October 2014 Visa Bulletin and analysis


October 2014 Visa Bulletin was released earlier today. 

EB2:

Date for EB2 India stayed at 01 MAY 09. EB2 China moved from 08 OCT 09 to 15 NOV 09. The cut-off for all other EB2 countries are Current.

As expected EB2 India stayed at 01 MAY 09. Good news is EB2 China is moving forward.

If you are waiting to file I-485, please use this opportunity to gather all the documents and keep it in place:

EB3:

Cut-off dates for EB3 India moved from 08 NOV 03 to 15 NOV 03. EB3 Philippines moved from 01 APR 11 to 01 OCT 11. EB3 China jumped from 01 NOV 08 to 01 APT 09. For all other countries the date moved from 01 APR 11 to 01 OCT 11.

Good news is all the countries have dates moved.

I-485 Pending inventory:

I-485 inventory was released earlier.

Current I-485 inventory shows data till 21 JUL 2014. For EB2 India, there are 31,234 pending applications, whose priority is before 01 MAY 2010. For EB3 India, it is 30,018 applicants before 01 SEPT 2007 Priority date. 

What to Expect Next Few Months:

For EB3 India:
I am hoping it will move 2 weeks every Visa Bulletin, at the very least one week.

For EB2 India:
I am hoping the date will remain the same at-least till November Visa Bulletin. But, there are indications in other websites and in the visa bulletin that it might retrogress in November Visa Bulletin. I think it will retrogress to 15 DEC 04.  But it depends on DOS strategy for this new fiscal year that begins in October.

  3. If the new fiscal year begins in Oct, then shouldn't we see the dates move forward in the Nov bulletin since the visa quota for next year should be free ?

    1. For all the categories, yes. But for EB2 India, the porting is more than the monthly available quota of around 250.

    2. No, because India has only 1,700 or so visas allowed by law. Each country has the same number. The reason why India is benefitting from large number of visas is that if the visas are unused by other nationals, USCIS will apply them to India, China, and other backlogged countries. Also, there is some spillover from EB1. But this happens only around May. You should expect dates to begin moving forward only from May 2015.

    Thank you very much for your service. My priority date is 30th June 2008. Ported from EB3 to EB2 in 2012. Applied for I-485, I-765, I-131 when I got current and my reciept notice date is July 03, 2014. Did the biometrics on 7/23 and got another request for biometrics for appearing on 9/2. Walked in early for FP and to get photos taken (some glitch, so they took just photos) on 8/22 as we were going on vacation. With the current trend of EB2 India progerssion, do you think we have a chance to get our Green Card in hand by the end of the year? I have not seen EAD/AP yet.

    1. I think so. Only troubling porting is 9/2 biometrics again. You can call USCIS and check why 9/2 biometrics and how it will affect your GC. Also, you can go enquiry through Congressman/Senator next week or so.

    2. I'm in the same boat. Apparently USCIS had an error in their system and rescheduled those who have already fingerprinted.

      I'm in the same boat....Ported EB3 to EB2 in 2012 with PD 11Aug2008. Filled 485/765/131 on 01July14 FP done 30Jul14 got another app for 03Sep went to ASC and spoke with Sup, she said no need to do 2nd one to confuse USCIS. Still haven't received anything and online status is still the same and not updated from 08Jul14.
      Do you think we have any chance of getting GC this year? Do you think its better to call and check on status.
      Would really appreciate your reply.

  8. Ambals, I got a few questions and hope you could help with this.
    1. I applied i-485(first time filer) on August 1st 2014 and my PD is Dec 2008, I recently completed finger printing as well. If the dates remain same in next VB, do i have any chance to get GC by end of this year?
    2. In case i miss this year, what are my chances for next year.
    3. If i want to change employer, do i need to wait 6 months after i get EAD or does the time counts from the date i filed my 485.

    1. There is a chance you might get next month. If not, mostly July 2015.
      After your I-140 is approved and you received your EAD and if it has been 6 months after I-485 receive date, you can use AC21 to move to same or similar job and keep the priority date.

  9. If visa bulletin retrogresses before I get the notice for fingerprinting, then can I still expect that notice (fingerprinting) to come through anyway, or does that also stop until the PD is current again? .... and if it stops, does it affect EAD/AP processing in any way?

    1. EAD/AP should come in about 75 days after you apply, that should not be affected by dates going back.

    First time filer in July (pd July 16 2008), I'm the primary and applied for 485/765 and my husband applied for 485/765/AP. We both completed our fingerprinting July 28th. There has been no movement on the case status online except last night my EAD shows in card production. Concerned about my husbands application I emailed the lawyer but they don't seem too concerned. I thought mostly the primary and dependent applications are approved together? Any chance of us getting a GC this year and should I be concerned that his applications remain the same status ? Thank you

    2. Regarding your husband's application status online you should not be concerned as your application is approved based on the primary applicant ( your husband ). As you have filed in July, there is a very good chance that you will get GC this year. Good Luck.

