August Visa Bulletin was released earlier this month. The EB2 India dates for getting Green Card stands at 15 NOV 04. The EB3 India date is at 08 NOV 04. New Cut-off dates are introduced for EB1 China and India and that date is 01 JAN 10.
Estimated 140,300 Green Cards (immigrant visas) are expected to be given this fiscal year -- between 1 October 2015 and 30 September 2016 -- under Employment Based Green Card category.
The number of Green Cards issued under EB2 India category is as follows:
FY 2015 - 7,235
FY 2014 - 23,527
FY 2013 - 17,193
FY 2012 - 19,726
FY 2011 - 23,997
FY 2010 - 19,961
FY 2009 - 10,106
FY 2008 - 14,806
EB2 India receives 2,809 immigrant visas (Green Cards) every year. On the top of it, it receives spill over from EB1, EB4, EB5 and EB2 - ROW. Typically, unused numbers from EB4 and EB5 go to EB1. Unused numbers from EB1 goes to EB2. In EB2, all the spillover go to most retrogressed country (India in this case) till it reaches the next retrogressed (China in this case).
This year, by the very fact that, DOS has established a cut-off for EB1 India and EB1 China, tell us that EB4, EB5 and EB1 will not come to EB2. We also see from I-485 inventory that there is more demand for EB2 from other countries and more porting happening from EB3 India to EB2 India.
Given all this, it makes me wonder, if we are in a new phase for EB2 India. The spillover reducing on one side and porting from EB3 to EB2 increasing on the other side, makes it nearly impossible for the dates to move forward. In theory, all the 18,000+ EB3 India applicants can port to EB2 India. In theory, all available visas for EB2 India can be consumed by porting. In Practice, if this happens, then EB2 India dates can't move much further and, EB3 and EB2 India dates have to move hand-in-hand. Not a good situation, but it might be the reality ! We have to wait and watch to see if it is !

Great Petition. Please sign the petition and join the FB group. That's the least we can do to get heard or to have some visibility. When Mexicans can get their right (though being illegal immigrants) we surely can get ours if we get our voices heard.
DeleteThis comparison with another community was uncalled for and spreads negativity. can't we just state an idea without comparing?
DeleteSelf-advertising doesn't help a cause. And in virtual world no one may care also. One's achievement can be helpful while boasting face to face. Here personal details and resume don't help.
Deletesigned. I sign such petitions every year. That's the least we can do and encourage everyone to write letters to white house. Letters have a invisible way of working their hand. We deserve the right to be heard and as skilled immigrants waiting in line, we are in our legal right for a due process and ask such questions. I am in EB2, June 2009 with 2 MS degrees from top schools. Here since 2002.
ReplyDeleteI totally agree, do the best we can and don't leave any chance which can help us. I am in same boat EB2 Oct (not porter), been here with Master degree since 2003, and even missed getting EAD when dates were current my company was going through acquisition. Its frustrating and hope there would be some reform.
Deletehow does your 2 MS degrees help? lol, no one cares Rampy sri..And what what you doing since 2002?!
DeleteThis shows how we need to avoid foolish folks from getting Greened!
hey Anonymous, forgot to take your medicine today? Go and be mental somewhere else. People here are already suffering
DeleteRampy Sri, lol 2 MS degrees, wait for it..FROM TOP SCHOOLS
DeleteI am here supporting Indians. Having two MS degrees is actually a big benefit to me. I work at a top bank at a Sr. level. I have changed by job 4 times at top firms who redid the PERM for me. I hope you get my point ( and no, I am not in IT which many of you will stereotype). I am here supporting India and few folks like me will do so even after we get our GC ( if I am still in US ). The immigration law is this country is flawed. My employers never put a country cap on skill. They look for the best talent. Similarly, we Indians work in top jobs but a guy from country "X" with a mediocre job gets a GC approved in 6 months under EB3. Write a letter, support petitions and try talking to Indians who have the political connections in your communities. It’s about raising a voice while you are here for something which is biased and unconstitutional against skilled Indians living here. Some of you may tell me to go back. To that I say, that’s none of your business where I choose to stay. Learn from what Mark Zuckerberg's immigration movement had achieved. Obama , was able to give H4 spouses EAD. That’s a big win and we need to keep fighting for more reforms like that.

Petitions are the only way out. Because Obama is refreshing his browser and checking every 5 minutes looking for a petition. Oh I forgot he passed an executive order for i140 EAD in Nov 2014, by looking at the white house petition. And the DHS is going to soon give us EADs.
ReplyDeletePlease give me a break.
Is there anything else you can do.. oh forgot you can be a typical Desi and try and pull down doers, back down into the basket.
DeleteNeither do we Indians have vote base like Mexicans, neither do we have enough senates.
What do we do ...yes at least sign a 2 min petition.
A therapist can help to eradicate such negativism. Bashing doesn't help. Hope this realization comes someday. Good luck!

