Are we in the new phase for EB2 India ?


August Visa Bulletin was released earlier this month. The EB2 India dates for getting Green Card stands at 15 NOV 04. The EB3 India date is at 08 NOV 04. New Cut-off dates are introduced for EB1 China and India and that date is 01 JAN 10.

Estimated 140,300 Green Cards (immigrant visas) are expected to be given this fiscal year -- between 1 October 2015 and 30 September 2016 -- under Employment Based Green Card category.

The number of Green Cards issued under EB2 India category is as follows:

FY 2014 - 23,527
FY 2013 - 17,193
FY 2012 - 19,726
FY 2011 - 23,997
FY 2010 - 19,961
FY 2009 - 10,106
FY 2008 - 14,806

EB2 India receives 2,809 immigrant visas (Green Cards) every year. On the top of it, it receives spill over from EB1, EB4, EB5 and EB2 - ROW. Typically, unused numbers from EB4 and EB5 go to EB1. Unused numbers from EB1 goes to EB2. In EB2, all the spillover go to most retrogressed country (India in this case) till it reaches the next retrogressed (China in this case).

This year, by the very fact that, DOS has established a cut-off for EB1 India and EB1 China, tell us that EB4, EB5 and EB1 will not come to EB2. We also see from I-485 inventory that there is more demand for EB2 from other countries and more porting happening from EB3 India to EB2 India.

Given all this, it makes me wonder, if we are in a new phase for EB2 India. The spillover reducing on one side and porting from EB3 to EB2 increasing on the other side, makes it nearly impossible for the dates to move forward. In theory, all the 18,000+ EB3 India applicants can port to EB2 India. In theory, all available visas for EB2 India can be consumed by porting. In Practice, if this happens, then EB2 India dates can't move much further and, EB3 and EB2 India dates have to move hand-in-hand. Not a good situation, but it might be the reality ! We have to wait and watch to see if it is !

We deserve the right to be heard and as skilled immigrants waiting in line, we are in our legal right for a due process and ask such questions. I am in EB2, June 2009 with 2 MS degrees from top schools. Here since 2002.

I am in same boat EB2 Oct (not porter), been here with Master degree since 2003, and even missed getting EAD when dates were current my company was going through acquisition. Its frustrating and hope there would be some reform.

    5. I am here supporting Indians. Having two MS degrees is actually a big benefit to me. I work at a top bank at a Sr. level. I have changed by job 4 times at top firms who redid the PERM for me. I hope you get my point ( and no, I am not in IT which many of you will stereotype). I am here supporting India and few folks like me will do so even after we get our GC ( if I am still in US ). The immigration law is this country is flawed. My employers never put a country cap on skill. They look for the best talent. Similarly, we Indians work in top jobs but a guy from country "X" with a mediocre job gets a GC approved in 6 months under EB3. Write a letter, support petitions and try talking to Indians who have the political connections in your communities. It’s about raising a voice while you are here for something which is biased and unconstitutional against skilled Indians living here. Some of you may tell me to go back. To that I say, that’s none of your business where I choose to stay. Learn from what Mark Zuckerberg's immigration movement had achieved. Obama , was able to give H4 spouses EAD. That’s a big win and we need to keep fighting for more reforms like that.

  5. Petitions are the only way out. Because Obama is refreshing his browser and checking every 5 minutes looking for a petition. Oh I forgot he passed an executive order for i140 EAD in Nov 2014, by looking at the white house petition. And the DHS is going to soon give us EADs.

  7. Immigration is political football. The status quo helps all sides. One side ratchets up the fear, the other side gives false hope. Seriously though, if immigration were reformed, which side does it help? It helps you and me but it doesn't help lobbyists, politicians, think tanks. A hot issue as long as it is alive helps pay the bills of all those people. It is in their interest to keep it burning forever. Tell your citizen friends to vote for the candidate this November who will at least maintain the status quo.

      Ever watched The House of Cards? It is worse in reality, the guy above summarizes some good points, good job bruh.

      What US DOS will argue is that, they are giving the max Green Cards to INDIA, it does not matter what category it came from, INDIA receives the MAXIMUM GC's every single year. If I were a US Citizen, it completely makes sense why GC's for EB's Categories should be slowed down even further.

      Desi companies applied GC's left and right in the last 12 years, why? even if you argue that, USCIS should have not accepted the forms at all to begin with, they are within their legal boundaries to review and accept the PERM and 1-140 applications, can't blame them there and ton's of money in the making from those applications.

      my PD is somewhere in Jan 2011, like DOS want's, I plan to vacate my seat here in the US sometime soon and head back home where I always belonged, agreed have to change GAS cylinders, live without power for a few days, I love all that.

