EB2:
Date for EB2 India is 15 NOV 04 and EB2 China is 22 MAY 09. The cut-off for all other EB2 countries are Current.
The good news is EB2 China keeps moving forward, more than a month this time.
No movement for EB2 India. From the recent news from various lawfirm websites, the dates for EB2 India will likely move only in August 2014 Visa Bulletin. EB3:
Cut-off dates for EB3 India is 15 OCT 03 and EB3 Philippines is 01 JAN 08 and EB3 China is 01 OCT 06 and all other countries is 01 APR 11.
Good news here is EB3 India date has moved 2 weeks and EB3 Philippines date has moved 2 months.
EB3 China has retrogressed 6 years. Apparently, there is lot of "downgrade" from EB2 China to EB3 China.
Visa Bulletin says, there has been sudden surge of EB3 applicants. That is why the dates for Mexico, China and Worldwide has been retrogressed.
I-485 Pending inventory:
New I-485 inventory was released in Jan 2014. For EB2 India, there are 31,242 pending applications, whose priority is before 01 MAY 2010. For EB3 India, it is 32,066 applicants before 01 SEPT 2007 Priority date.
There should be another update on the inventory data. We will keep you posted once it comes out.

DeleteMy priority date is Jan 30th 2009. I have already filed for I-465 back in 2012 and received RFE for medical (chest x-ray was not included by the doctor's office)
I have replied to the RFE and sent a new package immediately.

Moving dates in August can leave several people with 2008 PD behind. I have a OCT 08 PD and know that if there's an RFE or something then there's less likelihood of getting through this year. Even without that it is going to be the luck of the draw. 6 years from PD used to be the rule, now it is more like 7 years! Next year with increased ROW usage and no FB visas it will be even worse. Sad state of affairs.

The most retrogressed country will get all the spillover. In this case, till India matches China's date, it will get all EB2 spillover visas. Hence, it is good.

DeleteEven if the PD moves to Jan 08 i doubt it will get approvals for folks after June 07. There is a lot of pending inventory now in EB2 and with the available numbers its likely to be stuck in Jan 08 for 4-5 months. Hence only folks to be happy will be prior to June 07.

My PD is 11-Dec-2003. I was hoping that it will become current before October of this year.
According to the latest inventory, there are approximately 2000 applicants between 15-Oct-03 (June visa bulletin date) and 11-Dec-2003. For that to happen, you need 8 more months from June -- 250 visas per month. But, there are lot of porting happening. We don't the exact number. So, the movement is dependent on that.

DeleteI think in the last 1 month most of the EB3 India folks with PDs through 31Dec2003 have received RFEs. And I think not many in Jan or Feb 2004 got the RFEs. So, isn't that an indication that they would move the dates till 31Dec2003 atleast?
DeletePeople with PD of 2003 or perhaps most of 2004 should stop counting on porting as there are not many folks are going to port since they would like to believe that their EB3 itself will come in a year or two. Most of the porting will happen for cases beyond mid of 2004 PD.

Charles Oppenheim announced that PD will go Jan 2008 on Sep/Oct (end of the year) with 5000 spillovers. In his case, PD wont come even the last year PD (Jun 2008)? In the future, EB1-C will eat everything, there will no spillover, at that the same time EB3 to EB2 porting will increase. So next year, PD wont come even Jan 2008 ? Oh my god, GC become daydream.
Imagine the plight of EB3-I guys from 2004 & 2005.

DeleteYou both can pretty much forget in having GC's as it will be slow killing process. Since, you will be having EAD's, better to look out for a company who will do porting. Porting is the only option left for you both and all others whose priority date is 2005 and above....
DeleteAs Ambal has mentioned it above, 250 visas per month. You should check how many months it will be based on how many applicant are there before you. Unless you have the urgency to get GC & Citizenship, continue with using your EAD otherwise port to EB2
DeleteThere about 17,000 applicants pending in front of you, according to latest I-485 inventory. If it is 250 visas per month we are talking about 68 months. Even if half of them port, it will be another 3 years.

I am in a similar position. However, I don't think just becoming a manager qualifies you for EB1.
DeleteThere is more painful route wherein you could get promoted as manager and spend at least a yer outside the country. You should be able to come back to U.S. on L1 and then file as Multinational company manager under EB1.