DeleteImmigration is political football. The status quo helps all sides. One side ratchets up the fear, the other side gives false hope. Seriously though, if immigration were reformed, which side does it help? It helps you and me but it doesn't help lobbyists, politicians, think tanks. A hot issue as long as it is alive helps pay the bills of all those people. It is in their interest to keep it burning forever. Tell your citizen friends to vote for the candidate this November who will at least maintain the status quo.

DeleteEver watched The House of Cards? It is worse in reality, the guy above summarizes some good points, good job bruh.
What US DOS will argue is that, they are giving the max Green Cards to INDIA, it does not matter what category it came from, INDIA receives the MAXIMUM GC's every single year. If I were a US Citizen, it completely makes sense why GC's for EB's Categories should be slowed down even further.
Desi companies applied GC's left and right in the last 12 years, why? even if you argue that, USCIS should have not accepted the forms at all to begin with, they are within their legal boundaries to review and accept the PERM and 1-140 applications, can't blame them there and ton's of money in the making from those applications.
my PD is somewhere in Jan 2011, like DOS want's, I plan to vacate my seat here in the US sometime soon and head back home where I always belonged, agreed have to change GAS cylinders, live without power for a few days, I love all that.
Being an Indian, I seriously have come to hate Desi's now employed in CVS and Walgreens. We appreciate American values and Customer Service, I seriously don't want desi's to infiltrate American labor jobs. That ruins the very essence of AMERICA. I know many agree with my point of view, some don't. Listen to your conscience.
Not sure if u implied pharmacy unit or front desk at walgreens or cvs. Pharmacy requires specialization and not too many Americans don't go for degree which is the reason why we are seeing more foreigners in those pharmacy unit. I don't know if cvs and wg can be franchised. If it is desis/gujaratis might have entered that market
DeleteThe USCIS policy of keeping the same priority dates for Porting is the biggest blunder of all. Unless that undergoes some massive change - EB2 has no hope. Or some other category between EB2 and EB1 should be formalized where original EB2 applicants waiting for some threshold of years would qualify. Very sad!!
ReplyDeleteGuys any prediction for August 2009 priority date for EB2 category.
ReplyDeleteMy guess is 2022. There are about 10000 before you and if 4000 port in between its 6 years. Without porting another 3 to 4 years which is unlikely. Similarly eb3 may reach mid 2006 in about 3 to 4 years without porting. There are about 8000 eb3 before 2006 majority in 2004 might have. Remaining eb3i 6000 in 2.5 years is likely. Again those who are porting may help eb3 move much faster and some may even move from eb2 to eb3. Lack of real numbers in 2008 or 2009 eb3 makes it hard to predict

ReplyDeleteI sincerely hope things are resolved and law makers understand the real issues involved.
I work as a consultant in Citi Group and I'm tortured every day for months by this Indian Manager, I'm told to eat lunch at desk and cannot leave, literally working for 11 hrs a day including nights.
No amount of request, persuasion or escalation to the higher managers have any change.
Being tied to one employer with no portability a family to take care off, my life is nothing short of a nightmare right now.
I'm laughing at my problems none the less, I know what goes around comes around..Karma?
Good luck, thanks for reading up post!

You should change your job if you are not happy with it.
DeleteAbsolutely!, in the process now as I type..
DeleteNevertheless, how many amendment's will anyone go through? Not to be negative, there is absolutely limited opportunities for Corp to Corp contracts on H1B..
Well anyways..
If you think it might take a year for your PD to become current its better to go to a new job and get new PERM. Just do that in a legit companies and they will take care.
DeleteUnfortunately Desi consulting managers are more parents than managers. They just micromanage like their reports are their kids. I have seen this over and over happening to people. I advise my friends (when asked)about change of job is don't get a Desi manager. Even if you do find someone who has studied in the US or brought up in the US. Life will be way better. I'm not saying everyone is like that but a majority of them are jerks , especially those who come directly from India and who are not exposed to the western style of mgmt.
Well Said my friend
DeleteIt's the same story everywhere!!

ReplyDeleteI agree 100%

ReplyDeleteI worked under desi manager's only twice, Citi was the worst.
Prior Manager at Wells was a gem of a person(though desi).
The way I think, do good things, you don't have to worry about anything...Yesterday was my last day at work consulting for Citi, let's see what next.
With new VB releasing today, EB3 India goes to Feb 2015. Without pending inventory, THE WILD guess is if no porting is involved it will move by a month or two (April 2015) at the end of Sep 2017. If some porting happens in EB3 for years 2005 then the dates may even reach 2006. EB2I is complex and is at mercy of porters. Without porting it may reach end of 2008 by September 2017 but we all know porting will happen. Even if 1500 with PD before 2008 port it may not cross 2006 by Sep 2017. Most likely situation EB3 and EB2 will go hand in hand for few years to come and EB3 has a chance to do better than EB2.
ReplyDeleteAny actions on this Petition ?
ReplyDeletehttps://petitions.whitehouse.gov/petition/no-respite-highly-skilled-americans-waiting-need-portable-work-authorization-recapture-500k-green-cards
I could not find discussion on the petition even though more than 100000 signs collected before time Vs. petition about OPT which was discussed many times on immigration-law.com, murthy.com and elsewhere.