    4. Sorry my bad. I thought your husband was the primary applicant. It seems your husband's application was processed too but it's just not showing up as of now on his case status online. It will be updated eventually. You also have an option of calling USCIS directly & ask them about the same by providing your husband's receipt notice information.

    1. unlikely, given the numbers of visas available. This is in the visa bulletin and how they allocate visas.

      "Allocations were made, to the extent possible, in chronological order of reported priority dates, for demand received by September 8th. If not all demand could be satisfied, the category or foreign state in which demand was excessive was deemed oversubscribed. The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date earlier than the cut-off date may be allotted a number"

I already contacted Senator's once last year and agin this year. Is there any possibility I get GC this year before dates get retrogessed.

    1. There are about 5400 folks from nov 2003 to may 2004 according to latest I-485. At 250 visas per month, it will be another 21 months. Hopefully sooner because of porting.

    How does USCIS prioritze cases to process?

    I applied in July, 21st just and did finger printing 3 weeks ago but still no staus update. Seems like dates will retrogress next month.

  19. Dear Ambals - Your blog has been a great source of information while waiting for priority dates to be current. Thanks for the blog.

    A few days back, my spouse and I got our immigrant visas in EB2 at Mumbai Consulate. I plan to enter US in Nov or Dec. My question is if the priority dates retrogress by the time we reenter the US, will it affect issuance of our cards. I think should not but just wanted to confirm with you. Thanks.

    This is a very unfortunate breaking news. As per the news --> the Department of State will make the EB-2 India category unavailable until the end of the fiscal year (September 30, 2014) effective immediately as of today, September 10, 2014. Does that mean they will still process the applications that were received till September 9th 2014 ( end of business day ) ? Your input on this will be appreciated.

    Also is this news official yet ?

      Cases that are filed are either likely to be held for processing on October 1st or will be returned to the applicant.
      Update 9/11/2014. Based on recent experience when DOS made EB-5 China “unavailable”, USCIS is likely to continue accepting I-485 filings but those cases will be held in the Visa Office’s “Pending Demand” file until October 1, 2014. At that time, all eligible cases will be automatically authorized from the “Pending Demand” file under the FY-2015 annual numerical limitation.

      I am first time filer, applied on Sept 12th. Does this mean that my application may be returned ?

      What is EAD/AP got to do with Visa approvals ?

      Do I have a chance to getting EAD/AP atleast and will they issue me a receipt number or I will get it only after October 1st ?

  28. It might be roughly possible to predict who will get their visas this year

    According to the visa bulletin the USCIS allocates a visa priority number approximately based on the applicants priority date. You essentially enter a Que based on your receipt date and PD. Every yr they release a fixed number of GCs depending on spillovers from other categories. Based on these spill over number and the visa priority number, they designate applicants to be eligible for GC.

    Once this is established when exactly you will be approved will not depend on your pd but on when your papers are in order. This is the reason why some people with later priority dates get approved before people with earlier ones. They are within the "approved limit"

    Based on this logic you can tell if your GC will be approved this year or not. If you know a case from jan 09 who has been approved then as long as your papers are in order and your pd is before jan 09 you will get GC this year.

    Tallying this date with the inventory data you can approximately know what was the spillover number this year as well.

    My priority date is June 2007. I filed I 485 and I 140 concurrently on July 1st 2014 at the Texas Service Center. Biometric was done on August 8th, 2014. Is there any chance that I could get my GC before the dates retrogress? Also, Initially I did regular processing for my I 140 but on 09/10 I applied for premium processing for my I 140. Do you think this could enhance my chance of getting the GC this year?

    3. Guys I also got my application submitted for the first time on 2nd Sept. I did recieve the notices for me yesterday. Though last night when I checked for status, the applications were not found online. I dont know what that means.

      My wifes receipt notices came in today. Hopefully you guys should get it today or tomorow.

      Also, Would appreciate a response from Ambals that even with visa numbers expired, do we still get EAD and Advanced Parole approved or they get delayed as well.

      Also, if we get or not the EAD, can we still invoke AC21 after 180 days ?

    I had EB3 priority date in 2008 which has been recently upgraded to EB2 and I-140 approved. However my employer is not going with filing I485 even though my priority date is current since my position has been eliminated as of today. I just got an offer from another company and need to do H1-B transfer.

    I'm curious if there would be any issues with the H1-B transfer (and subsequently in GC filing) since my priority date is current and I've been in the country for more than 6 years. About 4 months back, I had my H1-B extended (till 2017) but didn't get it stamped yet.

