EB2 and EB3 India Visa Bulletin Movements


October 2017 Visa Bulletin was released earlier this month. The first bulletin for FY 2018. The EB2 India dates for getting Green Card stands at 15 SEP 08. The EB3 India date is at 15 OCT 06. [1]

Estimated 140,000 Green Cards (immigrant visas) are expected to be given this fiscal year -- between 1 October 2017 and 30 September 2018 -- under Employment Based Green Card category. [2]

In FY 2016, the number of green cards given for EB2 India was 3,930 and EB3 India was 4,583. These numbers confirmed the significant reduction of spillover for EB2 India category. [3]

According to latest inventory we have, as of August 2017, For EB3 India, there are about 1600 I-485s pending for last 3 months of 2006 and 1879 for Jan to Aug 2007. For EB2 India, there are about 1400 I-485s pending for last 4 months of 2008. [4]

Regarding the filing dates, USCIS has a logic, which we have no visibility to. They can technically open up the Filing dates to latest dates. This will give opportunity to file I-485 and more importantly get the EAD and give the much needed -- less hassle job portability.

Given this, I think EB2 India, for final action dates, will move only at the same pace -- one week to a month per bulletin -- depending on spill over and porting. On the other hand, EB3 India should move much faster. Going by the inventory, and assuming 4000 Green Cards to be given, for the whole year -- till September 2018 visa bullein -- the EB3 India can move to 01 Sep 07. For EB2 India, if there is no porting and assuming 4000 GC to be given, it can move to 01 MAY 09. How much less than that, will depend on porting.

  2. Thanks man, based on this analysis, the Dates for filing may move up-to Jan 2010 in the next 2 years, opening up EAD opportunity for people with PD till Jan 2010

    My analysis is this, based on current numbers, if India EB2&3 clear up till Dec 2008 in the next 2 years, the DOF AOS will be significantly moved

    I don't believe USCIS|DHS will be unreasonable, beyond my reasonable doubt

  7. My question is why there should be any more porting? If I am EB3 with a date between 2006-2008, whay should I reisk a port when EB3 is expected to move fast now.
    And a valid guess that number of EB3 candidates in year 2006-2008 would be very less, since most have already ported.

  11. Comparing the EB2 inventory data for India, for April 2017 and August 2017, there is big drop of pending inventory even for months which have not been current. Eg Jan, Feb, Mar 2009 shows drop from 1300s to 600s. How is it possible? Does it indicate GCs are getting processed for dates not current? Thanks?

    1. If you recollect, the filing dates in May 2012 reached around May 2010, meaning anyone with a PD of May 5th 2010 were eligible to file for their I-485.

      Maybe, they are processing people who filed all these years up until May 5th 2010, they must be processing as and when visa number are handy

    2. I could be wrong but I think these numbers are fake and the administration purposefully want to go slow and coming up with random numbers. There is a huge spike in numbers from Jan to April (porting??) and in september huge drop even when dates are not current (reverse porting to eb3?? which however dont think is the case). By this time most porters might have got green cards till 2009 April. With no accountability in USCIS/DOS things will be like this for several years

  12. EB1C India is a fraud and it violates the spirit of the law (if not the letter). Nobody from TCS/CTS etc who is getting EB1C these days is qualified and worthy of that priority. It WILL be stopped one day or the other -- very soon as it is a big loss for USA. Someone from USCIS will realize their big mistake!

      Not all are blessed. For family emergency situation I had left India lived there for fours years and came on 2014 with the help of my lawyer i was able retain old date. Sir what's wrong in porting is it illegal? BTW not all employers agree to file in EB2/EB1.

    4. we have the EB2 category for a reason,the problem starts when people who don't qualify for EB2 to begin with port to EB3 after 5 years by putting the false paperwork together and freaking port to EB2, this is what is happening for the last 6-8 years. This slows down the game for everyone waiting in line that qualified for EB2 to start with! Now do you understand the problem?

  14. Why so much animosity towards to porters and even EB1C filers? What makes you think you are moral and just? What answers would you have for an American who accuses you of stealing his/her job? You would be up in arms defending your position when accused, right? Similarly everyone here has his/her own position which in their realm is just. Mind you, all of these are legal. So instead of complaining, please cool off and just hope to get your card some day. Until then, enjoy life and start believing in the positivities around you.

    4. There is animosity towards idiotic EB1C filers as they do nothing their entire lives (besides their simple "jobs"). They dont work hard in colleges in India, nor here and they get 1st priority through the loophole! They have done NOTHING to deserve that kind of priority. USA created priorities based on which candidates are more deserving based on how smart they are and how hard they work neither of which these folks are. Google the requirements for EB1-A and EB1-B and see for yourself. This EB1C fraud does not violate the letter of the law, but violates the SPIRIT of the law and is detrimental to the United States Economy.