ReplyDeleteBut everyone knows that more than 100000 people are affected due to current situation. It seems now on India EB2 and EB3 will roll at same pace. But I think we should keep on producing this type of petition with these many signs until that heard.
Do you guys READ? it clearly says that "The White House" will respond back within 60 DAYS.
ReplyDeleteSo, do your due diligence and stop being spoon fed.
Read properly. The post talks about other websites not the government. if you find news about the petition on other websites then copy-paste url here.
DeleteI spoke to a US Senator's Office case worker who handles immigration issues.
ReplyDeleteFrom what she tells me, there is no way that the massive backlog for employment immigration be resolved in the immediate future, per her the timeline is >10years.
The reasons they site is, lack of confidence motion, that there isn't enough interest by the members of congress to make a case.
There isn't enough labor to handle such massive backlog's
There isn't a concrete effort to mandate a debate on making it a law, just to get a law drafted would potentially take minimum 3 years and there upon debates for pro's and con's would be taken up on the floor, that takes nearly a few months depending on the strength/importance.
She was brutally honest and said they receive several such requests throughout the year inquiring on employment base immigration movement.
So, I think we know most of what she covers. I don't think it is logical to sit and wait here for another 10 years, which would be morally and mentally dangerous.
Also, the companies are quickly enforcing strict rules around limiting working with 3rd party contracts.
i was happy living in denial , but you made a very valid point.. thx for revealing this info. indeed its morally wrong to live here and be in denial.
DeleteIt's a terrible immigration system.
DeleteWe should put pressure on the EAD for I-140 holder rule. That doesn't need congress to pass any law. The current rule only allows for spouses of I-140 holders to get EAD. Any Indian here on I-140 with say 2 years on EB1/2 or 3, should be allowed a basic right to change job in similar fields and travel to home country without the need for visa stamping and PERM re-approvals. It’s very unfortunate how legal Indians are being treated like third grade people here by a completely political and biased immigration system. Trust me; law firms like Murthy are not our voice. They want this to never end as there livelihood depends upon this.
ReplyDeleteI think we all should send a letter (separate letter by everyone) to president. Imagine how many letters he/she would receive regarding same issue. One fine day he/she will read it and would know how terrible their immigration system is....
DeleteTill a couple of years back EB1 was like premium airport security. So the great liers ... sorry Lawyers (remember those QA managers and other senior executives from great service companies from whom you pocketed big fees by applying EB1), took to that task and filled up that line and choked EB2. Now with greater help EB3 porting , EB2 is further choked.
ReplyDeleteFast forward a few years. Folks with adult US children will start choking the family visas queue. Assuming nothing is done to this immigration system Indians and Chinese will completely inundate every queue and predicting VB will be the easiest job. It will move 2 weeks for every single category throughout the fiscal year ...
Thanks to lawyers, consulting companies and politics for this deadlock.

ReplyDelete1. Do for undocumnted
2. Do for DACA, DAPA
3. Do for illegals
and all of the above should have path to citizenship

2. Trump:-
Increase H1B minimum salary
Re-evaluate all GC holder's application
Tight scrutiny on legal immigration
Stop refugee and illegals
3. FWD.us
same as Hillary
which one do u think is better ?
And the loop is :-
Delete1. Republicans :-
First do anything needed for legal employment based immigration and then we will talk about DACA/DAPA/Illegals/Undocumented etc.
Also there should be no path to citizenship for DACA/DAPA/Illegals/Undocumented
2. Democrats:-
First do for DACA/DAPA/Illegals/Undocumented with path to citizenship
and then we will talk about legals
and the same debate continues

ReplyDeleteREQUEST TO THE COMMUNITY - ENDING EB-1C FRAUD/ABUSE
ReplyDeleteI wanted to write to the community for help in decreasing EB1-C fraud. As you know, this has MAJORLY impacted EB-2I and led to SEVERE retrogression. This is due to a handful of companies violating namely CTS, TCS, Infosys and a few others.
For EB1-C, no doubt there are genuine petitions for high level managers/executives by the above mentioned companies and that is ok. My point is that a large percentage of people applying for EB1-C are just programmers and engineers and not high level Managers. Therein lies the abuse.
I would therefore request folks who are impacted by the severe EB-2I retrogression to write about the EB-1C abuse to the: USCIS - OFFICE OF INSPECTOR GENERAL - HOMELAND SECURITY. They specifically investigate any visa related fraud perpetuated by Indian Outsourcing Companies.
IF HUNDREDS OF LETTERS/EMAILS ARE SENT TO THEM THEY WILL DEFINITELY INVESTIGATE.
