September 2015 Visa Bulletin and Analysis

September 2015 Visa Bulletin was released day before yesterday.

EB2:

Date for EB2 India retrogressed 01 OCT 08 to 01 JAN 06. EB2 China 
retrogressed from 15 DEC 13 to 01 JAN 06. The cut-off for all other EB2 countries are Current.

Good News is the EB2 other countries are still current.

EB3: 

Cut-off dates for EB3 India moved from 01 JUN 04 to 22 DEC 04. EB3 China moved from 01 JUN 04 to 22 DEC 04. EB3 Philippines moved from 01 JUN 04 to 22 DEC 04. For all other countries the date moved from 15 JUL 15 to 15 AUG 15. 

Good news is EB3 India moved 6 months and there is forward movement for all the countries. 

I-485 Pending inventory:

I-485 pending inventory data was released couple of days back. It says the data is current as of 20 July 2015. For EB2 India, there are 18,744 pending applications, whose priority is before 01 MAY 2010. For EB3 India, it is 25,146 applicants before 01 SEPT 2007 Priority date.


The explanation given for EB2 India slow movement in the last few months and retrogression this month is -- EB2 Other countries demand has increased. It is interesting to note in the inventory data that there are 17,745 applicants whose I-485 is pending in this category. In this, there are more than 15,000 applicants with priority date 2014 or earlier, in-spite of the fact that it has been current all along. Also, 1,265 applicants are pending under EB2 Philippines and 765 under EB2 Mexico. EB2 China has only 6,413 applicants pending with priority date before 01 JAN 2014.

On the EB3 India side, there are 8,837 I-485 applications pending in 2004 alone. Given that dates have moved to 22 DEC 04, there might be that much spill over OR the data is simply wrong, yet to be updated for porting. Here, EB3 Other countries pending count is 11,367.

What to Expect Next Few Months:

For EB3 India:

I am hoping it will does not retrogress and keep moving 2 weeks or more every bulletin

For EB2 India:

October Visa Bulletin is the first bulletin for the fiscal year. What will happen will depends on DOS Strategy. DOS can decide to keep the date same till June Visa Bulletin and start moving from July Visa Bulletin. OR, DOS can decide to keep advancing the priority date slowly every month. The EB3 India date movement of 4 months last Visa bulletin, and 6 months this visa bulletin, instead of the regular 2 weeks, will help in less porting and will eventually help EB2 India as well.

For all EB2, EB3 India folks -- 
Unfortunately, if we want to be here, we all have to go through it. Yes, it is a tough long frustrating journey. Hang in there. It will get over soon.

  3. It is amazing how broken the system is. For China it went from 2013 to 2006. US immigration system is beyond reasoning of any sort. I feel like we back to slavery days and what's worse is that the system is impeding most talented most educated most decent people in this country. This is not just bad for us it is bad for US as well.

    2. It does matter. Study after study has shown. Asians are amongst the top earners and we contribute so much to the economy directly and indirectly. Yes it has not been politically admitted but I believe they realize. On the other side to play devils advocate, nobody wants a group that threatens to overtake the existing majority.

      According to the AILA, Mr. Oppenheim predicts that it will move to a date between February and April of 2005. That's all? Ouch!

    5. You didn't mention country/category. So, I'll take India, EB-2 example.
      India EB-2 I-485 Pending inventory in July 2013: 43,418.
      July 2014: 31,234
      July 2015: 18,744.
      So it looks like around 12000 are getting processed each year. If this average remains the same, then your date will be current in 3 years, 2018. (assuming some 8000 - 10000 more applications will come in for JUN-DEC 2010).
      Your question is about EAD though, and that we all might be able to get as early as next year if the Pre-registration rule is put in place.

    6. Hi I'm sorry it's eb2 India with a pd of March 2005 which is current however if Octobers vb regress further it might not be current. Also since I'm current I was under the impression while it's being adjucated if it indeed does retrogess it might no longer be valid till it becomes current hence the question if it will in October 2015 retrogress to march or may 2005

  8. As long as these rogue abusers exist that use EB1C to get GC's there is no hope for EB2 to move. Add EB3 porting to it, it gets hopeless. Until the USCIS cracks down on EB1C there is no relief in sight.