      Being an Indian, I seriously have come to hate Desi's now employed in CVS and Walgreens. We appreciate American values and Customer Service, I seriously don't want desi's to infiltrate American labor jobs. That ruins the very essence of AMERICA. I know many agree with my point of view, some don't. Listen to your conscience.

Not sure if u implied pharmacy unit or front desk at walgreens or cvs. Pharmacy requires specialization and not too many Americans don't go for degree which is the reason why we are seeing more foreigners in those pharmacy unit. I don't know if cvs and wg can be franchised. If it is desis/gujaratis might have entered that market

  8. The USCIS policy of keeping the same priority dates for Porting is the biggest blunder of all. Unless that undergoes some massive change - EB2 has no hope. Or some other category between EB2 and EB1 should be formalized where original EB2 applicants waiting for some threshold of years would qualify. Very sad!!

    1. My guess is 2022. There are about 10000 before you and if 4000 port in between its 6 years. Without porting another 3 to 4 years which is unlikely. Similarly eb3 may reach mid 2006 in about 3 to 4 years without porting. There are about 8000 eb3 before 2006 majority in 2004 might have. Remaining eb3i 6000 in 2.5 years is likely. Again those who are porting may help eb3 move much faster and some may even move from eb2 to eb3. Lack of real numbers in 2008 or 2009 eb3 makes it hard to predict

    1. 13k EB3-I cases are pending ahead of you. If you stay in EB3 Queue you will be current in 2-3 years assuming 5-6k EB3-I cases will port to EB2-I and if you can port to EB2-I, you will be current in Oct-Nov 2016.

  20. Looks like the petition to WhiteHouse reached the maximum signatures needed? maybe exceeded by a little over :)

    I sincerely hope things are resolved and law makers understand the real issues involved.

    I work as a consultant in Citi Group and I'm tortured every day for months by this Indian Manager, I'm told to eat lunch at desk and cannot leave, literally working for 11 hrs a day including nights.

    No amount of request, persuasion or escalation to the higher managers have any change.

    Being tied to one employer with no portability a family to take care off, my life is nothing short of a nightmare right now.

    I'm laughing at my problems none the less, I know what goes around comes around..Karma?

    3. If you think it might take a year for your PD to become current its better to go to a new job and get new PERM. Just do that in a legit companies and they will take care.
      Unfortunately Desi consulting managers are more parents than managers. They just micromanage like their reports are their kids. I have seen this over and over happening to people. I advise my friends (when asked)about change of job is don't get a Desi manager. Even if you do find someone who has studied in the US or brought up in the US. Life will be way better. I'm not saying everyone is like that but a majority of them are jerks , especially those who come directly from India and who are not exposed to the western style of mgmt.

  23. With new VB releasing today, EB3 India goes to Feb 2015. Without pending inventory, THE WILD guess is if no porting is involved it will move by a month or two (April 2015) at the end of Sep 2017. If some porting happens in EB3 for years 2005 then the dates may even reach 2006. EB2I is complex and is at mercy of porters. Without porting it may reach end of 2008 by September 2017 but we all know porting will happen. Even if 1500 with PD before 2008 port it may not cross 2006 by Sep 2017. Most likely situation EB3 and EB2 will go hand in hand for few years to come and EB3 has a chance to do better than EB2.

  25. I could not find discussion on the petition even though more than 100000 signs collected before time Vs. petition about OPT which was discussed many times on immigration-law.com, murthy.com and elsewhere.
    But everyone knows that more than 100000 people are affected due to current situation. It seems now on India EB2 and EB3 will roll at same pace. But I think we should keep on producing this type of petition with these many signs until that heard.

  27. I spoke to a US Senator's Office case worker who handles immigration issues.

    From what she tells me, there is no way that the massive backlog for employment immigration be resolved in the immediate future, per her the timeline is >10years.

    The reasons they site is, lack of confidence motion, that there isn't enough interest by the members of congress to make a case.

    There isn't enough labor to handle such massive backlog's

    There isn't a concrete effort to mandate a debate on making it a law, just to get a law drafted would potentially take minimum 3 years and there upon debates for pro's and con's would be taken up on the floor, that takes nearly a few months depending on the strength/importance.

    She was brutally honest and said they receive several such requests throughout the year inquiring on employment base immigration movement.

    So, I think we know most of what she covers. I don't think it is logical to sit and wait here for another 10 years, which would be morally and mentally dangerous.

    Also, the companies are quickly enforcing strict rules around limiting working with 3rd party contracts.

  28. We should put pressure on the EAD for I-140 holder rule. That doesn't need congress to pass any law. The current rule only allows for spouses of I-140 holders to get EAD. Any Indian here on I-140 with say 2 years on EB1/2 or 3, should be allowed a basic right to change job in similar fields and travel to home country without the need for visa stamping and PERM re-approvals. It’s very unfortunate how legal Indians are being treated like third grade people here by a completely political and biased immigration system. Trust me; law firms like Murthy are not our voice. They want this to never end as there livelihood depends upon this.