Here is the result of their investigation to stop L-1 Fraud in India
START
A Best Practice: Consular Team
India Consolidates Blanket L-1 Cases
In December 2011, Department of State (DOS) visa posts in India
centralized blanket L-1 petition processing in Chennai. Posts in India
process the most L-1 visas in the world, with 37 percent of total visas
worldwide in FY 2011. Almost 90 perc
ent of these petitions were for
blanket L-1 visas. According to Consular Team India, “India is the only
country in the world where companies have built a business model
dependent on using blanket L-1s to send large numbers of personnel to
the United States who would otherwise require H-1Bs.” Consolidation
was implemented at the recommendation of the DOS Office of
Inspector General, urging more supervision, consistency, and
centralization of visa operations in India.
Prior to consolidation, L-1 visa standards lacked uniformity.
Inconsistencies among posts and the complexity of this visa category
created fairness issues; petitioning companies noted different outcomes
for their employees with similar circumstances.
Immediately following consolidation, Chennai started to see positive
results in its adjudicative process. Consular officers in Chennai handled
more cases and became more confident and expert. As a result, the
number of unqualified applicants has decreased and fraud indicators
have declined.
END
Please email/write letters to the USCIS INSPECTOR GENERAL regarding EB1-C fraud so that they can tighten the screws against violators like CTS and Infosys. In your letter/Emails, name these specific IT outsourcing companies that are perpetuating this fraud.
Here are Important Links for the contact of USCIS INSPECTOR GENERAL. Website shows the details of investigations done over the past few years:
https://www.oig.dhs.gov/index.php?option=com_content&view=article&id=20&Itemid=47

India Consolidates Blanket L-1 Cases)
https://www.oig.dhs.gov/assets/Mgmt/2013/OIG_13-107_Aug13.pdf
If they are able to stop EB-1C abuse and only let genuine folks apply for EB-1C (as mentioned above by me) this will definitely decrease severe retrogression of EB-2I.
https://www.oig.dhs.gov/index.php?option=com_content&view=article&id=91&Itemid=62
DeleteThis is having details of address/emails to report EB1-C abuse.
Let's report enmass.
https://www.oig.dhs.gov/hotline/hotline.php
Deletehttps://www.oig.dhs.gov/hotline/hotline.php
DeleteLet's report the CTS fraud.
To report the case you need to have some thing in hand. Do you know anyone who benefited with EB1C in past, if yes then report it. We should not mention actual person name but case # should be fine.
DeleteThanks for your thoughts. However, it would NOT be correct to mention an individual person or case number. Intention is not to penalize people who have already received the greencard, but rather stop Indian Outsourcing companies from carrying out this abuse in the FUTURE. Here is a suggested letter.
DeleteTo The Inspector General, DHS
Dear Sir/Maam,
I would like to bring to your notice the widespread abuse regarding the EB-1C visa being perpetuated by Indian IT outsourcing companies like Cognizant, Tata Consulting Services, Infosys, Wipro and others. The EB-1C visa is meant for really high level managers/executives who manage 20-30+ people. However even lower level employees who are not managers (e.g. engineers/programmers) from the above mentioned companies are misusing and abusing the EB-1C process to obtain permanent residency greencards, which is a violation of the provisions of the laws governing EB-1C.
I would appreciate if your department can hold an investigation in these practices of the IT outsourcing companies (Cognizant, Tata Consulting Services, Infosys, Wipro and others) as they are violating the EB-1C provisions and letting NON-MANAGERS (e.g. engineers/programmers)obtain their permanent residency greencards via the EB-1C process which is an abuse of the law and its provisions.
Yours Sincerely,
..................
Your verbiage/script is going to hurt more than offer any help to any of us.
DeleteYou should NOT say engineers/programmers it will sound like talented individuals and OMB/Agencies would think "why NOT let them have GC's?" since real engineers/programmers are of shortage in the USA.
The so called .net/java guys are below par in US today ( you know who you are), they call themselves Senior Soft Engineers, laughable!
Sure, if you want to modify the above letter and post it here please feel free so that we can use it and post to the Agency. Thanks.
Deletepost this in trackkit , FB etc. It wont get much visibility here. Add to these companies like American express which are also doing EB1-C for 26 year fresh grads they hire in Gurgaon and then bring them over here at 70k under EB1C in less than 2 years. EB1C is 12k now and each year is going up due to such abuse even by well established MNCs which are sourcing cheap labor.
ReplyDeleteI see your point. Maybe then replace "engineers/programmers" in above letter with "project co-ordinators/project liaisons"
ReplyDeleteMay be consider some verbiage from here
ReplyDeletehttp://www.petition2congress.com/6398/stop-eb1-c-abuse-fraudulent-filing/
Infact even referencing this to tell that no action has been taken and those Blanket petitioners wont stop until they export every single soul out of the country.
Did you guys see this on Oh Law? What does this mean? Anyone care to interpret please
ReplyDeleteUSCIS "May" Consider Using "Filing Date Chart" in October 2016?