Also EAD renewal will take at least 2-3months. So plan ahead of time. Make sure to also apply for Advance Parole along with EAD so you can travel outside the country if needed

The priority date cut-off for EB-2 India could advance by nearly five years, to an early summer 2009 date, by the September Visa Bulletin. EB-2 China is projected to move forward by five weeks per month for the remainder of the fiscal year, but EB-3 China will remain static and could retrogress further if demand does not subside. EB-5 China may become unavailable in August or September, but is expected to become current when FY 2015 begins on October 1.
The nearly five-year surge in India EB-2 availability is due to the application of unused immigrant visas in the EB-1 and EB-2 worldwide categories, according to Charles Oppenheim, the senior State Department official responsible for visa control. EB-3 India is projected to advance slowly, by one week per month, through the end of the current fiscal year. EB-3 China is expected to move forward slowly during FY 2015. Rapid advancement is anticipated for EB-3 Philippines in the last months of the fiscal year, but EB-3 for all other countries is expected to hold at current cut-off dates.
What This Means for Employers and Foreign Nationals
Now would be a good time for employers and their immigration counsel to carefully review the priority dates for Indian employees with approved I-140 petitions but who have been unable to pursue adjustment of status applications due to retrogression. As we have seen in the past, there may only be a small window of time when before the EB-2 cut-off dates again move backwards. In addition, many long-pending adjustment applications may be approved during this surge.
The exact cut-off date will not be known until the State Department releases a Visa Bulletin announcing the advancement. The Bulletin is usually issued about three weeks before the month to which it applies.
When their priority dates become current, adjustment applicants with pending cases may need to provide supplemental documentation so that U.S. Citizenship and Immigration Services can finalize their cases. Applicants could be asked to provide updated job letters from their employer-sponsors and may need to attend another biometrics appointment so that new fingerprints can be taken. Updated medical certificates may also be required.
Now they are in-line with our predictions :)

I recently got RFE (in April) for EVL, Proof of Continuous Validity of Employement Status, Medical
I sent the RFE response and the case status changed to "RFE Response Review"
I am with the same employer who filed by Labor 11yrs back. And in the EVL letter they have responded that the GC position is still there, etc, etc.
Now, if I get a good offer from another company, it is safe to switch now? I understand that switiching before getting GC is better than switching immediately after getting GC. But my situation is that the new Job may be completely different than what was stated in my GC. So, I don't intend to file AC21. so, if I don't intend to file AC21, is it safe to switch now....given the fact that the current petitioning employer has already responded to the RFE EVL request that the position still exists?

I am confused coz by the time I make the move file AC21, my priority date becomes current, I dont want to unncessarily delay gc.. or affect it anyway.

DeleteAssuming you and I get our cards this September, unless there are unbearable work conditions at your current workplace, my advice would be to stick for a few more months.
A lawyer on Murthy.com had told me that I would have to stick for 6 months to a year with my current company once I got my GC to avoid any questions in future.

It might become current in late 2015. For other questions, it is best to consult an immgration lawyer.

EB-2 India is anticipated to advance significantly around September. Initially, the priority date was expected to advance to appx. Jan. 2008, but new estimates anticipate priority dates to advance to 2009.

DeleteThis reply from Fragomen doesn't mean dates will move only in Sept bulletin. Dates will move to 2009 by September bulletin. DOS/USCIS cannot make such a huge jump in one month and process all the requests. They will have to do it in phases in July, August and September bulletins.

DeleteI don't think june 1st is officallly early summer. Early summer starts June 20th until August 5th.

2. I will be in India in aug for vacation. If my aos is approved while I am gone, will I have trouble coming back on B11 visa (I dont have ead/ap)

ReplyDeleteMy PD is May 2008. I moved from EB3 to EB2 and filed my new perm application in September 2013. Unfortunately, I got an RFE on it , this May. How much time would it take to get my perm approved in this situation? Is there any chance that I will get EAD this year or do you think the dates will retrogress before I get my EAD?

ReplyDeleteI would appreciate some guidance here. I work at Big 4 accounting firm who is filing my green card papers, however, they have asked me to obtain an experience verification letter from my previous employer - another Big 4 accounting firm. I am not sure if my previous firm will provide me such a letter mostly because they were not happy that I left them for a competitor. Could someone please let me know what my alternatives are? I may be able to find a coworker from the previous firm who works at another company write a letter for me. I also have a friend that I made at a client who is willing to help me. Will a letter from a client contact and a coworker (both work at new companies now) suffice? Also, will the letters have to be on official letterhead?
Appreciate your help with this!