    1. First of all I belong to EB2 ocean like most of you guys. I don't think we should blame the Desi consultancies who are misusing this EB1C category. It seems these companies pay good money to immigration lawyers and if a candidate is eligible for all the criteria of EB1C, they would consider to apply an EB1C green card for him/her. I would blame the law itself in this case. How come an EB1A/EB1B guy who has went through decades of research and education be compared with a 3 year desi consultancy manager? Again, Some of the EB1C guys who see my post would not be pleased with my comments. Sorry guys! A fair share of EB1C people are indeed very experienced engineers and they deserve much more than a cheap green card we are all fighting for. But I still hate the criteria of EB1C.
      One of my friends is a HR in TXTX XS. He finished his distance education in MBA and came to US on an L1. Now it seems his employer has been begging him to send documents so he can apply for EB1C soon just because L1 is being cracked upon by you know what. Yes, I am VERY JEALOUS in this case.

    2. A few could be experienced and I agree and so are there people who have their STEM degree with 10 years of experience who can be considered similar. The few experienced so called international managers might represent 1 in 1000 of all those who apply to EB1C. Its not only about company paying good money to lawyers. If American companies want they can certainly pay much more than what the desi companies pay, but they follow law which consulting firms don't. Its about ethical behavior than anything else.
      I request the owner of this blog to include this petition in the main blog. At the least we should be heard by congress, I don't expect them to take any action soon, but if we make our case this nonsense can be stopped and there will proper definitions on who can be eligible for EBC1 compared to every Tom Dick and Harry that can apply today.

The purpose of this petition is to address the loophole in the Law and also bring this issue to light that "A Manager in the US/Foreign country" is not the same as "A Manager in India" and definitely the latter cannot be equated to Nobel prize winner requirements even if they have exceptional ability. Hopefully what we expect is to get some parity that is all and above all voice that this happening.

    2. Probably 2016, but best chance in 2017 with the way things move. There are lot less applications in 2010-2012 which may cause the date to move aggressively to 2012 if it hits 2010. But all is hope. Let's wait for the real thing to happen with patience :)

  14. My PD is EB3 I - Dec 30 2004 - So very close. But I dont know what to make of it given that there are 3 more gates - Getting the RFE and once replied , getting to CPO and then physical card on hand. As I see in forums, there are folks who are "current" for close to year with no RFE. I am sitting tight with very moderate expectations !!

    1. Totally agree. Every month eagerly awaiting for the 10th with a glimmer of hope only to feel the pain seeing the visa bulletins. It is even more depressing to see the I485 pending inventory. The cherry on top will be the moment when a friend(Who came in 2010 through InfosysL1B and got a GC) comes and ask why don't we go to Canada for the weekend and then mindfully reminding himself that I have been standing in the queue while he raced past me. When he applied for GC, no questions where asked. I apply for LCA with a STEM degree in the US and provided all transcripts, I get a RFE asking, could you please prove you have the right education for your job??. Excuse me officer, if only you had spend that time thinking more about how EB1C candidates are eligible and focusing a bit more on the documents I actually submitted.. we will not be talking this.

  18. I have full time offer now. I am confused to take it or not. My status - EB2 India PD Nov 2010. Should I stick with my employer or take full time! Any advice appreciate it...

    1. Go for the full time offer.

      Your new employer will start new GC after 1 Year
      Then it will take another 1.5 Years to get I-140 and date porting.

      Total 2.5 Years, which is 2018 from now.

      It does not look like 2010 Nov will become current until 2018.
      You will have peace of mind at least.

    1. You should switch to the new job. As mentioned by you already, you are easily looking around 2 years wait time. If you don't mind spending extra bucks, you can do a PP for I-140. So with labor and I-140 u r looking around 5-6 months.

  20. I would recommend getting the new job, but you can negotiate with your employer to consider filing Perm in 3 months after your start rather than wait for a year. This way you can minimize your risk a bit. Good luck!