Wow, according to the AILA, at one of the AILA conference in 2016, a USCIS official stated that the USCIS "may" consider using "Filing Date" chart for the purpose of filing of new I-485 applications in October 2016. Caveat: Reportedly this was neither a prediction nor decision of the USCIS. Accordingly, there is no guarantee that, even though the State Department's Visa Bulletin moves ahead for a limited period of time, the USCIS may accept large number of I-485 applications based on the "Filing Date" chart in October, if and only if this information turns into a reality. Dream on, the prospective I-485 filers in October!
Question then remains in October Visa Bulletin, how much the cut-off dates for employment-based "filing date" charts will move ahead. In September, the date for India EB-2 is 07/01/2009. Obviously, this cutoff day may also move forward. We will thus have to watch carefully filing dates in the Visa Bulletin as well.

DeleteMost of EB2s and EB3s before 2008 have all got their EAD's and some GC's! it must move at least to somewhere in 2011 or 12 to make any difference to the backlog. Waiting over 13 years here on EB2..PD 2010.
Not exactly exciting news bro..
DeleteLook at the date, the movement is not significant
iS uscis not honoring the filing date? It seems it has retrogressed by 3 months 22nd April 2009. I have a friend who has a priority date of 2008 but has been told he cannot apply for EAD.
DeleteGuys what do you do to renew your license because I94 will expire in few days but extension has not been approved yet even filling before 5 months?
ReplyDeleteyou get a 9 month/one year license based on your pending application
DeleteWhich State? generally varies with DMVs across the nation but for the majority you would just have to wait until you get your approval letter. Sorry!
DeleteIn Virginia!!!
DeleteEven with an approval letter it took me 3 weeks (after verification with USCIS) to renew my license in Virginia!
DeleteNot sure when we would be able to live the life peacefully with this kind of immigration system.
DeleteAre you in California? If you are in California, expedite the "Assembly Bill AB 60" policy.
ReplyDeleteLink : https://www.dmv.ca.gov/portal/dmv/detail/ab60
Texas won't give without approval & update in their system
ReplyDeleteMurthy's expecting 4 month movement for EB2 india for every month's bulletin. Movement in which direction they didn't specify :D
ReplyDeletewell the bottom line is will it ever cross july 2009 ? any movements before july 2009 is irrelevant and for entertainment purpose only :-)
DeleteBased on the green card availability trend, I think we should switch the topics in this forum. No more talking about US Green Card, lets talk about the ways to immigrate to Canada or Australia or Germany or other good countries. What do you say?
ReplyDeletetotally agree...I wasted my time and life here. I started canada process in 2011 but then got hopefull that my PD date of Jun 2009 EB2I will become current someday. I never completed my Canada PR. Today i would have a citizen and taking vacations with my Canadian passport. Here, I to continue living the american dream. BTW..I heard Canada now is a 6 year rule for getting citizenship and Australia has stopped giving citizenship as well ? Also your comp can be hard to match. 200k+ jobs are hard to get in Canada. Any thoughts/comments ?
DeleteSalary is based on your capability. 200K jobs are very easy to get in Canada.. Don't worry about that. Even janitors in Canada makes $250K+(in 5 to 7 years).
Deletewow janitors making 250k+. In Queens JFK,i heard janitor salary is 60k only. Why are janitors cleaning your @#$ here ?
Delete250K when you add up the pay for 5 to 7 years....not in 1 year. Perception matters.
DeleteWhat about the UK or Singapore or New Zealand?
ReplyDeleteWhy so desperate?! why plan moving some corner of the planet?
DeleteThe guy above is talking about 200+ jobs!, you guys are mentally disabled and unstable, pls show some maturity, when will you be "content?"
Dude calm down....who are you to judge?? people are just discussing
DeleteUK is the best option. I have a friend who did his second MS from Berkeley in Fin Engg and moved to UK about 6 yrs back and now he is a citizen. His salary is in upper 250k gbp range at a Bank. So yes, if you have the skills UK is good option. Healthcare and pension are lot better. guess what, he now doesn't mind coming back to US since he has UK passport. Australia I heard is getting tough ( depends upon your field. I am in finance). Singapore stopped giving citizenship to Indians but pay there is same as US ( after taxes and expenses).
Deleteambala, are you with holding a few comments? post comments i made before, don't with hold the obvious...

ReplyDeletehttps://petitions.whitehouse.gov/petition/skilled-immigration-reform
Not trying to undermine your effort buddy. But we had one petition filed a few days ago that achieved 100K and we are still awaiting response.
DeleteCan anybody plz explain what does it mean? See the latest story on 09.21.2016
ReplyDeletehttp://immigration-law.com/XXIV.html
It means you can file for 485 under EB2I if your PD is before 22Apr2009
DeleteFiling date will move upto 2011 June for EB2-I in 2017.
ReplyDeleteDon't ask me how and why.
Its just a forecast.
haha. I guess your priority date is somewhere lower than 2011.
