seen current PD earlier than may2009 since 2012. I assume we will see more new filing in EB2 india with PD after may2009 (these are the people who missed in 2012).
it also depends on how many visa numbers we get this year as explained by Ambal earlier.
another thing to note is that EB2 india may not have large pending inventory after 2015 and EB2 india may move forward in early 2016 to create pending inventory by end of 2016.
as you can see there are more unknown variables than equations. all depends on assumption and what USCIS has in mind.
I hope it helps people to understand it and stop asking questions like when will my date become current.

  22. Based on the forward movement, USCIS is trying to balance the workload on its staff which typically occurs from July to October as dates become current. While new I-485s are filed, EB3 to EB2 conversions & interfiling also happens a lot.
Since EB3 ROW is almost becoming current, this means a lot EB3 porting from (July-Aug 2007 fiasco) is completed, although many cases still will be converted this year.

For this year, we have June, July, Aug, Sep visa bulletins remaining before the fiscal year is closed. Thats where "typically" dates stall and even retrogress. Assuming 4-5 month average movement, we can expect EB2 PD dates to end up as Dec 2009 or so by Sep.

The problem is being current doesnt mean immediate GC. The process of RFE, interfile, etc takes 2 months or so and many people who become current in last months of fiscal year (Sep-Nov), see dates retrogressed and have to wait until next summer to get GCs.

I think people with EB2 PD of Oct 2009 (+/- 2 months) will get GC this year.

All others have to wait next year.

I will be really happy to know the Funda of Building Inventory and how it works. If they move dates to build inventory people will get EAD atleast and i will be really happy if i get EAD.

    1. No EAD for 2011 if Perm goes down will be around 2018 and if no executive action then. Completing 2008 and Prior will be for this year and EAD for ppl until August 2009 priority Date. and Getting GC for complete 2009 is 2016 and 2017 with EAD for 2010 priority dates next year and year after so I would guess your dates will be current only around July 2018 with EAD and getting GC in hand around early 2019.

    B> EB2 world wide pending b/w 2007 and May 2010 = 26,000 (approx)

    C> Assuming EB3 India porting to EB2 India = 14,000 (ballpark)

    1. yeah, based on the past two years, the SO to EB2 from various stream roughly total up to 14-16k. However, demand and porting activity has been high this year. Hence, the forward movement of dates will be much less than in the previous years probably reaching july/Aug 2009 at Best.

  30. I am a newbie in this prediction and analysis but here are the result of my analysis.

Here are the details of visa issued in 2014 worldwide
    EB1 40.608
    EB2 49,071
    EB3 42,699
    EB4 8287
    Eb5: 10,692

    Assuming the demand remains unchanged:

    • This means that EB1 was oversubscribed and no spill over from EB1 can be expected
    • EB2 received 49,071 out of which India took 23, which means all countries except India took 25,544 visas. If the worldwide demand remains same and all the other countries take same 25,544 EB2 visas this year that would create a balance of 14,496 visas visas (40,040 alloted to EB2 per year minus 25,544 taken by all countries except India). This 14496 visa will spillover to EB2 India.
    • EB4 took only 8287 of possible 9940 visas hence if the demand remains unchanged the unused 1653 visas from EB4 should spill over to EB2 India making total of16,149 visas available to India.
    • EB5 appears to have oversubscribed by 752 (10,692 minus the quota of 9940) and I am not sure if this is to be taken out of 16,149 above. Senior members please comment on this

If 16,149 visas are granted to EB2 India this physical year the PD will move to November or December 2010 (including about 300 EB3 porters per month)

If the same number hold true for 2016 year, then next year PD will move to January or Feb 2011

Correct me if I am wrong

    1. If 16,149 visas are granted to EB2 India this **FISCAL** year the PD will move to November or December 2010 (including about 300 EB3 porters per month) ... To Answer your question, Your assumption is based on last year and you do not have correct DATA.

Calculate this OTHER way, to clear the current i485 pending inventory, India needs approx 18K spillover from today. Which is highly anticipated that we get a huge spillover and inventory will be clear which is on paper right now. Only thing you, me and even USCIS do not know, number of applications after 1May2010. To understand the volume they have to create inventory and then dates will move. I think after August VB we see some Date Movements. Obama EO may help us to get AOS without waiting :), feeling lucky ...

  34. Newbie trying to understand the analysis: it seems right, except for the porting number which was approx 10,000 last year not 300*36.
    There is already 21,000 I 485 inventory as of jan'15, add 10k eb3 to eb2 porters= 31k less 16 k spillover = 14 k inventory as of sept 2015, which mean dates move to Aug/ sep 09 this fiscal.

Also please help me understand how did eb2 get 49,000 visa numbers when only 40k is allowable limit.
If we get around 20k spillovers it will surely move to dec 09.

