you are already current unless you meant to say your PD is NOV 2008. When and at what point your application will be picked up by USCIS is anybody guess. There isn't a definite pattern or timeline.

DeleteIts annoying when you see 90% of the post here asking the same question "when my PD will become current". If we avoid those posts then nothing will be there to read. I agree with Neel here that no one knows so just keep watching and be prepared when it comes close to your PD. I dont think anyone here is to make fun to others and definately not here to insult. I personally think predictions does not do any good and in most cases it is being proved wrong. No matter how much you say that this is only prediction but lot of people (including me) will take that as "carved date" and when it does not come true then it shatters our hearts. Anyways my point is that I like to see some valuable information from these posts. May be updates on immigration bill, overall GC process, perms updates. There are so many things we can talk about and educate people from this post which will increase the value of this site.

Deleteonly missing information is we don't know how many new I485 applications are getting filed for dates earlier than current PD.
for example last year EB2 India got ~23000 visa but pending I485 inventory didn't decrease by that number, in fact it decreased by ~12000 and EB2 india still has ~20000 pending cases. pending EB3 India decreased by 5000. I am guessing half of that have gone to EB3--> EB2 porting. that leaves ~9500 new I485 filing for EB2 india with PD between aug2007 to april2009.
according to comments from Charles Oppenheimer EB2 India will move 6-8 months in next bulletin. and after that slowdown 3-6 months movement. looking at pending inventory it makes sense as EB2 india has more than 1000 pending cases per month from may2009.
also we have not seen current PD earlier than may2009 since 2012. I assume we will see more new filing in EB2 india with PD after may2009 (these are the people who missed in 2012).
it also depends on how many visa numbers we get this year as explained by Ambal earlier.
another thing to note is that EB2 india may not have large pending inventory after 2015 and EB2 india may move forward in early 2016 to create pending inventory by end of 2016.
as you can see there are more unknown variables than equations. all depends on assumption and what USCIS has in mind.
I hope it helps people to understand it and stop asking questions like when will my date become current.

My PD is Jun 26 2009. I have EAD/AP since 2012 and I am waiting on the GC. Am I included in the 21,082 pending application.
What you gonna do with "GC"? You are not going to switch the Job from IT to McDonalds, Do you? EAD ka bhi apna maja hai, Maje lo.. apne paas toh woh bhi nahi... Just playing with you ... You should be current by July VB...

DeleteBased on the forward movement, USCIS is trying to balance the workload on its staff which typically occurs from July to October as dates become current. While new I-485s are filed, EB3 to EB2 conversions & interfiling also happens a lot.
ReplyDeleteSince EB3 ROW is almost becoming current, this means a lot EB3 porting from (July-Aug 2007 fiasco) is completed, although many cases still will be converted this year.
For this year, we have June, July, Aug, Sep visa bulletins remaining before the fiscal year is closed. Thats where "typically" dates stall and even retrogress. Assuming 4-5 month average movement, we can expect EB2 PD dates to end up as Dec 2009 or so by Sep.
The problem is being current doesnt mean immediate GC. The process of RFE, interfile, etc takes 2 months or so and many people who become current in last months of fiscal year (Sep-Nov), see dates retrogressed and have to wait until next summer to get GCs.
I think people with EB2 PD of Oct 2009 (+/- 2 months) will get GC this year.
All others have to wait next year.

DeleteI agree with your analysis, i commented something similar on Ambal's last blog, What i think is if we get a great Spillover, it may cover upto FEB 2010 PD's (Here i mean GC)... Question is when they will move dates to start building inventory and how far they will move. Like after May 2010 can it move to Dec 2011 (1.5 Years)... I will be really happy to know the Funda of Building Inventory and how it works. If they move dates to build inventory people will get EAD atleast and i will be really happy if i get EAD.

No EAD for 2011 if Perm goes down will be around 2018 and if no executive action then. Completing 2008 and Prior will be for this year and EAD for ppl until August 2009 priority Date. and Getting GC for complete 2009 is 2016 and 2017 with EAD for 2010 priority dates next year and year after so I would guess your dates will be current only around July 2018 with EAD and getting GC in hand around early 2019.

yeah, based on the past two years, the SO to EB2 from various stream roughly total up to 14-16k. However, demand and porting activity has been high this year. Hence, the forward movement of dates will be much less than in the previous years probably reaching july/Aug 2009 at Best.

• EB4 took only 8287 of possible 9940 visas hence if the demand remains unchanged the unused 1653 visas from EB4 should spill over to EB2 India making total of16,149 visas available to India.