DeleteWonder if the entire pending inventory is a farce. Many of us havent seen anyone people in EB2I with PD before 2009 JAN and EB3I before 2007. May be my sampling is incorrect but the few 100s I know all have GC's with PD earlier than 2009 MAR. Similarly I asked several of those and they dont seem to know anyone with pending I485. There might be some may be couple of 100s but I started doubting if USCIS is really accurate and honest with these numbers
ReplyDeletea friend of mine with feb 2009 PD still doesnt have his GC. However a few people i knw in mar-09 ended up getting it a few yrs back. We indians have in our DNA to not do anything. uscis shld be sued as they are creating a total mess when it comes to alloting GCs and recapturing visa numbers from last 10yrs
ReplyDeleteWe signed petition and didn't get any positive reply from White house so that definitely says we all together need to do something beyond signing petition. The wait is definitely endless.
DeleteOne of my friends was saying that the petition to wh can be filed only by US citizen (in the wake of petition to wh to designate pak as terrorist state). Filing lawsuit on ead was quashed by us court sometime back.
DeleteThe reality is that we indians are happily giving into abuse by this system. They do it because they can, because indians still flock to US despite this broken system and indians complain, kick and scream but still STAY in this system. I don't know who to blame - the US or Indians who allow themselves to be abused. Either stay in the system or just go somewhere else where the government appreciates you.
DeleteDate moved out to Nov 2007 though EAD filing date remains the same. Your predictions would be appreciated Ambals :)
ReplyDeleteMy guess is it will go to end of 2008 in next 2 vb's and thats it FOR this year. With porting involved and no rollover from eb1/eb5 it will rarely reach 2009 April. In addition USCIS is not releasing pending inventory which makes it tough to predict. Few in 2009 will get medical rfe only to find USCIS is wasting those folks money. 2009 August may take 4 to 5 years to finish.
Deleteby 2050, India will be the next superpower.
ReplyDeleteReverse immigration will start by 2045.
Just looked into Aug 2011 VB, where as for India EB2 current date was 15 APR 2007 where as after 5 years now Nov 2016 VB says EB2 current date is 01 NOV 07.. So hardly 6 months movement in 5 years... think about people who's PD is in 2015....that too hardly 2809 visa per year including family members... so hardly 750(2809/3.75) family's eligible to get GC per year.. Indians in the wait list is huge...20 years wait time is what I'm predicting...
ReplyDeleteYou are not wrong on so many levels and proofs.
DeleteEB2 Predictions for coming months..
ReplyDeletehttps://www.murthy.com/2016/10/20/november-2016-visa-bulletin-check-in-explanations-and-predictions/
We have seen and heard the same since last 7 yrs. Noting is going to happen. Only way is to get in EB1
ReplyDeleteor be a lucky EB3 porter from 2007 and before.
Haan bheiya, toh ka huaa ??
ReplyDeleteTohre GC mila ka ?
Any prediction on Adjustment of Status "Filing date" movement for FY2017?
ReplyDeleteAny prediction is as good as pulling data from thin air or going to astrologer. Best course of action is - have low expectations. that's all because EB1 fraud will not stop. EB3 porting will not stop. ROW will apply for more quotas. Hillary or Trump will not do anything for legal immigration.
ReplyDeleteSorry for being blunt.
Blunt but so true.
Deletehttps://www.quora.com/U-S-Immigration-How-much-is-the-Priority-date-for-India-EB2-green-card-expected-to-progress-in-the-year-2016
ReplyDeleteHow much was the spillover for year 2016. Where can find this information? Did EB2 get any spill over at all? Did Eb1 get any spill over from other categories?
ReplyDeletekya karega janke?
ReplyDeleteDecember bulletin is released.
ReplyDeleteLet's go home.............
DeleteMotherland calling....
Pls lead the way
ReplyDeleteI wrote this line because I would be going back to India coming Feb-2017.
DeleteNo more this crap visa, GC tension. Enough is enough. BTW, my Priority date is 2011-June. I still have a stable job here in trumpland.
The job that I am going to join in India will make me travel different countries.
At least will have some fun before I retire.
http://www.computerworld.com/article/3140711/it-careers/trumps-election-sets-stage-for-h-1b-reform.html
ReplyDeleteNone of us are going to go back voluntarily. Trump will either kick us out ( which I think is good since we can get on with our lives in our motherland) or Reps will clear the "legal" backlog first. I suspect US is going to have a immigration system similar to Canada's or UK's which will be point based ( i.e skills based) and the bar will be high enough. H1-B wont' be scraped but wage determination will be set higher and hiring period will be extended.I am hopeful that thing will change for better with immigration under Reps than Dems. Obama took office in 2008. All my friends in EB2 from 2007 and early 08' are citizens now. During Obama's 8 yrs the legal line stayed put. I am hoping under Trump's it moves faster ( and before he gets impeached)
ReplyDeleteDon't dream. Nothing is going to change
DeleteAny idea about the new bill on i140 and wad which is expected to go in effect on Jan 17, 2017
ReplyDeletehttps://www.uscis.gov/news/news-releases/uscis-publishes-final-rule-certain-employment-based-immigrant-and-nonimmigrant-visa-programs
write to DT and Bannon to stop giving visa and GC to below WITCH :-
ReplyDelete1. Wipro
2. Infosys
3. TCS
4. Cognizent
5. HCL
all problems will be solved.