  29. Till a couple of years back EB1 was like premium airport security. So the great liers ... sorry Lawyers (remember those QA managers and other senior executives from great service companies from whom you pocketed big fees by applying EB1), took to that task and filled up that line and choked EB2. Now with greater help EB3 porting , EB2 is further choked.

    Fast forward a few years. Folks with adult US children will start choking the family visas queue. Assuming nothing is done to this immigration system Indians and Chinese will completely inundate every queue and predicting VB will be the easiest job. It will move 2 weeks for every single category throughout the fiscal year ...

    Thanks to lawyers, consulting companies and politics for this deadlock.

  35. REQUEST TO THE COMMUNITY - ENDING EB-1C FRAUD/ABUSE

    I wanted to write to the community for help in decreasing EB1-C fraud. As you know, this has MAJORLY impacted EB-2I and led to SEVERE retrogression. This is due to a handful of companies violating namely CTS, TCS, Infosys and a few others.

    For EB1-C, no doubt there are genuine petitions for high level managers/executives by the above mentioned companies and that is ok. My point is that a large percentage of people applying for EB1-C are just programmers and engineers and not high level Managers. Therein lies the abuse.

    I would therefore request folks who are impacted by the severe EB-2I retrogression to write about the EB-1C abuse to the: USCIS - OFFICE OF INSPECTOR GENERAL - HOMELAND SECURITY. They specifically investigate any visa related fraud perpetuated by Indian Outsourcing Companies.

    IF HUNDREDS OF LETTERS/EMAILS ARE SENT TO THEM THEY WILL DEFINITELY INVESTIGATE.

    Here is the result of their investigation to stop L-1 Fraud in India

    India Consolidates Blanket L-1 Cases
    In December 2011, Department of State (DOS) visa posts in India
    centralized blanket L-1 petition processing in Chennai. Posts in India
    process the most L-1 visas in the world, with 37 percent of total visas
    worldwide in FY 2011. Almost 90 perc
    ent of these petitions were for
    blanket L-1 visas. According to Consular Team India, “India is the only
    country in the world where companies have built a business model
    dependent on using blanket L-1s to send large numbers of personnel to
    the United States who would otherwise require H-1Bs.” Consolidation
    was implemented at the recommendation of the DOS Office of
    Inspector General, urging more supervision, consistency, and
    centralization of visa operations in India.
    Prior to consolidation, L-1 visa standards lacked uniformity.
    Inconsistencies among posts and the complexity of this visa category
    created fairness issues; petitioning companies noted different outcomes
    for their employees with similar circumstances.
    Immediately following consolidation, Chennai started to see positive
    results in its adjudicative process. Consular officers in Chennai handled
    more cases and became more confident and expert. As a result, the
    number of unqualified applicants has decreased and fraud indicators
    have declined.

    Please email/write letters to the USCIS INSPECTOR GENERAL regarding EB1-C fraud so that they can tighten the screws against violators like CTS and Infosys. In your letter/Emails, name these specific IT outsourcing companies that are perpetuating this fraud.

Intention is not to penalize people who have already received the greencard, but rather stop Indian Outsourcing companies from carrying out this abuse in the FUTURE. Here is a suggested letter.

      Dear Sir/Maam,
      I would like to bring to your notice the widespread abuse regarding the EB-1C visa being perpetuated by Indian IT outsourcing companies like Cognizant, Tata Consulting Services, Infosys, Wipro and others. The EB-1C visa is meant for really high level managers/executives who manage 20-30+ people. However even lower level employees who are not managers (e.g. engineers/programmers) from the above mentioned companies are misusing and abusing the EB-1C process to obtain permanent residency greencards, which is a violation of the provisions of the laws governing EB-1C.

      I would appreciate if your department can hold an investigation in these practices of the IT outsourcing companies (Cognizant, Tata Consulting Services, Infosys, Wipro and others) as they are violating the EB-1C provisions and letting NON-MANAGERS (e.g. engineers/programmers)obtain their permanent residency greencards via the EB-1C process which is an abuse of the law and its provisions.

      You should NOT say engineers/programmers it will sound like talented individuals and OMB/Agencies would think "why NOT let them have GC's?" since real engineers/programmers are of shortage in the USA.

Add to these companies like American express which are also doing EB1-C for 26 year fresh grads they hire in Gurgaon and then bring them over here at 70k under EB1C in less than 2 years. EB1C is 12k now and each year is going up due to such abuse even by well established MNCs which are sourcing cheap labor.