      USCIS needs to wake up and STOP THIS ABUSE.

    1. Not everyone qualifies for EB2 outright, correct? people who qualify easily for EB3 because the paperwork for EB3 and company's justification is not cumbersome. They get approved, now after 5 years, the crooked mind is always working and waitng to hit the 5 year mark so that they can upgrade to EB2, showing the 5 years work experience, isn't this abuse? how is it a natural progression? You can tell they are all recently landed FOBs with GCs. They are ALL EB1-C frauds. They do NOT deserve to be in the same priority class as EB1-A and EB1-B and are using a loophole in the wording to get people GCs in 3 months - 1 year for "project manager" morons. I call EB1-C for what they are, because, I know people working with me here from IIT and PhD's from MIT/Berkeley working their a** off at world class companies who don't get priority and these "international managers" some of whom are friends and cousins of mine, who I know have not done ANYTHING special since school, well, besides the fraudulent EB1-C filing who are getting priority.

      One Proposed Solution Path: If you are EB2-India raise this issue with your companies lawyers. Petitioning congress might go somewhere, but lawyers/law firms have a strong role to play and pressure from many fortune-500 companies' lawyers could correct the issue faster.

      I am trying to help EB2-India as I strongly feel for them, as I once was in the same boat.

      Do you feel USCIS | DHS don't know EB1 misuse? when a country is built on law's, people always find a way to by pass and circumvent the law, this is nothing new and this is exactly what EB3 and EB1 mokfers are doing.

      My life along with the rest of us waiting on EB2 India is almost running out, I did not bother all these years hoping 2010 Dec PD would breeze through, I realize like the rest of us, things will NOT change and there are bigger problems for US Govt to handle than legal immigration focused on EB cat for INDIA

  20. i 485 inventory got released today...can't make sense out of it...the numbers for 2008 keep fluctuating massively. Aug data showed total 1998 , oct data shows 8820. How is it possible ??

    How in the world is this possible when the priority dates for both Eb2 & Eb3 categories have never ever reached 2010 in the last 7 years?!

    3. 2010 numbers flip-flopping makes no logical sense to me..USCIS has always said they will not 'process' a pending I-485 if the priority date is NOT current, still the pending numbers for EB2-I has reduced, how?

May be approaching a larger platform like immigration voice might help. This site has been helpful for few of victims to come together and share various perspective and everyone appreciates Ambals for that.

  24. ANYONE reading this , time to act ! Please send you senator a letter ( via email, call etc) to ensure that while they debate DACA, lets not forget the 1000s of kids as well legal aliens like us who are law abiding and standing in lines for 10+ years. I know a friend who filed in EB2I in Feb 2009, still waiting for the day he will get his green card while his kids are now applying to colleges and having to think about coming back in F1 status or how to legally stay with their parents. This is not how any country should frame its legal immigration laws. Even in Switzerland ( trust me they don't want you there) , if you hold a job for 10 years, you get a C permit ( aka green card).
    so please write and educate senators when they debate DACA. Don't put trust in murthy and any laws firms ( they are there to make money and will loose when legal immigration becomes streamlined).

    If they are in the present immigration situation without green card ,

    First one will always end up in a consultant world and due to the inherited laziness , they don't try anything new . lead a terrible life and fight with their their employer . After the sweet 10 years in US , They expect government to automatically give them permanent residency and citizenship . They come to this forum and curse the authorities and themselves

    second set of people would have been already immigrated to Canada or Australia or Start a business in India

    4. No. You can't apply for EAD with filing date. Filing date is useless for Employment based categories. It is useful only for Family based category. In Sep 2015, when the two dates thing happened, Filing date was going to be used for filing EADs. But then a genius lawyer filed a lawsuit and apparently USCIS got pissed off and filing dates became useless for Employment based categories.

      I am confused now. I was also hoping that the filing date (for EB2-I) will be something to watch for in coming Visa Bulletin. But now you guys are telling me that you cannot apply for EAD even if filing dates becomes "Current". is that true? Any articles related to this? I could not get my head around the fact that filing dates are useless for EB and still every bulletin, I am looking forward for it (from last 3 years now) :(

      This is what it says in every Visa Bulletin above the chart. When you go to USCIS link, they ask you to use Final Action dates instead of Filing Dates for EB.

    1. According to the I-485 numbers we have available, between Dec 08 and May 10, there are about 12000 EB2 India applications are there. With 3000 GCs per year, it will be 4 more years. It will increase if the porting increases.