  21. According to Mr Charles Oppenheim only 7500 EB2 485 have been approved in fiscal 2015 compared to 23000 in 2014. The culprit - World wide demand increase and unavailability of unused EB1 for India. The latter point clearly points to the EB1C abuse. Assuming 50000 students come from India every year of which 5% will end up with Phd's and eligible for EB1, which is 2500, the remaining thousands are being eaten up by our shameless citizens @ Infosys / TCS/ Cognizant et all.

  22. EB1C folks from Indian consulting companies are not frauds. They have simply followed the prudent advise of contacting their local MLA. You can too get GC in 6 months. Just talk to your local MLA and send attested passport size photo to USCIS with recommendation letter from MLA. Good luck! More power to consulting geniuses. May the EB1C consulting manager deluge drown EB2 MS/PhD applicants.

  23. another interesting thing i found out that ppl who are managers and got gc under eb1c working for so called sweat shop are struggling to find any good job outside there current employer.. most they can find is another similar job in a sweat shop.. i think they are useless for open market and meant for the employer who brought them in US as a manager... lol

    1. if they are willing to file new perm , go for it.. as of now.. looks like you have another 3-4 yrs of wait to file i 485... unless the ead rules goes through.. but everyone is saying that don't count on it for your future planning.

    6. To help understand the EB2 I situation better-
      There 18800 in i485 pending inventory today.Considering the dates never moved past May 2009, there may be additional EB2 I filings( who missed in 2012) and porting is still an advantage to the EB3 I folks, you can expect in total an additional 15k(approx) spread over 5 years, as the dates drag towards April 2010,.. so that gives us- 18K+15K=33k.
      All the advantageous factors that helped India get Huge spillovers, have diminished.
      Going by a positively conservative average figure of 5k visa available to India per year for the next 5 years,Inventory build could take place around 2020/2021.

  31. Pretty bummed out by the lack of progress in this years visa bulletin for eb2i. My priority date is late dec 2010.
    In order to understand when i would actually get the green card, if no spillovers are available, given the present scenario..and what the inventory could be, i took a few pointers from ( spec, qs blog) and the Ombudsman report 2015 which gives the I140 filings data from 2009-2014.
    After all the adjustments for acceptance/rejection rate, and assuming India makes up for 55%of Eb2 filings, and multipling by a factor of 2.05(yourself and spouse in most cases) the rough estimate of total i485 fiings are 37000 per year approx for 2010. Less 5k which is already accounted for (in present inventory )till April 2010 is 32,000 .The 2009 eb2 i485 figures are 14k, and they are already a part of the present inventory.

    Next eb3 i485 calculated figures for the same period are around 18,000. Lets say 60% of this will port to EB2- 10,800.
    Further, 2009 (june 09 to dec09) eb3 to eb2 porters at 60% porting rate is around 6500.
    With around 19k inventory already present, the total number till Dec2010 ( 19K+32K+10800+6500) is 68300.

    If just Eb2 india 7% quota is of 2800 is taken, it would take 24.39 years from today ie from 2015 to get GC.
    30 years in total for a Dec 2010 Eb2 priority date. :(

    Yes,that is the most pessimistic view..
    Changes in immigration law, crackdown on rouge EB1C filers, some spillover from family based visas, Eb3 catching up and easing the porting pressure and even some degree of downgrades to Eb3, might make things move faster.

  33. In light of the above post, Pappu's EB2I story..

    Pappu came to the land of dreams and opportunities i.e.USA in October on 2007 on the coveted H1B Visa.
    He married a year later and brought along with him a pretty,career savvy, stylish ,techie biwi..Pammi, who was all too happy to be in the USA.
    The same year, Pappu asks his co. to file for GC, they tell him its recession, and it would be rejected if filed now.. he needs to wait atleast a year more. 2 years of begging the company reluctantly begins the GC process in late 2009, and after a lot of back n forth Pappu gets a priority date of early 2011 EB2 I. He is pleased, his friends and family congratulate him.. Everyone tells him 2011+6 years you will get your GC, or even faster as filing were very low during recession.