      Most of EB2s and EB3s before 2008 have all got their EAD's and some GC's! it must move at least to somewhere in 2011 or 12 to make any difference to the backlog. Waiting over 13 years here on EB2..PD 2010.

    1. totally agree...I wasted my time and life here. I started canada process in 2011 but then got hopefull that my PD date of Jun 2009 EB2I will become current someday. I never completed my Canada PR. Today i would have a citizen and taking vacations with my Canadian passport. Here, I to continue living the american dream. BTW..I heard Canada now is a 6 year rule for getting citizenship and Australia has stopped giving citizenship as well ? Also your comp can be hard to match. 200k+ jobs are hard to get in Canada. Any thoughts/comments ?

    3. UK is the best option. I have a friend who did his second MS from Berkeley in Fin Engg and moved to UK about 6 yrs back and now he is a citizen. His salary is in upper 250k gbp range at a Bank. So yes, if you have the skills UK is good option. Healthcare and pension are lot better. guess what, he now doesn't mind coming back to US since he has UK passport. Australia I heard is getting tough ( depends upon your field. I am in finance). Singapore stopped giving citizenship to Indians but pay there is same as US ( after taxes and expenses).

  55. Wonder if the entire pending inventory is a farce. Many of us havent seen anyone people in EB2I with PD before 2009 JAN and EB3I before 2007. May be my sampling is incorrect but the few 100s I know all have GC's with PD earlier than 2009 MAR. Similarly I asked several of those and they dont seem to know anyone with pending I485. There might be some may be couple of 100s but I started doubting if USCIS is really accurate and honest with these numbers

We indians have in our DNA to not do anything. uscis shld be sued as they are creating a total mess when it comes to alloting GCs and recapturing visa numbers from last 10yrs

    2. One of my friends was saying that the petition to wh can be filed only by US citizen (in the wake of petition to wh to designate pak as terrorist state). Filing lawsuit on ead was quashed by us court sometime back.

    1. My guess is it will go to end of 2008 in next 2 vb's and thats it FOR this year. With porting involved and no rollover from eb1/eb5 it will rarely reach 2009 April. In addition USCIS is not releasing pending inventory which makes it tough to predict. Few in 2009 will get medical rfe only to find USCIS is wasting those folks money. 2009 August may take 4 to 5 years to finish.

  59. Just looked into Aug 2011 VB, where as for India EB2 current date was 15 APR 2007 where as after 5 years now Nov 2016 VB says EB2 current date is 01 NOV 07.. So hardly 6 months movement in 5 years... think about people who's PD is in 2015....that too hardly 2809 visa per year including family members... so hardly 750(2809/3.75) family's eligible to get GC per year.. Indians in the wait list is huge...20 years wait time is what I'm predicting...

  70. None of us are going to go back voluntarily. Trump will either kick us out ( which I think is good since we can get on with our lives in our motherland) or Reps will clear the "legal" backlog first. I suspect US is going to have a immigration system similar to Canada's or UK's which will be point based ( i.e skills based) and the bar will be high enough. H1-B wont' be scraped but wage determination will be set higher and hiring period will be extended.I am hopeful that thing will change for better with immigration under Reps than Dems. Obama took office in 2008. All my friends in EB2 from 2007 and early 08' are citizens now. During Obama's 8 yrs the legal line stayed put. I am hoping under Trump's it moves faster ( and before he gets impeached)

  81. friends, its true that people who have PD of 2009 or 2010 might get the GC within 5-6 years, but for 2011 and so on, it will be of 15-20 years atleast. We need to have some backup plan so that we can always have some escape route planned, whether it might be going back to India or something else, without that, with job loss in US and no health insurance, life is worse than dogs on streets.

  85. October 2016 Pending 485 inventory is out, Eb2 #s unchanged while Eb3 has gone down significantly to 12,000 from 20,000 in October 2016. This explains the lack of move in Eb2 as the entire available GCs in Eb2 is consumed by Eb3 porters.

If quiet a few people start porting from EB3 to EB2, the queue for EB3 will start to get shortened and will make the dates to move little faster for Eb3 resulting in less porting and even prompt some in EB2 to file in EB3 clearing the queue in EB2. There will be years where the EB1 filings will go down(atleast I hope so) and rest of world. There were years when eb2I got 23k visas. Keeping all that in mind , my guess is 2009 : 2020. 2010: 2023 2011: 2026, 2012: 2030. In addition to that, I feel that there will be some change in immigration law within the next few years. Be positive and hang in there. Do remember that india is your home country which you can always go back to.

  93. I'm pretty sure things will move pretty fast in the next 3 years and the process will be streamlined.

    I don't think USCIS | DHS will make people wait beyond 10 years to get their EAD eventually a Green Card shortly after.

    People who write stories of 29 year wait times need to lighten up and stop being desperate, needy. Time to grow up.