  35. Shamin
I don’t think you are correct on the porting numbers

In January 2014, the pending inventory for EB3 India (with those with PD Aug 2007) was 32066. In Jaunary 2015 the pending inventory for EB3 India (with those with PD Aug 2007) was 27472. The decrease in inventory is 4594. This means 4594 EB3 were either given GC or ported to EB2 during the last one year. Without any spillover EB3 should have received 2800 visa (7% of 40,000) as per country quota. This means EB3 to EB2 India porting can’t be more than 1794 for the last year. Anyone disagrees?

    ReplyDelete
  36. Hi Ambal,
    Will you please clarify this?

You said that in FY 2014 a total of 23,527 GC were given to EB2 India, however the inventory for EB2 India with PD upto May 2010 has decreased form 31242 to 21082 during the last one year (Jan 2014 to Jan 2015) which is reduction of only 10,165. Where did the balance of 13,362 go. Don’t tell me that there were 13,362 EB3 to EB2 India porters for the year 2014.

In January 2014, the pending inventory for EB3 India (with those with PD Aug 2007) was 32066. In January 2015 the pending inventory for EB3 India (with those with PD Aug 2007) was 27472. The decrease in inventory is 4594. This means 4594 EB3 were either given GC or ported to EB2 during the last one year. Without any spillover EB3 should have received 2800 visa (7% of 40,000) as per country quota. This means EB3 to EB2 India porting can’t be more than 1794 for last year.

But what about those Eb3 to Eb2 porters whose dates are between Sept07 and April09.These numbers donot show up in the I 485 eb3 inventory because the dates never moved beyond Sep09.
They do however show up as new Eb2 I485 filings in the EB2 inventory and take up the mysterious 13K visa numbers.

and yes, there will be a few EB2's who missed their chance when dates were current, and are filing in 2014, but i doubt those numbers will be as high as 13k per year.
    Is this explanation plausible?

    2. Agree, but it is hard to believe that while porting from EB3I to EB2I from an inventory of 32066 (up to Sept 2007) is only 1794, that next 19 months (Sept 07 to April 09) it was 12K. I guess it is possible, since the inventory data up to Sept 2007 represents those who can’t port to EB2 (since most of the eligible has already ported to EB2)

      Delete
    3. yes,Another way of looking at is based on the benefits and risk. For Eb3 before Sep 2007, they already have AP, spouses can work, travel independently and they can change jobs with their EADs, hence less incentive to port to EB2 and risk losing it all if their application is rejected.
For porters fromSep07 to April09,there isnt anything much to lose, and application getting rejected is a small price to pay for a chance at swift EAD/GC,rather than wait decades.
Hence the *huge* numbers in the next 19 months.

Also i checked the 2013 years porting trend- it was around 5K for Sept07 to April09.
I think it was because a lot of eb3 porters held off porting due to hopes of immigration reform, and since nothing happened on that, 2014 saw almost 12K porters.
This year, the trend may be similar. Here is the ballpark:

      20K Inventory+ 10porting eb2 to eb3+ 3K new eb2 filings=33K inventory as of Sep 2015
If we have a spillover of 16K, there will still be around 17k left in Oct 2014 Eb2 I 485 inventory.

Hopefully, they will move the dates, beyond Dec 2010 to allow new Eb2 filings a chance to join the queue.

EB-2 India. After advancing 16 months in March 2015, and eight months in April, EB-2 India will advance another 7+ months in May, to April 15, 2008. As cautioned last month, members should not expect that this category will continue to advance at this pace beyond July, and should expect it to slow or stop in August and/or September.

    1. With an I-140 approved for more than 180 days, you should be able to changes employers (AC21 portability, right) as long as the new job classification matches the LC. Confirm with your attorney or other sources...
Really depends on whether you want to spend another few years with same employer or want to move on.

      Delete
    2. change it if its good offer, since your PD is 2013. it will take couple of years to become current.. so if you move now, by the time PD is current for your case, your 140 will be re approved from new employer.

if you are in 2011 Feb, EB2-I, then I will suggest you to stay with your consultant for another 1-2 years more.

There will be lights at the end of the tunnel.

If you change now ( after waiting 4 years already), you have to start your GC process again and by the time you get your I-140 approved to have old priority date, it will be another 1-2 years, some headaches, RFEs etc.

      Stay calm..........

Now I am again moving to another company .. will start all over again .. I know the risk involved but I dont want to feel exploited or sad that I missed opportunities..when you miss opportunity it is very tough to come back.. So make a move accordingly..Atleast you will have 3 years in hand as an extension and can apply.. all the best .. with greater risk comes greater rewards too ..There is not always only a loser thing associated ..if that is the case then there will be no business started :) ..

    Replies
    1. Why Retrogress Baba? Do you know the funda of Retrogress? If it reaches to Feb/March 2010 it means they will be left with 2 months of Inventory to clear out in FY 2016... and here Feb/March 2010 PD's will get GC as they have EAD's. So, if that happens it will not retrogress they have to move dates ahead to know the exact number of applications (Demand) to plan ahead. I think they create between 25k to 40k of inventory by moving dates so that folks can apply for i485...

      Any Thoughts?