    Now Pammi has been quite upset, she's quit her career,and though the first year went happily in site-seeing, posting FB pics, cooking experiments, and friends she is bored and wants to work. Her friends n family don't understand the H4 spouse cant work theory and keep questioning her. She tells Pappu she wants to do her MS to get OPT. They agree.. She takes, GRE/TOEFL,applies for admission and tells all her friends she plans to join college.

    That evening, Pappu returns home rather worried, his Co has laid off thousands of people worldwide.. his job is shaky.. he tells Pammi she may not be able to join for MS after all.He consoles her saying he's heard rumors of H4 Ead and most likely by next year she can work.. its a win- win coz their child paplu by then will be ready for daycare!

    2011 passes,2012 passes,2013 passes..
    Pappu n Pammi sign every petition to whitehous, and forward to friends as well, comment on blogs, and wait eagerly for any news on immigration reform...a BIG announcement is on its way that year!
    2014 ..Paplu joins preschool.

    Among other news H4 ead finally gains momentum( thanks to rashi, kamakazee, dataguy). In the Fall on that year, the much awaited reform is announced...Pappu has his papers ready..(just in case all dates get current)...hullabaloo ensues, the dust settles everyone realizes NOTHING has changed.

    2015- Jan- Pappu's meets his friend P, who has a B.com and a year of distance Mgmt education..comes to US on L1A visa in 2013 and gets GC in hand. He says he's opening a consultancy with his fellow extraordinary ( read EB1C) skilled colleagues, and is looking to recruit US MS Grads on OPT. He gives pappu an offer too!

    2015 July- Pammi gets EAD,and trying hard to get a job, bouncing from one consultant to the next. She has a 8 year career break.
    2015 August- Pappu waits with bated breath for the 10th,the inventory build up is to happen.... yet again.. visa retrogressed..he reads a disappointing blog with all calculations that tell him his wait could stretch into 30years.

    He works hard for 30years, knowing if he loses his job so will his wife,a risk he can't take with growing bills,aging parents and kids about to start college and heart problems( the doc says its all the stress).He is the hardest worker in the team, but passed up for all promotions, because he has to be in a same or similar job till GC.

    2041- Pappu gets his GC today, He will be retiring in 20days.
    He is happy he can now babysit his grand kid with out fear of breaking the law.

    1. This guy (the person who wrote the article) does not understands the inventory data. He is giving us the false hopes. There are total of 2800 people waiting till dec 2008.

      The reality is that if we do not get the spillovers and if there is no porting (from EB3 to EB2) and there is no one who missed the boat (meaning all are accounted for, who are going to apply I-485) then the dates will move till Dec 2008 (this is max).

      If we add porting and the person who may have missed the boat, then it will not move beyond Dec 2007.

      The only reason we can move ahead, is by getting the spillovers. Spill overs which will not come easily due to

      1. Eb1 taking all the visas
      2. Lots of Eb2 demands form the other countries.

      So nothing will come to EB2 India. However, if we get 23000 spillovers like we did in years from 2010 to 2014 then we might see the dates moved to May 2010 (max).

      No new dates are going to come....sorry but this is the truth.

  39. None of us has direct eye on the ROW demand, porting, EB1C usage and other parameters on which inventory data and priority date are based. No point in blaming on any of above.

    On top of this, probably no one exactly knows where US economy stands in 2016. Oil market is already has downturn going on. Probably all above (in paragraph one) are based on later stated point only.
    Canadian government has opened up few gates, if someone is looking for somewhat peaceful and secured life as an option.

    What irks me is that our folks are still naive over the immigration situation.Many still expect to get Gc in hand 6yrs priority date ( esp eb2i), without understanding how Eb1c, has fundamentally changed things for the worse in the recent years.
    There are atleast 2,50,000 ( both Eb2/3) of us waiting to file I-485, but the signatures in any petition to WH do not exceed 1000, and often its the same people signing everywhere.

    if we are content with letting things take their course, remember that while we slacked, 40000 new Eb1c India filers per year will have got GC and are on their way to citizenship in 4.5 years thereafter.
    Good luck with the new 'citizen' managers ...and the new immigration policy changes they vote for!!

    Very very simple.