    1. Yes. The bill based on that introduced as "Securing America's Future Act", proposes to increase EB1, EB2 and EB3 India to 9940 visas for each category each year. But, with the new senate debate, that might change.

    4. We cannot say anything based on I-485 inventory as there is data only till April 2010. By lot of assumptions, we can guess a number. Currently there are no spill overs for EB2 India. So, we get around 3000 Green Cards per year. Assuming there are roughly 9000 applicants per year. Starting at Jan 2008 to come to Jan 2011 -- it will be 9 years (Oct 2026) - assuming porting evens out.

  36. I agree EB1C(filing by Indian firms) is causing further delay for all of us stuck in eb2 and eb3. But this is matter of the law. USCIS law for eb1c seems to be very lousy and have lower requirements than even eb3. Now here is my plan: I have started to write about eb1c to senators. Senator Tom Cotton from Arkansas and Senator Perdue are ideal candidates. They are already working on reducing the green card backlog and other immigration reforms. I have already sent emails to them about how eb1c and its lousy lower requirements are causing major problem to elevate the backlog problem. I would suggest the same. We should spread the word among people in backlog and all of us should write to our senators. In my opinion that is the only way.

    1. At the current rate of PD movement, 2013 will be provisioned in 2035 or later. Only way to get the GC earlier is to effect a legislative change that will remove per country caps.

    1. It is totally depend on the number of people porting. Assuming, zero porting and no spill over, around 3000 GCs has to be given every year. It will be another 2.5 years without any law change.

  40. I have a question , I saw some people responding like "Eb2 may in 30-40 year you will get it , Eb3 oh don't bother you will get it upstairs". Why are you guys responding like that may be I still don't get it but I looked up how long was the processing time for past years and found below , these numbers represent how long it took to process each year. Eb3 has moved to Jan 2007 already. considering 2008 was recession time I think on an average it should take 8 months or max 12 months for each year from 2007 - 2011 and then every thing went down hill from 2012 super high demand of H1 ,GC etc.
    So I feel reaching to 2011 should take max 1 year each so considering that by 2023 they may be processing 2012 application. now this is just all hypothetical but at least its better than saying you will get GC upstairs :) which I have no idea where that calculation is coming from lol

    2001 - 41 months
    2002 - 34 months
    2003 - 21 months
    2004 - 18 months
    2005 - 10 months
    2006 - 8 months

    1. Lot of EB3 applications ported to EB2, that's the reason EB3 has been moving fast. Very soon (in a year or so), both EB2 and EB3 will move at the same pace i.e. current EB2 pace.

  43. @ambals - Is the new H1B 3rd party USCIS rule only for new(first time) H1B applicants?

    I'm now in my 10th year on H1B with 1 company all the while. I planning to move to a larger consulting firm(similar to Accenture, CG, IBM), can anyone pitch your thoughts? The only reason I want to move is for stable contracts, no need to find my own projects in cases of losing a contract.

    Also, can the new company file for H1B extensions based on prior I140 approvals? or should they file for GC PERM/Labor, and I-140 again in-order to get new extensions?

    Please advise anyone, ambals? highly appreciate your inputs. I will also try to consult an attorney, will have to find one first.

    1. any inputs(though non-legal) is highly appreciated. time is off essence for me, legal opinion appointment with murthy law is not until April 7th(apparently due to H1B filings, they do not have appointment with any attorney till April 16th)

      You can go for extensions based on prior I-140 approvals.

  45. According to Jan 2018 I-485 inventory release, there are total 18448 EB2 India pending till May 2010. Ambals, if the current date for EB2 India is 15-Dec-2008, how come so many are pending till Dec 2008 (7557 are 2008 alone)? Does that mean all the numbers prior to Dec 2008 are people who are not applying? Does that mean only the remaining ones for 2009 (8747) and 2010 (1754) are left? Please help to understand.

    1. This implies people who are yet to receive gc's inspite of filing 485. The numbers increase might be family members and those who ported. However I seriously doubt how accurate this data is when the dates which are not current have seen an increase

  46. All bogus data... I see significant adds to 2009 May/June which is not possible as the PD is not current. Also, inventory numbers have changed for every single month all the way through 2010 April.

  47. Your new employer should be able to file H1b transfer/extension based on approved I140 however they will need to file new Labour/Perm and I 140 later in order to continue your GC. You would be able to port your earlier I140 date.

    1. Thank you..can they keep extending the H1B's without filing for GC process with them?

      I plane to go back to the old employer when the PD's are current, and avoid all the paper work, time for GC re-start(labor/I-140), and as we know definite RFE's mainly!

    2. The new employer would have to start your GC. Transfer would work fine but getting extension beyond 3 years might become tricky. Also, when you go back to file your GC with the old employer you might get a query.