That would be great , plus all the desi consultants available here! All cheats as simple as that.
DeleteHow much was the spillover from other categories to EB category this year. Did EB2 get any spill over at all? Did Eb1 get any spill over?
ReplyDeleteLatest as per Mr.Charlie from Visa office Path for EB2--- Screwed (Nothing new)
DeleteEB1 fraud from consulting firms - Exceeded 2017 fraud expectations
EB2 ROW high usage - On Track to Use everything
EB3 upgrades to choke EB2 - Firmly on track
Scope for people following legal rules -
Ouch... It just keeps hurting
Mr Trump .. Wish you add Infy, TCS and similar companies to your list after "Bad Hombres"
jan 2017 bulleting came out..nothing new as the prior post says..endless wait..winter is coming..going into eskimo mode..just survive with what you have in your cave and be happy. Check back in spring.
ReplyDeleteJan bulletin released, EB2 - 15 April 08
ReplyDeleteUpdated prediction :-
ReplyDeleteEB2-I PREDICTION
2009 - Current in 2021
2010 - Jan current in 2022 , Dec in 2031
2011 - Jan in 2032, Dec in 2058
2012 - Will never see it
2013 - will never see it
i concur , with 2800 yearly visa for Eb2 it would take 7 year x 2800 = 19600 visa to cover EB3 porter and EB2 for 2009.
DeleteSir, what will happen for those who are applying now :(
Deletegame over for you , look for canada or australia.
Deletenot sure if this realistic? I think these dates will be much sooner!!
Deleteno point in being denial.. the data and stats above are the fact.
DeleteThese are accurate. If EB1 is going to soon have cutoffs(as per USCIS), then there is no hope for Eb2/Eb3. Unless, Trump goes after Indian consulting firms. In that case, Eb1 to Eb2 spillover may happen.
DeleteDate of Filing chart is going to be current for all employment categories in February bulletin.
ReplyDeleteI will call BS on that.. do you expect mr. DT to distribute EAD card to all of us?
DeleteNot a bad dream for 2017!
DeleteI think Mr.BO may do it as his last final push...right thing to do as a relief for the backlog. Mr. GB did this in his last year....
DeleteFor January 2017 - they have reverted back to final action dates. Even in dream world it just sounds too optimistic. Wishing for crossing 2009 by itself will be improbable, let alone .. current
DeleteBO last visa bulletin is already out and nothing changed.. ppl who are illegal under DACA already have EAD..
Deletenothing is going to happen, Check the following formula, The Priority date movement will be, we have to wait for (Present Date-Priority Date)/2.5 Months,
ReplyDeleteWhat is this magic formula, Genius? So for example, if Present date - priority date = 64 months / 2.5 months = 26 (What)? Is it 26 months from today to get GC? How this formula works? Curious ...
ReplyDeleteMay be 26 years :)
DeleteThis comment has been removed by the author.
DeleteIt was just a prank ... I hope everyone get benefited by Trump Govt. Hope he will help the EB community and end this long wait or atleast streamline ... New Years Resolution .. Finger Crossed...
DeleteBrother, its 2.5 months of Priority date movement per year, mark my words if DT or his gov doesnt do anything for us. There is no magic trick that will make USCIS to move the dates just like that, in the recent OMB discussion, one of the lady clearly said, its everything is in the air right now.
Delete26 Years from above calculation, No way. I think it will streamline and something bound to happen, yaa toh iss paar ya toh uss paar, it can not be hanged for that long.
DeleteDon't count on it. EB3 guys waited 10-15 years. Most of the folks now file under EB2, so wait time can easily be around 20 years.
Deletecharlie popat has told our beloved murthy law firm as always that blah blah blah..strong eb2 demand worldwide is there, desi eb3 upgrade in full flow hence cut off date of Nov 2008 is the most likely scenario for eb2i...so if you are in late 2009 PD like me....punch a bag, have a drink and go back to work..kuch nah hone wall..india bhi jake such faidaya nah unless you are IIT+IIM TOP ranker or some sort of quota holder..we all know why we are here.no point complaining..
ReplyDeleteI completely agree, keep doing what we are doing, forget about promotion, moving up the ladder.
Deletefriends, its true that people who have PD of 2009 or 2010 might get the GC within 5-6 years, but for 2011 and so on, it will be of 15-20 years atleast. We need to have some backup plan so that we can always have some escape route planned, whether it might be going back to India or something else, without that, with job loss in US and no health insurance, life is worse than dogs on streets.
ReplyDeletePorting is a major issue, I dont think original people in EB2 will get GC soon, everything is consumed by porters.
ReplyDeleteUpdated prediction :-
ReplyDeleteEB2-I PREDICTION
2009 - Current in 2021
2010 - Jan current in 2022 , Dec in 2031
2011 - Jan in 2032, Dec in 2058
2012 - Will never see it
2013 - will never see it
2009 to 2010 in just one year - seems linear not exponential. The game of employment based GC for indians is over - not even worth putting a false hope anymore.