DeleteCalculate this OTHER way, to clear the current i485 pending inventory, India needs approx 18K spillover from today. Which is highly anticipated that we get a huge spillover and inventory will be clear which is on paper right now. Only thing you, me and even USCIS do not know, number of applications after 1May2010. To understand the volume they have to create inventory and then dates will move. I think after August VB we see some Date Movements. Obama EO may help us to get AOS without waiting :), feeling lucky ...
Need help and i would appreciate a reply. My priority date is April 2009 and I got EAD on Jan 1st this year. The EAD is valid till the year end. I am hopeful that my date will become current on 1st July and I will get a Green Card before July end. My question is what will happen if I loose my job before my priority date becomes current. Also please help me understand how did eb2 get 49,000 visa numbers when only 40k is allowable limit.
If we get around 20k spillovers it will surely move to dec 09.

Without any spillover EB3 should have received 2800 visa (7% of 40,000) as per country quota. This means EB3 to EB2 India porting can’t be more than 1794 for the last year. Anyone disagrees?

They do however show up as new Eb2 I485 filings in the EB2 inventory and take up the mysterious 13K visa numbers.
and yes, there will be a few EB2's who missed their chance when dates were current, and are filing in 2014, but i doubt those numbers will be as high as 13k per year.

Agree, but it is hard to believe that while porting from EB3I to EB2I from an inventory of 32066 (up to Sept 2007) is only 1794, that next 19 months (Sept 07 to April 09) it was 12K. I guess it is possible, since the inventory data up to Sept 2007 represents those who can’t port to EB2 (since most of the eligible has already ported to EB2)

DeleteFor porters fromSep07 to April09,there isnt anything much to lose, and application getting rejected is a small price to pay for a chance at swift EAD/GC,rather than wait decades.
Hence the *huge* numbers in the next 19 months.
Also i checked the 2013 years porting trend- it was around 5K for Sept07 to April09.
I think it was because a lot of eb3 porters held off porting due to hopes of immigration reform, and since nothing happened on that, 2014 saw almost 12K porters.
This year, the trend may be similar. Here is the ballpark:
20K Inventory+ 10porting eb2 to eb3+ 3K new eb2 filings=33K inventory as of Sep 2015
If we have a spillover of 16K, there will still be around 17k left in Oct 2014 Eb2 I 485 inventory.
Hopefully, they will move the dates, beyond Dec 2010 to allow new Eb2 filings a chance to join the queue.

it will become current in July bulletin. you may not get green card this year but EAD/AP for sure if you don't already have one.

ReplyDeletewhy confusion ? If you current employer is not going to kill you in next 1 or 2 years, STAY in the current job until you get GC. If you are not HAPPY/not happy with PAY still STAY with current employer until you see the green land.

DeleteI hope your sure get EAD by 2016. Switching companies good for higher salary but some kind of hectics like H1 stamping, POE, H1 Amendments. If i would you keep with the same company. New labor filing also consume the time. My advice is check with some attorney and discuss with your friends then take decision

With an I-140 approved for more than 180 days, you should be able to changes employers (AC21 portability, right) as long as the new job classification matches the LC. Confirm with your attorney or other sources...

change it if its good offer, since your PD is 2013. it will take couple of years to become current.. so if you move now, by the time PD is current for your case, your 140 will be re approved from new employer.

Deleteif you are in 2011 Feb, EB2-I, then I will suggest you to stay with your consultant for another 1-2 years more.
There will be lights at the end of the tunnel.
If you change now ( after waiting 4 years already), you have to start your GC process again and by the time you get your I-140 approved to have old priority date, it will be another 1-2 years, some headaches, RFEs etc.

MY pd is Mar 2011 ..when i changed company during Mar 2012 people said it is a bad move.. as I have approved i-140 .. I did change and recently got another approved i-140 .. Now I am again moving to another company .. will start all over again .. I know the risk involved but I dont want to feel exploited or sad that I missed opportunities..when you miss opportunity it is very tough to come back.. So make a move accordingly..Atleast you will have 3 years in hand as an extension and can apply.. all the best .. with greater risk comes greater rewards too ..There is not always only a loser thing associated ..if that is the case then there will be no business started :) ..

ReplyDeleteEB2 : so pattern is six month increment for every bulletin release. so it will be april 2009 , oct 2009 and possibly feb-march 2010 for next three release and then retrogress.
ReplyDeleteWhy Retrogress Baba? Do you know the funda of Retrogress? If it reaches to Feb/March 2010 it means they will be left with 2 months of Inventory to clear out in FY 2016... and here Feb/March 2010 PD's will get GC as they have EAD's. So, if that happens it will not retrogress they have to move dates ahead to know the exact number of applications (Demand) to plan ahead. I think they create between 25k to 40k of inventory by moving dates so that folks can apply for i485...

ReplyDeleteHow do you know? I think it will move till Aug Bulletin upto June/July of 2009 and the last (Sep VB) will have some spillover to cover entire 2009 or Feb 2010. Desperately waiting for the Dates to move to build Inventory of 40k which may give EAD's upto mid 2012 PD's... (I wish my predictions come true).