    Total EB2-I pending = 25K
    Total EB2-I eligible per year=2800

    In past years :-
    1. EB2-I was getting SO from EB1 & others approx 15-16K
    So it was moving big time

    Now:-
    1. EB1 is going towards a cut off date
    2. EB3 porters are coming and joining EB2
    3. There are only 500-600 SO

    So to clear the current backlog of EB2-I , it will take 25K/2800 = approx 9 Years

    And then it will start from 2010-May.

    So till May-2010 priority date it will be 9+ years
    After 2010-May priority date it will be 10+ Years ( plus add 2 years each for each consecutive years)

    i.e.

    Priority date 2009 = 2018
    Priority date 2010 = 2019
    Priority date 2011 = 2021
    Priority date 2012 = 2023
    Priority date 2013 = 2025
    Priority date 2014 = 2027
    Priority date 2015 = 2029

    1. The calculation is incorrect. if eb2i inventory is 25k today(ie19k present +6k porters from eb3) before May 2010.and 2800 is yearly quota+600 spillover available, then it would be 8years FROM TODAY 2015..so priority date before May 2010 will get GC in 2023.
      After that it will move 1 -2 months every year based on the number of filings.

    After struggling in USA in 70/30 rate with my employer for 4 years, finally he agreed to start my GC in EB2. I am from India. He has asked me to prepare all necessary documents. Most probably by next year March or April ( latest) my advertisement work will start.

    2. As of now people with priority date after May 01, 2010 are hoping to get their GCs at least 10 years from today... Or atleast by 2025. So if no rule changes you have atleast 20 or more years to go. The good news however is that after I 140 is approved your spouse can work on h4 ead, and you too can get ead if I 140 rule is approved.

      1) Misusing EB1 by consulting company to faster way to get GC - timeframe 1 year or less
      2) Marrying citizen
      3) Qualified to be in EB1 or any other category to be eligible.

      If you stuck with EB2, EB2 India is still pending from 2009, ( even 2007 priority date migrated from EB3) .

      if your filing EB2 2016 priority date, you can calculate when you will receive GC.
      As per new modernization there might be few benefits which were not available that is the hope.

National Law Review reports today (09/03/2015) that the reform will create two separate monthly cut-off dates: One for Approval Cutoff Date, that will allow pending I-485 applicants to get approval of the green cards. The other Approval Cutoff date, that will allow the approved I-140 to file I-485 application (pre-registration) with EAD and AP and portability of I-140 for employment changes. Reportedly, “acceptance” cut-off dates will be several years before the “approval” cut-off dates in the China/India EB categories. Wow.

    1. Are you a moron? What is this petition for and to whom?

      Its to the White House, don't you donkeys know that White House had been working on this for more than an year now? Ignorance of this EB community is so appalling, sometimes I wonder what is the qualification underwhich you guys come over. Know who the petition is to, what is the current status of the issue, and who are the allies, and what is the procedure. Try to do some ground work before creating good for nothing online petitions.

  86. People knows what's happening. Signatures may help others and organization understand that many people are affected and waiting for solutions. Even though they know this will become on paper. Signature may make case strong in case of any law suits. Also I agree, some people may not know completely about the petition but most of us are here to share and looking for some fruitful solution to this long wait.
    If you have done your ground work then guide others rather than barking in the blog. Hope you understand and act mature next time in your reply rather than becoming moron.

    Thanks for your support. There are many fixes that make the package. The VB fixes will be implemented start new fiscal year starting 1st Oct. Then there will be fixes done through memos like fix for 'same or similar'. We expect memos and VB fixes will be announced in next 2 weeks. The regulatory fixes will need to go through the regulatory process.Overall you will start seeing fixes starting to get announced very soon, within next 2 weeks.

    Because of some last minute issues, DHS decided not to implement the planned changes in 'visa bulletin' for coming few months. They are currently studying the pros and cons of implementing such measures in view of recent judiciary law suit against H4-EAD.
    We at IV can assure that we have guaranteed information on the proposed changes which will benefit thousands in EB line.
    Please wait for some more months and we will let you know once USCIS is ready to announce those.