    I'll be consulting lawyers, but the advice/input here is too valuable to ignore and looking forward to the guidance or if anyone had any similar experience

    My PD is Jan 2009 in EB2 India category. I answered the RFE for medical records on July 8th, 2014 and I had to move in August to a new address (filed form AR11 electronically). I still haven't received my GC. My colleagues who answered the RFE later and have PD later than me have started getting their GCs.

    Can you advise what could be wrong?

    1. What does your online case status say? You can register in USCIS for case updates. I had a similar issue and they send my GC to the old address (which USPS forwarded to new address). I have been reading that USCIS is bad with updating the new addresses.

Filled 485/765/131 on 01July14 FP done 30Jul14 got another app for 03Sep went to ASC and spoke with Sup, she said no need to do 2nd one to confuse USCIS. Still haven't received anything and online status is still the same and not updated from 08Jul14. 
    Do you think we have any chance of getting GC this year? Do you think its better to call and check on status.

    1. Havent heard of any first time filers getting thier GC. Seems more and more unlikely as days pass by. Hope for the best but make yourself mentally ready for next year

    4. I have seen 2 cases so far. The common thing with these is they filed for 140 and 485 concurrently, dont know if that makes a difference.

    3. Thanks for your quick response, my company decided not to apply the EAD & AP along with 485 due to various reason. But, received the approval from the HR to apply EAD & AP by myself. Completed all required documents, planning to apply EAD & AP by end of this week. I think need to wait for 75 day to get my EAD and AP as per the current trend.

  56. Since GC is for future employment, can someone clarify if there will be any consequences while applying for Citizenship for the below mentioned hypothetical situation?

    Hypothetical Situation:
    Let's say you leave the GC sponsoring company few months before getting the GC and you don't use AC21 at the time of switching jobs. But 6-9months after getting the GC you re-join the same company that sponsored the GC.

  60. EB-2 India - Quota for FY2014 has been reached

     EB-2 India visas are "unavailable" until October 1, 2014.

     USCIS offices will continue to accept and process EB-2 India cases with priority dates earlier than May 1, 2009 during the month of September. However, instead of being acted upon immediately, those cases will be held in the Visa Office's "Pending Demand" file until October 1, 2014, at which time they will be authorized

    EB-2 India - Retrogression is imminent

     For the month of October 2014 the priority date for EB-2 India is May 1, 2009

     Given current demand, Mr. Oppenheim expects the priority date to retrogress significantly, possibly to early 2005 by November 2014

     The main reason for the expected retrogression is the high number of EB-3 to EB-2 upgrades for Indian-born applicants

Since my priority date is old, will they process my6 case any faster than people with priority date later than me but who filed at the same time.

    I had applied for I495/EAD/AP on 08/02/2014. Priority date 01/05/2009. I completed FP on 09/02/2014. Now I received another appointment for Fp. I contacted lawyer, he sent me note received from AILA saying recently USCIS has a problem of issuing FP appointment from old to new system transition. Lawyer confirmed that as notices does not specify any cause for second mo need to attend for second appointment. Please advise. Also what are my chances for GC this year.

    2. Hi, Ambals, as recommended I call USCIS customer care number provided in biometric notice, they are hopeless. They don't have access to the records whether my initial finger prints accepted or not and also they could not confirm that the second notice is a duplicate. Does any one receives a second biometric notice is it required for USCIS to specify reasons on the notice, (in case rejected initial biometrics) I am not sure. For the safe side I would like to attend the second biometrics, please advise.

    3. USCIS was sending duplicate biometrics. It's always safer to go and ensure you don't need it. You can also try and walk in instead of waiting for the biometrics date with a copy of your 1st biometrics stamp

Does it mean they will not be processed at all until next year? My PD is 08/08/08. Applied i485 at TSC on 07/03/2014 as a first time filer.

    I'm still awaiting my EAD (Initial Review) and 485 (Acceptance). Do you think I have some chance getting GC in Oct?

    Or will any of the first time filers will get it in oct?

    2. I believe some will get in October with regular 250 or so visas per month quota. We need to wait and see what plan they have in mind for EB2 India.

  71. Finally got the receipt notices for i485/EAD/AP for EB2I after three weeks. However the i485 receipt says EB3 instead of EB2 when we clearly attached the approved i140 for EB2. How do we handle this now?

The best scenario, China EB2 will be advanced to 2012 May by 2016, if the current movement remains.so certainly EB2 India has high chances to see 2011or early 2012. by 2016..I think China EB2 numbers going to be lower than china EB3 so that it can benefit EB2 India category at some point. This is just my personal view......Ambals can have better word on this..

    past:eb3 2008 i140 appoved, upgraded to eb2 i140 approved.
    present: changed job. eb2 perm approved.

    now, should i file i140 premium with or without concurrent filing. my employer attorney suggesting to file 485 after 140 is approved and date is ported. i think if all goes well it would be mid oct to file for 485. any thoughts, suggestions on best way of handling this. anyone has done concurrent filling with porting before?