DeleteRemember this Murthy is part of ITSERV.
DeleteWhen and how it became linear? In last 5 years how many times it reached 2008/2009 and went back?
Delete1. Have kids in US,
ReplyDelete2. Invest in India so that you are safe,
3. In case anything happens, return back to India,
4. Make GC through kids when they grow up,
5. Return back to US with GC and get the citizenship
That is the only way now, nothing else, its all political fishing game for Indians in the name of GC, people are wasting their lives here.
This comment has been removed by the author.
Delete"Invest in India so that you are safe"? - Dude, Invest in India after Demonetization things are pretty bad, bank has too much money so they do not need money, in few years you have to pay money to bank to keep your money. This is going to happen. It's better to keep money here in 401k or IRA or Personal retirement account. It has better growth here. Do not just type blindly.
DeleteOctober 2016 Pending 485 inventory is out, Eb2 #s unchanged while Eb3 has gone down significantly to 12,000 from 20,000 in October 2016. This explains the lack of move in Eb2 as the entire available GCs in Eb2 is consumed by Eb3 porters.
ReplyDeleteOnly glimmer of hope for Eb2s with 2008/9 PD is that there are only 12 k potential Eb3 porters. This backlog may get cleared by the end of 2017 and then Eb2 can move based on the regular quota atleast....
ReplyDeleteThis is going to encourage more porting.
DeleteIf most people port from EB3 to EB2, the movement for EB3 would get better. In that case, people may start porting from EB2 to EB3 sometime in future, just like China.
DeleteOK Friends, that's it.
ReplyDeleteWith below inventory data, my updated prediction is :-
2009 - Current in 2026
2010 - Never, unless ported to EB3.
2011 - Will never see it
2012 - Will never see it
2013 - will never see it
Data to do calculation :-
1. EB1 demand went up from 20K in 2014 to 38k in 2016.
And thats going to even go further up.
2. EB3-I demand decreased from 20K to 18K which are mostly porting.
EB2-I is done deal.
October 2016 38,921
October 2015 27,843
October 2014 20,162
October 2013 13,849
October 2012 13,905
October 2011 14,072
"2011 - Will never see it", I am EB2-I and has PD of 2011, i will see my EAD this year and GC may be next or max to max 2019. Mark my words.
DeleteIf quiet a few people start porting from EB3 to EB2, the queue for EB3 will start to get shortened and will make the dates to move little faster for Eb3 resulting in less porting and even prompt some in EB2 to file in EB3 clearing the queue in EB2. There will be years where the EB1 filings will go down(atleast I hope so) and rest of world. There were years when eb2I got 23k visas. Keeping all that in mind , my guess is 2009 : 2020. 2010: 2023 2011: 2026, 2012: 2030. In addition to that, I feel that there will be some change in immigration law within the next few years. Be positive and hang in there. Do remember that india is your home country which you can always go back to.
ReplyDelete"2011: 2026", 2011 - EAD in 2017 and GC by 2019. My prediction.
DeleteThere are 39K managers came to USA from India in 2016 alone.
ReplyDeleteUnbelievable !!!
Yes .. Credit goes to the following people.
DeleteAll consulting companies for exporting anyone who knows to type using keyboards
US government for coming up with the stupid policy of giving L1 blanket petitions, just to lower their operational burden
All the lawyers who are the forefront of "partner in crime" doing unethical work.
these inventory numbers are as worse it can go.. no wonder.
DeleteGurus,
ReplyDeleteI looked at the below link. But could not find how many visas are issued in 2016 for India EB2 and EB3.
https://travel.state.gov/content/visas/en/law-and-policy/statistics/annual-reports/report-of-the-visa-office-2016.html
Where to find the numbers?
Thanks,
Prasad
what is the real scenario ?? anyone '
ReplyDeletepeople here are just venting out but no real guidance
No body knows "real scenario". Please help fight against EB1C abuse. Only that will provide faster green cards to eb2 and eb3.http://www.trackitt.com/usa-discussion-forums/i485-eb/1408711431/-imp-all-eb2i-waitring-flower-campaign-a/page/last_page
ReplyDeleteSpread the word, take decisive action and send the letters ASAP.
I'm pretty sure things will move pretty fast in the next 3 years and the process will be streamlined.
ReplyDeleteI don't think USCIS | DHS will make people wait beyond 10 years to get their EAD eventually a Green Card shortly after.
People who write stories of 29 year wait times need to lighten up and stop being desperate, needy. Time to grow up.
1. I do not understand this logic ever, when people write such stories "29 Years and waiting and still no green card", how it is possible logically, If someone is here from last 29 years and never applied for GC process (i mean applied for the Perm, i-140 late), then sure he has to wait. Otherwise I see people from 2007 are waiting from last 9 Years. How this 29 Years wait logic is coming in?
DeleteFeb 2017 VB is out. No change at all. Thinking if the govt. is too bored that they publish the old VBs all the time. Annoying....
ReplyDelete
